Re: Cattaraugus County Bus and Van Services Bid Specifications Questions and Answers—Number 1

Potential Bidders have asked certain questions concerning the above referenced Bid Specifications. Following are those questions and the answers.

1. Appendix E, page 49, shows thirteen vehicles in the Rehabilitation Center inventory. Are all thirteen vehicles on routes, or are there spares?

All thirteen vehicles will be utilized on routes.

2. How many additional 5310 vehicles are on order by the Rehabilitation Center? Does the Rehabilitation Center get new vehicles annually?

The Rehabilitation Center secures additional vehicles as state funds are granted to it. This may or may not happen in the future. Presently three additional 5310 vehicles are on order. It is presently expected that such vehicles will be delivered in twelve to twenty- four months.

3. What is the present basis on which the transportation contractor for the Rehabilitation Center is paid? What is the present basis on which the transportation contractor for Cattaraugus County is paid?

of 24 The Rehabilitation Center’s present transportation contractor is paid a “flat fee” each month.

The County’s present transportation vendor is paid a “price-per-mile.” This price varies based on the “zone” that a vehicle travels into.

It must be noted that the foregoing payment bases will not apply with regard to the contract to be executed pursuant to the Bid Specifications. As stated in Appendix E of the Bid Specifications, the price basis (or “unit of transporter payment”) will be the “Rate Type” applicable to each type of vehicle the prospective contractor will supply and the Rate Type for the 5310 vehicles, and the unit of time each such vehicle is operated (i.e. 2- hours, or 4-hours, or 6-hosurs, or 8-hours).

4. How many miles are driven on each route presently serviced on behalf of the Rehabilitation Center and the County?

The current daily mileage for each route shown on page 48 of the Bid Specifications is as shown in Addendum 1 attached to this memorandum.

5. Can you provide copies of the current vehicle routes? How many days per year are the vehicles scheduled to run?

a. The current routes run on behalf of the County and on behalf of the Rehabilitation Center are attached as Addendum 2 to this memorandum. It must be noted that the state and Federal regulations regarding the confidentiality of health information, permit disclosing the names and addresses of passengers only as necessary to actually provide their required services. This means that though the successful bidder will be provided with this information, prospective bidders may not be. As a result of the foregoing, the routes shown in Appendix 1 show only street names and towns.

b. With regard to the routes shown on page 48 of the Bid Specifications:

i. The Rehabilitation Center vehicles (vehicles 1 through 13) are presently scheduled to operate approximately 260 days per year;

ii. The majority of the vehicles that provide services on behalf of the County are presently scheduled to operate approximately 210 days per year.

The exact number of days each vehicle will be scheduled to operate in the future cannot yet be determined. The days on which services are provided to various passengers, passenger counts, and/or the locations of pick-ups and drop-offs might change. Such changes might necessitate variations in vehicle usage requirements.

of 24 6. How many driver assistants/monitors are currently being used on a daily basis?

Eight driver assistants/monitors are currently used on a daily basis. Most driver assistants/monitors are required for only 2 to 6 hours a day. However, approximately 2 to 3 might be required for 8 hours a day.

7. Are the current drivers and driver assistants/monitors members of a union? If yes, which union?

In the context of this bid specification, the question lacks relevance. If a transporter not presently providing services to the County or the Center is the successful bidder, the union status of the current contractor would not affect the employees hired.

8. Is the County scheduled to replace any of the County owned buses during the contract? If not, to what extent is the contractor responsible for repairs (i.e. engine replacement, transmission replacements, etc.)?

a. Cattaraugus County does no own vehicles. The 5310 vehicles are owned by the Cattaraugus Rehabilitation Center.

b. Additional vehicles that will be secured by the Rehabilitation Center will be pursuant to available 5310, 5311, or other similar grant. Please see question 2, above, for additional pertinent information.

c. The transporter will be required to follow the Rehabilitation Center’s established policy for cosmetic maintenance. The Rehabilitation Center will meet with the successful bidder and review its policy as to what is the acceptable standard of cosmetic maintenance. The successful bidder will establish a maintenance schedule that ensures the cleanliness of the interior and exterior of the vehicles in the Rehabilitation Center’s inventory.

d. In the event that so-called “major repairs,” such as the replacement of an engine, transmission, etc. are required, the successful bidder will undertake and complete such repairs at its expense.

9. With respect to preschool children to be transported, can the County provide the required car seats? How many car seats/harnesses are currently used on a daily basis?

a. The successful bidder will be responsible for securing and installing all required car seats, and for securing any required harnesses.

b. Currently 55 car seats are required. The bidders are advised that this is subject to change as children with special needs enter and age out of their programs. Future requirements of car seats and harnesses will be determined by the children’s ages,

of 24 and special needs. Information as to such requirements will be provided to the successful bidder by the County’s Transportation Consultant on an ongoing basis.

10. Can you note the size, passenger capacity, and body type (i.e. school bus, cut-away, etc.) of the vehicles that the contractor is to provide? (Reference was made to the Bid Sheets shown on page 50 of the Bid Specifications).

a. With regard to the vehicles referenced on in the Bid Sheets (page 50 of the Bid Specifications) and as implied on the chart on page 48 of the Bid Specifications, no body type is specified. It should be noted that school buses (i.e. vehicles painted “school-bus yellow, and having flashing lights and a swig-out Stop sign) are specifically not required.

b. The projected number of vehicles of each size that might be required are as shown on the Bid Sheets (i.e. “Vehicles req. for evaluation”).

c. With regard to wheelchair vans, historically few Cattaraugus County children with special needs have required wheelchair service. Presently there is only one such child. However, so as to account for future needs, it is recommended that wheelchair vehicles have a capacity for no less than two wheelchairs, and seating for four “walk-on” children. All wheelchair vehicles must have a lift.

11. Can you be specific as to what kind of vehicle a “Van” is?

A Van must be capable of seating a minimum of seven passengers, and must meet all Department of Transportation (DOT) requirements. There are no other requirements specified.

12. Are all requests for transportation made by the various Agencies and Departments, or do the travelers themselves call in to request required transportation?

The travelers/passengers do not call the transporter to request transportation. Transportation requests are made by the respective Agency or Department, through the County Transportation Consultant. However, passengers (or their caregivers) might call the transporter directly to advise that transportation will not be needed on a specific day.

13. With regard to Liquidated Damages, are you able to give an accounting for the number of instances in which Liquidated Damages were applied to the current transportation vendors? Please also provide the amount of the financial penalties that the transportation vendors encountered as a result of Liquidated Damages.

a. As stated in Section VII, page 33, of the Bid Specifications, unless a failure to perform as required might lead to a risk of liability to the County or to the Center, a warning will always be issued. During the past three years, we have a record of only one instance in which an incident of such a serious nature occurred.

of 24 Our records indicate that over the past 3 years, warnings have been issued for lesser failures an average of seven times a year. On average in only two instances were the failures repeated, resulting in the assessment of liquidated damages.

b. The average amount assessed in a single specific instance has been approximately $250.

14. Because bids that exceed current contract cost can be rejected, can you please supply the rates that are being paid to [the present contractors that provide] the services mentioned in IFB.

a. Because the prices for vehicles paid by the County are presently based on a price- per-mile basis and the prices paid by the Center are presently based on a flat fee- per-month, and because these “units of payment” are changed in the present bid specifications, only a total annual cost of the vehicles can be stated. This annual amount is approximately $1,560,000.

b. The current amount being paid for driver assistants/monitors is $32.83 per hour.

15. With regard to the vehicles shown in the Rehabilitation Center’s inventory, are you able to list the current odometer readings, and the body type (i.e. school bus, cut-away, etc.)?

Because many of the vehicles are presently in use, it is not possible to provide this information at this time. We will collect the information requested and provide it in a subsequent Q & A memorandum.

16. How and when is the lease fee [for the vehicles in the Rehabilitation Center’s inventory] to be paid?

Other than the annual lease price per vehicle and the fact that major repairs will be the successful bidder’s responsibility, the terms of the lease agreement between the Rehabilitation Center and the successful bidder will be the subject of a negotiation between those parties.

17. In the chart [at the top of page 48] the times 6:00 am to10:00 am, are noted for each of the AM, Midday, and PM time segments. Are these the correct time periods?

The correct time periods are: AM: 6:00 am to 10: am Midday: 10:00 am to 2: 00 pm PM: 2:00 pm to 6:00 pm

18. A bid for driver assistants/monitors is mentioned, however, there is not a spot on the Bid Sheets to submit the bid.

of 24 As stated, there is no spot to place a bid for a driver assistant/monitor. That is an error. Attached as Addendum 3 is a corrected Bid Sheet, with a place indicated to enter a bid for the price to be charged for 2 hours of driver assistant/monitor’s time.

Also in Addendum 3 is a corrected example of the manner in which the “total weighted average price” will be calculated.

19. How many full-time personnel are currently being used by the current contractor (i.e. contract manager, dispatcher, safety supervisor)? Why do the Bid specifications not require staffing levels?

We have no information as to the number of full-time personnel the current contractors utilize in ensuring compliance with their respective contractual requirements.

The Bid Specifications specifically mention tasks to be performed by a dispatcher. Also discussed are specific safety and performance requirements. The manner in which the successful bidder applies its personnel in fulfilling its obligations is best determined by the transporter, which is expert in it own business operations.

20. Item X, Paragraph B, page 38, requires a $10,000 Performance Bond in the form of a cashiers check or certified check. Will the County accept a performance bond in lieu of a cashier’s check?

The County will not accept a performance bond in lieu of a certified check or a cashier’s check.

21. Can you provide a copy of the current contract(s) with the applicable rates.

Copies of such contracts are not available. The rates (i.e. the total annual amount paid to the current service providers) during 2011 have been disclosed in response to question 14, above.

22. Can you provide copies of the last three month invoices submitted by the current transportation vendors?
