Draft Poole Street Market Strategy

1 Introduction

1.1The objective of this strategy is to improve the quality of the Street Market by building on the traditional market strengths of; variety, atmosphere and value for money. 1.2It is intended that the street market will continue to complement the town centre by encouraging new visitors and enhancing all visitors experience of the High St. Any improvements to the Street Market will complement the changing needs of the town and meet the expectations of customers, visitors and stakeholders alike.

1.3This strategy shall also assist the council in making provision for the new EU Directive that allows online application of permits from any European member state citizen.

1.4The definition of Street Traders for the purposes of this strategy is defined as doing any of the following things in a public place:

 Hawking, Selling, or Offering or Exposing for sale any article;  Offering to carry out or carrying out for money or money's worth any service.

1.5 Definition of "Public place" Any place (whether a thoroughfare or not) to which the public have unrestricted access. For the purposes of this strategy the definition specifically relates to any lawful trading activities that take place on the High St from Falkland Square to Old Orchard

1.6 Definition of Street Trading The sale and exposing or offering for sale any article (including a living thing) in a consent street. For the purposes of this document the definition can refer to “concession” traders who are trading in the High Street on a daily basis as well those operating as part of the Street Market.

1 2 Background

2.1The Borough of Poole was granted a Market Charter in 1453. During the Second World War the market stopped and Poole was no longer classed as a market town. The Street Market was not reinstated until 2004 when the then Town Centre Manager campaigned to reopen the street market after 12 months of research and consultation with the public, residents, the local High Street traders and the Borough of Poole.

2.3The Borough of Poole, in accordance with Paragraph 2 of Schedule 4 of the Government (Miscellaneous Provisions) Act 1982, made a resolution to re- designate the High Street from Falkland Square to Old Orchard as a consent street (i.e. where trading is prohibited without the consent of the Council). The primary purpose of this re-designation was to allow a weekly Town market. Other trading may be considered.

2.4 In February 2004 the High Street from Falkland Square to Old Orchard was re-designated as a consent street for trading activity under the above Act

2.5 The street trading activities raise around £113,000 per year. This enables Town Centre Management to deliver the 32 projects in its annual business plan.

2.6 In 2009 the Town Centre Management Board invested in a review of the street trading activities to ensure that the Street Markets were in fact making a positive contribution to the Town Centre.

3 Research

3.1 Three key pieces of research were undertaken to asses the impact of the Street Market Traders.

3.2 Research Summary

1) The Poole Opinion Panel research in the summer of 2009 revealed that the majority of residents think the street market is a positive asset to the Town Centre. 2) The Bournemouth University Market Research Group undertook a week long visitor survey that revealed that over 80% of visitors thought the Street Market was a positive attribute to the Town Centre. 3) A survey of 104 businesses in the Town Centre revealed that over 80% thought that the Street Markets were a positive asset to the Town.

2 4 The Purpose

4.1 The High Street is a unique area and draws many people towards the Quay and Old Town. Improvements made to the High St Market will make the High St more attractive, friendly, install greater confidence in the consumer and leave visitors with a more positive impression of the Street Market and thus Poole Town Centre. The Street Market should be designed to encourage pedestrian movement up the High St and towards the Old Town and Quay in order to increase footfall in the lower end of the High St. The overriding issue being to provide added value to the Town Centre.

5 The 2011 Street Traders Policy for all stalls

5.1 All New Street Market Stalls (Including Concessions) are to apply for a permit using a formal application process. See below:

5.2 Concessions A maximum number of 6 concessionary stalls in the Town Centre at any one time. The exception being at Christmas time or for other specialist markets.

5.3 Trailer Stalls A maximum of 3 trailer style stalls in the High St at anyone time. (Excluding marketing events vehicles booked in through the Town Centre Management office)

5.4 Product Allocation No more than two stalls selling the same products on the same day.

5.5 Zones and Pricing (See full price tariff Appendix C ) Zone 1 - Food and Plant Stalls only. Standard pitch fee Zone 2 - Standard pitch fee Zone 3 - Discounted pitch fee Zone 4 - First four weeks of trading free in any one calendar year. (£5 per pitch afterwards) January and February are half price rents with the exception of Zone 4

5.6 The terms and conditions in the Street Traders Permit shall apply in addition to the above.

5.7 Visual Improvements a. The permitted gazebo tops for the Street Market will be yellow and blue with one colour on each side. The Poole Town Centre Management logo and the “Poole Street Market” text will be shown to the front of each stall. No other colour Gazebos shall be allowed. b. Side sheets shall be clear plastic or matching blue or yellow. c. Table covers shall be blue. 6. New Street Trading Applications

6.1 The Street Trading Fact Sheet (See Appendix A) is available on request or by visiting pooletowncentre.com

6.2 Requests for new stalls are to be in writing or email or via the Borough of Poole’s online Street Trading Permit Enquiry Form or by contacting Poole Town Centre Management..

6.3 For Concession stall requests, at least three Town Centre Management Board members are to be informed and comments received to assist in the decision of the application. This shall be guided by the Town Centre Manager.

6.4 Consideration of all new stalls shall be based on the following: I. The ability to add value to the Town Centre II. The impact on the existing street traders and retailers III. The visual quality of the Stall IV. The quality of the product V. The size of the stall VI. Any unpleasant smells/ fumes or smoke VII. The need for electricity supply VIII. The amount of and disposal of waste produced by the stall. IX. The number of trading days required X. Seasonal conditions (such as Summer or Christmas festivities) XI. Conditions and regulations in the Poole High Street Market Fact Sheet XII. Any other condition that may not be listed here but which may be regarded detrimental to the High Street environment in general.

6.5 Decisions made using this procedure and applying the detailed criteria above will be final. 4

Appendix A

STREET TRADING FACT SHEET 2010

DO I NEED A PERMIT?

In general, any form of selling of goods or the provision of services which takes place in the street or on the public footway, or up to 7 metres distance from any street, will require a permit. This includes some forecourts to which the public has access without payment.

ARE THERE ANY EXCEPTIONS?

Yes. The exceptions are:-

 The sale of current newspapers or periodical from small ‘dumb sellers.  The sale of current newspapers and periodicals, if carried by the seller.  The delivery of milk or other perishable goods to the occupier of premises adjoining a street.  Authorised charitable collections.  Pedlars trading from home to home who hold a pedlar’s certificate.  Trading from the forecourt of a shop provided: i) the trading forms part of the business of the shop; and ii) the trading takes place whilst the shop is open to the public for business.

WHERE CAN I TRADE?

Trading can take place only from designated streets or parts of streets that are usually referred to as pitches.

As in the case with many markets certain days are regarded as 'Market Days' although spaces are of course available for trading on other days in the week as a concession stall. Generally speaking Thursday’s and Saturdays are peak trading days. 1

WHAT ABOUT WAITING LISTS? ( For Concessions)

Although there are currently vacancies in Poole Town Centre Markets. It is expected that a waiting list for the pitches Under Town Gate Bridge and the walk way through from the train station to Falkland Square will be up to 2 years. For other sites, you should be prepared to wait for a considerable time for vacancies to occur, as most waiting lists are quite long. However an application to be added to Poole Town Centre Managements waiting list is permissible for a pitch that is presently occupied.

If you wish to be considered for a market pitch where there are no vacancies at present, you must complete a waiting list form, which you can obtain by contacting Poole Town Centre Management on 01202 649433. Once completed you will need to return this form to [email protected]. You will be contacted when a pitch becomes available and invited to apply for the vacancy. No money will be required at that stage.

It must be noted that being near the top of the waiting list does not guarantee obtaining a pitch. If more than one application is received for the same vacant pitch, the application will be put to the Board of Poole Town Centre Management, who will review each applicant, taking into account:

(a) The current Street Market Strategy for Poole High Street. (b) The applicant’s position on the waiting list or when a person is not on the list whether any special circumstances apply; (c) The commodities to be sold bearing in mind the size and location of the vacant pitch and any market (or area) policy. (d) The arrangements for the stall after trading hours; (e) Ability of the applicant to personally work the pitch and to comply with street trading laws and the Council’s Standard Conditions and Council Policy.

WHAT IS THE PROCEDURE IF VACANCIES ARE AVAILABLE?

You can apply for a permanent permit by making an appointment with the Market Manager, who may be contacted in the first instance, on Tel: 01202 649433. You will be required to attend an interview.

You will need to bring to the interview:-

 Three identical full-face passport sized photographs of yourself without sunglasses, taken within the preceding 12 months. These photographs must be signed by yourself on the reverse.  Proof of address – (this could be a utility bill such as council tax or gas bill)  Photo ID (passport or driving permit)  Any relevant fee

You will also need to produce evidence of third party insurance cover before a permit can be issued, proof of address and evidence of eligibility to work in the UK.

When an application is made for a permit, officers will take into account the guidelines in the Street Traders Strategy. You should bear this in mind when applying as your application could be refused even when there are vacancies. THE MAKING OF AN APPLICATION DOES NOT GUARANTEE THE GRANT OF A PERMIT.

Once you get a permit you will be expected to abide by the permit conditions and carry out any reasonable direction of the Council's Officers. 2 Permits remain in force, unless cancelled or revoked.

A permit can be cancelled at any time subject to WRITTEN notification, the Trader will be to return the permit document.. Should, however, the permit be lost by the trader the permit will be formally cancelled.

Contract and Permit You will be required to complete a Street Traders Permit application form which will also be your permit under the terms and conditions within. WHAT WILL IT COST ME?

See Appendix C for the pricing Tariffs or pooletowncentre.com for the latest tariff. The amount you pay is based on the number of days of the week on your permit. You can, if you wish, pay in advance or by standing order, which is positively encouraged by the Council, or cash collected by the Market Manager, which will be receipted by an official Borough of Poole receipt.

3 4 WHAT IF I WISH TO SELL FOOD?

Food Business Registration Subject to a few exemptions, all food businesses (including market stalls, delivery vehicles and other moveable structures) must be registered with the Local Authority at least 28 days prior to commencement of trading. Registration is a one off exercise, which cannot be refused and is free of charge.

Vehicles and stalls should be registered with the Local Authority where the vehicle/ stall and/or the stocks of food to be sold are ordinarily kept. If this is different from your home address and you are preparing and/or storing foods for the business at your house, your house will also need to be registered as a food premises in the Borough in which you live.

Hygiene Regulations Please refer to the separate guidance booklet provided, which details fully the legal requirements that you need to comply with. The key areas are summarised below; how these apply to your business will depend on the type of foods you intend to supply:  Implementation of a Food Safety Management System (HACCP)- with particular reference to temperature control of high-risk foods  Food Hygiene Training for food handlers  Facilities for the hygienic cleaning of hands and equipment  Precautions to ensure food is protected from contamination  Structural requirements to allow easy cleaning of the stall/vehicle  Labelling requirements  Storage and Disposal of Waste

Other Considerations Planning Restrictions If you are intending to prepare or store food at your house, it is advisable to check your house deeds. Some deeds have covenants preventing the use of the house for any commercial use. Additionally, you may need planning permission to store a vehicle used for transporting a food stall or for the food stall itself. The local authority in which you live should be contacted for further information.

LPG If LPG is to be used on the stall, a Gas Safety Certificate will have to be provided. The Certificate should be obtained from a “Gas Safe” registered engineer www.gassaferegister.co.uk Electrical Connections 4 All electrical equipment and connections provided by the trader must be safe and suitable for intended use, with particular regard to the external location and potential wet conditions. Confirmation should be obtained from a suitably qualified and competent electrical engineer.

NB: Please ensure that you completed Form B, confirming details of your food business, as part of your permit application.

1. Personal Details This section requires you to provide details of the consent holder. The consent holder must take an active part in the running of the business. A home address and a contact telephone number(s) for the consent holder MUST be given.

2. Proposed Location of Trading Trading is only allowed in the High St area between Falkland Square and Old Orchard. Your pitch will be allocated to you by Town Centre Management. The reason for this is to ensure that your stall does not affect the surrounding businesses in a harmful way.

3. Requested Dates and Times of Consent The maximum permitted consent is 12 months You may request a consent which is less than the maximum permitted time and as such the fee will be calculated accordingly. Please indicate the days of the week and the proposed times of trading for each day.

4. Types of Goods This section requires you to list ALL of the types of goods to be sold. Do not be too general in listing the type of goods.

5. Method of Street Trading This requires details of the type of vehicle or stall e.g. van, stall, vehicle etc, together with any vehicle registration number associated with it. You must also indicate the dimensions of the pitch and whether or not you need an electricity supply.

6. Food Traders There are specific requirements relating to the sale of food. The legal requirement to register is found in Article 6(2) of Regulation (EC) No. 852/2004 on the Hygiene of Foodstuffs. You must register your mobile / static food business with the local authority in whose area the vehicle is stored when not in use. You must include all of the extra food hygiene information detailed in Section 6 of the application form in support of your application. Forms A and B also need to be completed

Appendix G 7 POOLE TOWN CENTRE MANAGEMENT

STREET TRADER PERMIT 2010 For All Traders

PART ONE General Regulations

1. Trader Registration / Application 1.1 All traders must complete a trader registration / application form before commencing to trade at the market and any subsequent changes to the details/information provided therein must be notified to the council in writing.

1.2 Traders will be required to provide proof of identity and residence by way of a domestic bill i.e. current gas/electric bill, bank statement etc. showing name and address or other such proof. All traders shall have the necessary permissions to work in the UK.

1.3 The Market Manager reserves the right to not let a pitch, even if vacant, if in the opinion of the Market Manager to do so would disrupt the balance of trades and harmony between retailer and street traders in the High Street

2. Trading Days and Hours 2.1 All pitches must be fully set up with full product display and open for business at all times during the stipulated trading hours. Trading should not take place before or after the stipulated times which are for the time being: 8.30am – 5pm

2.2 Any changes to these times will be notified in writing by the Council.

2.3 In the event of emergencies or severe weather conditions the Market Manager may at his/her discretion amend the trading times.

3. Attendance (Regular traders only) 3.1 Regular traders are to be in attendance on their allocated pitches by no later than 8.15am each market day.

3.2 Failure to attend the market by 8.15am will result in the pitch being available for re-allocation for that day to a casual trader or as an additional pitch for an existing regular trader.

3.3 In the event of unavoidable delay due to illness, breakdown or other reasonable cause, the Market Manager may reserve the pitch at his/her discretion upon being notified in advance and no later than 8.15 a.m. on the market day in question of the estimated attendance time and the reason for the delay. In situations where any trader regularly telephones the market manager to notify late attendance, the Market Manager may refuse to reserve the pitch.

3.4 If, after requesting the Market Manager to reserve the pitch and the regular trader then fails to attend, that trader will also be liable for paying the casual fee that the pitch would have attracted, but only in cases where casual traders have been turned away due to lack of space.

3.5 Every Regular trader is required to provide one weeks notice of terminating their allocated pitch.

4. Trading Charges 4.1 When a trader is allocated a regular pitch they are required to pay 1 weeks charge in advance. This advance payment is retained by the Council and is off-set against that trader’s final weeks pitch charge should the trader vacate the market. The Council also reserves the right to off set any arrears against this advance payment. 1 4.2 All charges relating to the use of any pitch and any ancillary services must be paid, on demand, to the Market Manager. Traders are advised they must bring the full cost of the charge with them to each market.

4.3 An official receipt shall always be issued.

4.4 All l traders without exception are required to pay in full all charges on demand by the Market Manager and no later than 2.30 pm on any market day. The pricing tariffs are on the pooletowncentre.com website

4.6 Failure to pay any such charges will result in permission to utilize the pitch being withdrawn. A trader will not be allowed to use a pitch until all arrears are paid in full.

5. Display, Permitted Goods to be sold and Changes to Licensed Commodities 5.1 Only those commodities contained in the registration / application form and confirmed in the trader’s license are to be sold from the allotted pitch. Any disputes concerning the commodities being sold will be determined by the Market Manager and any goods found not to be permitted for sale on any pitch must be removed from display immediately.

5.2 Changes to permitted commodities sold by any trader will only be considered, if the proposed range of commodities is not being sold elsewhere on the market by more than one trader. Any requests to change the nature of commodities being sold by any trader or any changes to the license terms whatsoever requires the written consent of the council.

5.4 Goods shall be displayed properly and attractively in a style approved by the Council. The use of cardboard boxes for displaying goods shall not be permitted. Signage of prices and goods on stalls should be of high presentation, clearly displayed and in a style of lettering and colouring approved by the Council.

6. Absences 6.1 In any period of likely prolonged absence on medical grounds the Market Manager may determine, in consultation with the trader or his/her representative, to terminate the trader’s permit in order that arrears do not accrue. In such circumstances, every effort will be made to find alternative space if and when the trader is able to return to the market as near as possible to the original trading position. The Council reserves the right to use the pitch in the trader’s absence.

6.2 Holidays (Regular Traders only) All regular traders will be entitled up to 4 weeks Free Holiday Allowance each year from the 1st January – 31st December. Allocation being as follows: Paid-on for 3months 1 week Paid-on for 6 months 2 weeks Paid-on for 9 months 3 weeks Paid-on for 12 months 4 weeks 6.3 All Holiday allowances must be taken during each Calendar year and no allowances will be rolled over to the following year. During the traders absence their will not be a charge for the pitch but will have the right to reallocate that pitch on a casual basis during the Traders holiday period.

6.4 Should a trader not wish to avail himself of any part of his/her holiday entitlement the Council will not allow this to be off-set against future rents.

6.5 Before any Free Holiday absence is taken, each regular trader must notify the Market Manager in writing of their intention to do so giving where possible two weeks notice of the period of absence.

6.6 Un-notified Absence Any regular trader absent from the market without notifying the Market Manager (with the exception of urgent reasons) will be charged full pitch charges for the period of absence. 2 6.7 Any regular trader absent from the market (with the exception of urgent reasons) for a period exceeding two weeks will be deemed to have terminated their use of the allotted pitch and such pitch will be liable to be re-allocated.

7. Public Liability and Employers Liability Insurance 7.1 All traders attending the market must have a minimum £5million Public Liability Insurance cover which fully indemnifies the Council against all claims arising from the traders’ attendance at the market. The details and proof of such cover must be shown to the Market Manager before commencement of trade and such proof must be provided on demand and annually.

7.3 All regular traders who employ other persons are required to hold Employer Liability Insurance protection and details should be shown to the Market Manager where applicable.

8. Traffic on the High Street 8.1 The Stallholder shall not bring or permit or suffer any vehicle or trailer to be brought into the Market earlier than two hours before or later than two hours after the Trading Hours except in an emergency and then only for the purposes of unloading of stock and the erection of the pitch cover and the loading of stock and the dismantling of the pitch cover. The Stallholder shall not cause or permit or suffer any obstruction inconvenience or nuisance to the public or any other Stallholder or vehicle in the Market or in surrounding roads where traffic has access legally.

8.2 All vehicles entering the market must only use the approved entrances and exits.

8.3 No vehicle will exceed 5mph on the High St or approaches thereto. Hazard warning lights and a banksman wearing Hi-Vis clothing should be used when entering pedestrian areas.

8.4 All vehicles and trailers must be removed from the market by 8.45am and should not be brought back onto the market until 5pm (or 4 pm when the clocks are put back during the winter period), without the express permission of the Market Manager. Where refrigeration of goods is required please consult with the Market manager for authority to keep the vehicle on site or for alternative parking arrangements.

8.5 Vehicles must not be parked in such that will obstruct other traders and must be removed as soon as loading and unloading is complete or when requested by the Market Manager.

8.6 Vehicles on the market or approaches must only be driven by qualified drivers holding a full motor vehicle license and valid vehicle insurance.

8.7 The Stallholder shall make their own arrangements for parking their motor vehicle in a proper parking place throughout the Market Day.

9. Electrical Supply / Equipment 9.1 No alterations or modifications are to be made to any electrical supply or equipment provided by the Council and traders must not illuminate a pitch by any other means than that provided or recommended without the written consent of the council. Any such requests to make changes must be in writing and include relevant details and drawings provided by the qualified electrical contractor who will undertake the works if approved.

9.2 Any authorised electrical works of any kind must comply with and be carried out in accordance with the current schedule of the Institution of Electrical Engineers.

9.3 All electrical equipment used by each trader must have been Portable Appliance Tested (PAT) in the last 12 months. You may be required by the Market Manager to show documentary evidence e.g. test certificate.

9.3 No electric fires or kettles are to be used.

9.4 TCM can provide 240v single-phase power supplies for any stand, exhibition or stall in the High Street or Falkland Square. 3 9.5 Power supplies provide by PTCM

1. The power supplies for any stand, exhibition or stall licensed by PTCM to trade on the High Street or Falkland Square must not be taken from adjacent shop premises or domestic properties. 2. There are permanent 240v single-phase power supplies for use by authorised traders and events housed in dedicated kiosks at various locations along the High Street and in Falkland Square. 3. PTCM will not permit privately supplied electrical cables of any kind to be connected to the power supply outlets in the dedicated electricity kiosks. 4. PTCM will provide sufficient distribution boxes among the stalls/stands to permit safe connection. 5. Each distribution box will include two 16A MK Commando socket outlets with a DP isolator and 16A mcb for each outlet. 6. Each distribution box will allow a maximum load of 20A split between the two socket outlets.

Connections by traders and event organisers 1. It is the responsibility of the trader or event organiser to ensure that any equipment or appliance that is connected to the PTCM distribution box is suitable and safe at all times. 2. PTCM reserve the right to inspect any equipment or appliances connected to their supply and take any appropriate action to ensure public safety. 3. The PTCM distribution box must remain readily accessible and obvious at all times in case urgent disconnection is required. 4. Connection to a PTCM supply outlet can only be made using a 16A MK Commando plug or similar. 5. The following guidance will be used when assessing suitability and safety: a. All flexible leads from the supply outlet to the traders equipment must be of Arctic grade cable to BS6500, or better, and be 3 core(including a protective earthing conductor) b. Flexible cables should not be laid in areas accessible to the public unless they are protected against mechanical damage. c. Mechanical protection or armoured cables should be used wherever there is a risk of damage. d. Cables offering integral mechanical protection are: i. Steel wire armoured ii. Cable with external protective steel wire braid e. Rubber cable matting should be used to reduce the risk of tripping, but cannot be considered as providing sufficient mechanical protection for flexible cables. f. Where flexible cables are used above floor level they should not be unsupported across gaps wider than two metres without the use of a suitable catenary wire support. 9.6 Any plug/socket connections should be protected against damage and secured above ground level to reduce the risk of water penetration from puddles

10. Cleaning 10.1 All traders are responsible for ensuring that the area in and immediately around their pitches is kept clean and tidy and that debris and refuse is cleared away during the course of the day and also at the end of each trading day.

10.2 Food traders are responsible for ensuring the cleanliness of their allotted pitches at all times in compliance with the Food Hygiene legislation in force at that time.

10.3 Food traders are responsible for the disposal of all offal or waste food, which must be stored in sealed containers and removed from the market for disposal at the end of each trading day.

11. Obstruction 11.1 No goods or boxes are to be placed in the public passageway or in other areas of the market so as to obstruct the free passage of other users of the market or obstruct the display of another trader. 4 11.2 The Stallholder shall not do or permit or suffer anything to be done which would or might result in a breach of the terms of any permission for the placing of structures in the highway under the Highways Act 1980 or cause any other person to do so. A minimum inter aisle width of 3.6m must be maintained at all times to allow for the passage of emergency vehicles, and any access gap between Pitches maintained at all times.

11.3 Where a wheeled trailer unit or equivalent unit is used, the unit shall remain in a portable state. When wheel clamps or other immobilizing device is used, the keys or code to which, are to be in the possession of Poole Town Centre Management. This is to ensure emergency vehicle access at all times.

12. Building Out All goods must be displayed within the defined limits of the pitch. Any overhangs (if permitted by the Market Manager) must not cause a hindrance to others, an obstruction, or, a danger to pedestrians/vehicles. Goods/articles placed outside the designated pitch area may attract additional charges.

13 Use of Side Sheets The use of side/back sheets on a stall should be kept to a minimum where possible. In order not to block-out shop keepers window frontage, the Market Manager may request the stallholder to keep side/back sheets rolled-up, weather permitting

14. Transfer of Pitch License 14.1 The Stallholder shall not permit any person other than his/her employees to use the Pitch and the Stallholder acknowledges that this Permit is personal to him/her and is not to be assigned, transferred or sublet in part or in whole. The parties acknowledge that nothing in this Permit shall create the relationship of landlord and tenant.

14.2 Any trader found to have permitted use of the pitch by anyone else will be deemed to have terminated this license and will be refused permission to attend the market in future.

14.3 Any unauthorized trader found to be trading from any pitch or trading space without the consent of the Market Manager will be removed from the market by the Police.

15. Display of Placards Posters or Notices No trader will display any placard, poster, or notice without the prior written consent of the Market Manager, and must not display any literature, which may be deemed to cause offence.

16. Fire Prevention 16.1 No refuse or combustible material must be allowed to build up in or around any pitch and will not be placed near to electrical fittings.

16.2 No hazardous substances or chemicals or inflammable substance should be stored on the pitch. No gas bottles or other high-pressure container to be left on the pitch unattended or over night.

16.3 Any stall holder that has any form of heat or electrical equipment on or around their stall, must have a fully functioning fire extinguisher.

17. Evacuation 17.1 In the event of fire, bomb threat or such potentially serious incident which requires the immediate evacuation of the area, instructions will be given by the Market Manager/Town Centre Management staff.

17.2 All traders are advised to make themselves aware of the evacuation procedure in place at the market. On being requested to evacuate by a member of the market team, emergency services or police, traders should leave the market without delay and where possible and, without danger to themselves or others, assist in directing customers away from the market area.

18. Compliance 5 18.1 The Stallholder shall comply with all acts of Parliament and Regulations applicable to the operation of the Pitch and to the Stallholder’s trade or business and in particular any person selling foodstuffs shall comply with the Food Safety (General Food Hygiene) Regulations 1995 (as amended) and the Food Safety (Temperature Control) Regulations 1995 or any regulations amending or replacing the same.

18.2 All traders must comply fully with all the rules, regulations and with all terms and conditions of any Permit agreement when attending the market and shall comply with all reasonable directions of the Market Manager and the Council or its agents. The Council’s decision is final in all matters and it can remove any trader at its discretion.

PART TWO. Conduct of all Traders

1. All market traders, their servants, agents, employees or contractors are required to conduct themselves in an orderly manner so as not to cause annoyance or inconvenience to other users of the market and to act in a responsible manner and not cause any act of neglect, willful damage or disturbance to the peaceable enjoyment of the market.

2. The Stallholder shall not use or permit to be used abusive, profane or insulting language.

3. All market traders, their servants, agents, employees or contractors attending the market are expected to observe all rules, regulations, bye-laws and legislation and to comply with all reasonable requests of Poole Town Centre Management..

4. Trade will be conducted in such a manner as to comply with all trading standards and consumer legislation and food traders in full compliance with the food hygiene legislation in force so as not to damage the goodwill of the market generally.

5. In a dispute between a trader and consumer the trader should at all times endeavour to remain courteous and polite. Where the matter cannot be resolved amicably the Market Manager will attempt to arbitrate, if requested to do so, If in his/her opinion the consumer is found to have a justifiable complaint, the trader will be requested, without any liability on the part of the Market Manager, to rectify the matter as recommended.

6 If the Market Manager is unable to offer a clear opinion or the trader is unwilling to resolve the matter then the consumer will be advised to take the matter to the local Consumer Advice Agency. The trader will be expected to comply with the written opinion of the Agency.

7 The stall/ pitch holder will move to another pitch when told by the Poole Town Centre Management Staff with short notice. This is to ensure that complaints or other issues can be dealt with quickly.

8. TRADER DISCIPLINARY PROCEDURE

The Borough of Poole has the right to expect that any trader or traders’ employees working at its Markets do so in full compliance with the rules and regulations established for the good management of the market. It also recognizes its commitments to providing a well managed market where the rights of traders are recognized and protected and where members of the public are treated courteously, fairly and professionally. This procedure has been developed to establish a mechanism which can deal with any areas of dispute and allows traders to raise Grievances and lodge Appeals against decisions made in respect of any disciplinary action.

Disciplinary Procedure. Any breach of the rules, regulations or bye-laws applicable to the markets or any misconduct by a trader or agent in the course of trade shall be regarded by the Council as a disciplinary matter. 6 Minor disciplinary matters will normally be dealt with by the Market Manager, who may if he/she thinks it necessary, administer an oral reprimand. All such matters will be recorded by the Market Manager in the ‘Market Incident Book’ and the trader advised of this action. Persistent Failure to Comply - Suspension Persistent disregard for any of the established rules, regulations or bye-laws will normally be dealt with by the Market Manager who must have recorded all alleged breaches in the Market Incident Book. The Market Manager before taking any action to suspend any trader must first warn the trader verbally of a possible suspension and secondly write to the trader setting out the nature of the alleged offences referring to entries made in the incident report book and advising trader of a possible suspension.

Prior to suspending a trader the Market Manager as a final attempt to ensure a traders compliance, should bring the matter to the attention of a Traders Representative or the Town Centre Management Board, and advise both parties on the likely course of action if the offending trader still fails to comply.

Failure to comply thereafter will result in the Market Manager issuing a letter of suspension to the trader

Any trader who is suspended from trading at the market will have the right to appeal to the Town Centre Manager and such appeal shall be made in writing no later than 72 hours after notification. As soon as practicable after receipt of notice of appeal the Town Centre Manager shall consider the allegations made and shall be entitled to seek other submissions or representations whether oral or in writing from such persons as he/she deems fit and shall then be entitled either to confirm the decision or to allow the appeal and dismiss the allegation or to substitute such lesser penalty as befits the offence.

The Market Manager or the Town Centre Manager has the authority to remove a stall immediately without notice if any conditions of this Schedule have been breached. If Poole Town Centre Management removes the stall, then the costs of the removal will be recovered from the stallholder in full.

7 General Disciplinary Matters.

Other breaches of discipline shall be reported by the Market Manager to the Town Centre Manager who shall where necessary investigate the matter, and if requested, arrange a meeting with the trader concerned (who may be accompanied by a representative of his/her choice) and the market management staff. The Town Centre Manager may also arrange to hear from any other persons with relevant knowledge of the alleged offence or incident and may also arrange for such other persons as considered necessary to be present during the meeting or any part thereof.

On hearing all evidence and facts of the respective case the Town Centre Manager may decide the matter in any one of the following ways:-

a) Dismiss the allegations entirely

b) Give an oral warning.

c) Give a formal written warning.

d) Suspend the trader for such a period as deemed fair.

e) Terminate the trader’s permit.

The Council will ensure that a proper record is kept of any action taken where a trader is given any formal warning, or is suspended or has their license terminated and shall, within 4 working days after any such decision is taken, provide a written notice of the decision setting out the circumstances to the trader and representative.

Gross Misconduct-Suspension Any trader who directly or indirectly is involved in or has influenced any incident which in the opinion of the Market Manager constitutes gross misconduct or where other users of the market are placed in danger will be suspended from trading at the market immediately until an investigation has been completed (pursuant to above investigation procedure).

Upon completion of the investigation in accordance with the terms and provisions of these rules any trader deemed to be guilty of gross misconduct and/or endangering other users of the market will have their licenses terminated immediately. Refusal to pay any market related charges applicable to the trader’s use of the facilities will be deemed gross misconduct and will result in permit termination.

10 Conditions of the Permit

1. The Permit holder agrees to comply with all the rules and regulations established by the Council for the good management of the market. 2. The Permit holder agrees to pay to the Council all fees and charges in accordance with the rules and regulations established by the Council for the good management of the market. 3. The Permit holder agrees to abide by all Legislation, Regulations and Rules applicable to the use of the allocated pitch and operation of the business there from at that time. 4. The Permit holder acknowledges that this Permit is personal to him/her and is not to be assigned, transferred or sublet in part or in whole. The parties acknowledge that nothing in this Permit shall create the relationship of landlord and tenant. Definitions

“Pitch” is a specific allocated space on the High Street, Town Square or Falkland Square. 3x3 meters in size.

“ Regular Trader” Those stall holders who attend consecutively for a period of at least 3 months and pay one week in advance

“Casual Trader” Those stall holders who turn up on the day and pay on that day for that day.

“Concessions” (Maximum of 6 stalls only) those stall holders who are on the High Street, Town Square or Falkland Square on days other than, or as well as, Thursday and Saturdays.

“Permit Period” means twelve months or less from the signing date.

‘Stall’ means a demountable market stall occupying not more than nine square metres overall comprising a steel framework with a waterproof cover securely affixed to the framework or constructed of such other materials as the Town Centre Manager may from time to time approve

‘Stallholder’ means any person permitted by the Stall Operator to trade from a Stall in the Market and his servants and agents

‘Stallholder Conditions’ means the conditions to be observed and performed by stallholders set out in the Schedule to this Permit
