Intent to Adopt New Rules

Public notice is hereby given that the Department of Workforce Services (DWS) intends to file new rules pursuant to the Wyoming Administrative Procedures Act, W.S. § 16-3-101, et seq., the Public Works and Contracts Act, W.S. 16-6-101, et seq., and the Wyoming Preference Act of 1971, W.S. §§ 16-6-201, et seq.

Chapter 4 – Certification of Resident Contractors, Suppliers and Enforcement of Preference Laws

The Department of Workforce Services is seeking to modify rules governing the Certification of Resident Contractors, Suppliers and Enforcement of Preference Laws. DWS is modifying these rules in order to ensure compliance with HEA 0032 passed in the 2012 legislative session wherein language was added which will affect enforcement of resident labor and supplier preference laws on public works projects.

A public hearing regarding the proposed rules will be held if requested by 25 persons, by a governmental subdivision, or by an association having not less than 25 members.

DWS welcomes all comments and suggestions on these proposed rules. The public comment period is planned from September 29, 2012 through November 13, 2012 at 5:00 p.m. Any person may urge DWS to not adopt the proposed rules or modify them and may request that DWS state its reason(s) for overruling the consideration urged for modification or against adoption of the proposed rules. Interested parties may request a statement of DWS’s position regarding each comment and the action taken as a result of the comments prior to or within thirty (30) days after adoption of the rules. Requests must be submitted to the above mentioned address.
