Conversion to ACE – CBP Modifies Mandatory Filing Schedule

Customs and Border Protection (CBP) modified its mandatory filing schedule for entries and entry summaries in its Automated Commercial Environment (ACE). CBP set two new dates for filing in ACE based on the entry scenario, and advised that throughout the summer of 2016, additional entry scenarios will become mandatory as it pushes to convert all activity to ACE. Following is a recap of the CBP requirements.

March 31, 2016  Entry summaries with no participating government agency (PGA) data, except foreign trade zone (FTZ), quota, and warehouse entries.

 Cargo release and entry summaries for shipments that involve the Animal and Plant Health Inspection Service (APHIS) for Lacey Act or the National Highway Traffic Safety Administration (NHTSA), unless paired with other PGA data.

 Entries subject to the Food and Drug Administration (FDA) have not been assigned a new mandatory filing date.

 Entries subject to NHTSA or APHIS-Lacey Act that are also subject to another non-FDA PGA may be filed in ACE Cargo Release with the other agency’s requirements satisfied by submitting documents to CBP’s Document Imaging System (DIS) or directly to the other PGA as directed by such PGA.

May 28, 2016  In addition to the entry summaries, cargo release will be mandatory when no PGA data is required.

 Cargo release and entry summaries for FTZ entries with no PGA data, except when subject to quota.

 Filing requirements for PGA data are the same as the March 31st requirements.

Summer 2016 (Specific dates to be determined by CBP)  Quota entries, including FTZ entries subject to quota

 Entries subject to an additional 13 PGAs

Schenker Filing Status Following its early adoption plan, Schenker is currently filing nearly all entry activity in ACE that CBP has deployed. FTZ entries are being converted on an individual client basis. We have begun filing entries subject to NHTSA and APHIS-Lacey Act requirements and are actively seeking to pilot FDA entries. If you import goods subject to one of these three agencies and have not yet discussed the requirements with Schenker, please contact your Schenker brokerage office. The PGAs require information that is in addition to their current agency forms and we have templates available to assist in the data collection process.
