Printed 2/19/13--H. 10 Read the first time February 6, 2013. 11 12 13 THE COMMITTEE ON WAYS AND MEANS 14 To whom was referred a Joint Resolution (H. 3501) to provide 15 that the provisions of Section 62750, Code of Laws of South 16 Carolina, 1976, relating to restrictions on amending or repealing 17 provisions in the State Aid, etc., respectfully 18 REPORT: 19 That they have duly and carefully considered the same and 20 recommend that the same do pass: 21 22 W. BRIAN WHITE for Committee. 23 24 25 STATEMENT OF ESTIMATED FISCAL IMPACT 26 REVENUE IMPACT 1/ 27 This joint resolution is not expected to impact state revenues. 28 Local revenues will not be directly impacted by this joint 29 resolution that allows the General Assembly to suspend required 30 funding to Aid to Subdivisions for FYs 2013-2014 and 2014-2015. 31 Local government revenue from the State Aid to Subdivisions 32 Fund will be determined by the General Assembly in the 33 Appropriation Act. 34 Explanation 35 This joint resolution allows an amendment to the State Aid to 36 Subdivisions Act for Section 6-27-50. Under Code Section 6-27- 37 30, four and one-half percent of general fund revenues of the latest 38 completed fiscal year must be appropriated to the Local 39 Government Fund. Code Section 6-27-50 requires that special 40 legislation be passed to suspend this requirement. Under proposed 41 Proviso 110.5 with the Ways and Means Committee from FY 42 2012-2013, the provisions of Section 6-27-30 and Section 6-27-50

[3501-2] 1 of the Code are suspended. Since this was previously suspended, 2 local revenues will not be directly impacted by this joint resolution 3 that allows the General Assembly to suspend required funding to 4 Aid to Subdivisions. Therefore, local government revenue from 5 the State Aid to Subdivisions Fund will be determined by the 6 General Assembly in the Appropriation Act. 7 8 Approved By: 9 Frank A. Rainwater 10 Board of Economic Advisors 11 12 1/ This statement meets the requirement of Section 2-7-71 for a state revenue 13 impact by the BEA, or Section 2-7-76 for a local revenue impact or Section 6-1- 14 85(B) for an estimate of the shift in local property tax incidence by the Office of 15 Economic Research.

[3501-3] 1 2 3 4 5 6 7 8 9 A JOINT RESOLUTION 10 11 TO PROVIDE THAT THE PROVISIONS OF SECTION 62750, 12 CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING 13 TO RESTRICTIONS ON AMENDING OR REPEALING 14 PROVISIONS IN THE STATE AID TO SUBDIVISIONS ACT 15 ARE SUSPENDED FOR FISCAL YEARS 20132014 AND 16 20142015, AND TO PROVIDE THAT FOR THOSE FISCAL 17 YEARS COUNTIES MAY TRANSFER AMONG 18 APPROPRIATED STATE REVENUES AS NEEDED TO 19 ENSURE THE DELIVERY OF SERVICES. 20 21 Be it enacted by the General Assembly of the State of South 22 Carolina: 23 24 SECTION 1. The provisions of Section 62750 of the 1976 Code 25 for fiscal years 20132014 and 20142015 are suspended. 26 27 SECTION 2. Notwithstanding other provisions of this joint 28 resolution, for those fiscal years provided in Section 1, counties of 29 this State may transfer among appropriated state revenues as 30 needed to ensure the delivery of services. 31 32 SECTION 3. This joint resolution takes effect upon approval by 33 the Governor. 34 XX 35
