NOTICE OF INTENT TO AWARD: Timber Sale Contract No.

Pursuant to Oregon statutes and published notice, bids were received by the State Forester on , in , Oregon, for certain designated timber on State-owned lands in County, Oregon.

(CASH DEPOSIT) The bid was accompanied with sufficient deposit to be applied to the purchase price of the timber, or as liquidated damages for failure to qualify under the terms of the proposed contract.

(BID BOND) The bid was accompanied with sufficient bond to be applied as liquidated damages for failure to qualify under the terms of the proposed contract.

The State Forester, acting on behalf of the State of Oregon, Department of Forestry, hereby accepts such bid for the purchase of timber described in the enclosed contract. As provided in the Notice of Timber Sale, the Form of Proposal and Instruction to Bidders, you will forfeit your bid deposit unless you qualify under all of the terms of the contract within 30 days of this notice.

Be advised that OAR 629-029-0110 (3) allows 14 days from the date of this letter for aggrieved bidders to protest the award of this sale. You should be aware that this contract will not be executed by the State Forester until that 14-day period has expired, or . Instructions to Qualify for Sale:

According to the Oregon Secretary of State, on , your business is due to renew registration with the Corporation Division of the Secretary of State’s Office for the year as required by Chapter 57, Oregon Laws. The sale is contingent upon that re-registration. DELETE IF NECESSARY

The requirements outlined below must be filled within 30 days of the date of this letter. No operation will be permitted before complying with these requirements and receiving written notice from State.

The enclosed contracts are ready for signing. As noted below, in order to finalize the qualification process you will need to either have on file with this office a list of individuals authorized to sign for your firm, or send one with your signed contract. An additional copy of the contract is provided for your surety. DELETE LAST LINE IF INDIVIDUAL

Please sign the first page of both contracts and return the two signed originals to Oregon Department of Forestry, Attention: Management Division, 2600 State Street, Salem, Oregon 97310, along with the requirements listed below. An executed copy of the contract will be returned to you once you qualify as described in this letter. NOTE: PLEASE SEND THE REQUIRED PAYMENTS TO: DEPARTMENT OF FORESTRY, UNIT 12, P.O. BOX 4395, PORTLAND, OR 97208-4395.

Amount due, first installment payment: $ per Section 1750.

Performance bond required: $ per Section 1210. Performance bond forms and other surety forms acceptable to State are enclosed.

Contract requirements per Section 1240 are met by certificates of insurance on hand.

The Insurance Requirements list is enclosed for use by an insurance company in providing coverage and evidence per Section 1240.

Section 1230 of the contract requires a Timber Payment Bond or a Blanket Timber Payment Bond adequate to cover one installment of the sale or sales listed on the bond. Our records indicate that your Blanket Bond that is on file is sufficient to cover your sales at this time. Application for Addition of Timber Sale Contract to Blanket Timber Payment Bond forms are enclosed.

Our records indicate that you do not have an active Payment Bond on file at this time. Your Payment Bond must be at least $ (amount equal to one installment). Timber Payment Bond and Blanket Timber Payment Bond forms are enclosed.

Our records indicate that your Blanket Bond that is on file is insufficient to cover your sales at this time. Your Blanket Bond is currently $ and therefore needs to be increased to at least $ (equal to total of one installment for each active sale). Surety Rider forms are enclosed for your use. Applications for Addition of Timber Sale Contract to Blanket Timber Payment Bond forms are also enclosed.

Return a list on company letterhead showing individuals authorized to sign contracts or contract modifications for your company. DELETE IF INDIVIDUAL

Access documents are enclosed per Section 2120. Third-party payment requirements are outlined in Section 2120.

Please be advised that failure to meet the above requirements within 30 days of the date of this letter could result in retention of bid bond by STATE as liquidated damages.

A Public Safety Road Fee is required for this timber sale (see Section 2110). An initial payment of $ shall be made to Tillamook County within 30 days of the date of the signed timber sale contract. The initial payment (and subsequent payments) may be delivered or mailed to: Tillamook County Treasurer, Tillamook County, 201 Laurel Avenue, Tillamook, Oregon 97141.
