On the basis of Article 10 (1) of the Construction Act (Uradni list RS*, no. 102/04 – officially consolidated text and 14/05-revised), the Minister for the Environment and Spatial Planning, in agreement with the Minister for Culture, Minister for the Economy, Minister for Transport, Minister for Agriculture, Forestry and Food, Minister for Education and Sports, Minister for Higher Education, Science and Technology, Minister for Labour, Family and Social Affairs, Minister for Health, Minister for the Interior, Minister for Public Administration and Minister for Defence, hereby issues the

R U L E S on the mechanical resistance and stability of buildings

I. GENERAL PROVISIONS

Article 1 (content of the Rules) (1) These Rules lay down the requirements for ensuring the mechanical resistance and stability of buildings throughout their lifetime, and the aim of these requirements is to limit danger to people, animals and property in buildings and in their immediate surroundings. (2) These Rules shall apply to the designing, construction and maintenance of new buildings, reconstruction of existing buildings and replacement construction. They shall apply to the reconstruction of buildings where the technical possibilities for attaining the requirements of these Rules are established and where this would not be counter to the conditions regarding protection of cultural heritage.

Article 2 (relationship with other regulations) Individual requirements regarding mechanical resistance and stability may for any of the types of building be governed by a special regulation differently from these Rules, if this is necessary owing to the special features of the specific type of building. In such case the provisions of these Rules shall apply only to those requirements that are not governed by a special regulation.

Article 3 (definition of terms) (1) For the purpose of these Rules, the terms used herein shall have the following meaning: 1. Eurocodes are the standards determining the principles and rules for ensuring safety, usability and durability of structures, describing the basis of their design and verification, and providing guidelines for attaining the aforementioned aspects of soundness of structures;

2. the principles of Eurocodes are general provisions and definitions, for which there is no possibility of any other choice, and requirements and analytical models that may not be changed, unless expressly determined in the Eurocodes; 3. the rules of the Eurocodes are generally accepted rules which accord with the principles of the Eurocodes and fulfil their requirements.

(2) Terms in the area of buildings construction that are not defined in these Rules shall have the same meaning as set out in the Construction Act (Uradni list RS, no. 102/04 – officially consolidated text and 14/05-revised, hereinafter: Construction Act) and in the Eurocode SIST EN 1990.

II. REQUIREMENTS FOR MECHANICAL RESISTANCE AND STABILITY

Article 4 (ensuring mechanical resistance and stability) (1) Buildings must be designed, constructed and maintained in such a way that actions to which they will probably be exposed during construction and use will not cause: – destruction of all or part of the building, – deformations greater than the permitted level, – damage to other parts of the building, utility supply and installed equipment owing to major deformations of the load-bearing construction or – damage arising as a result of some event whose scope is disproportionately large relative to the primary cause.

(2) Buildings must be designed, constructed and maintained in such a way that in case of fire their load-bearing construction retains the necessary load-bearing capacity for the period of time laid down for the individual group of buildings by the regulations on fire safety of buildings.

(3) The requirement from the third indent of the first paragraph of this article shall not apply to earthquakes with a low probability of occurrence, as defined in the Eurocode comprised by standards of the group SIST EN 1998.

III. METHODS OF FULFILLING REQUIREMENTS

Article 5 (application of Eurocodes) (1) The requirements regarding mechanical resistance and stability of buildings may be fulfilled: – through design and construction in compliance with the principles and rules of the Eurocodes or – by adhering to the principles and application mutatis mutandis of the Eurocodes rules in designing and constructing buildings (e.g. highly unusual geometry of a building) or in the use of construction materials (e.g. glass), which the Eurocodes do not deal with directly.

(2) In designing and construction in accordance with the second indent of the preceding paragraph, those solutions that are in accordance with the principles of the Eurocodes and are not counter to the rules of the Eurocodes shall be permitted. (3) The list of Eurocodes from the first indent of the first paragraph of this article shall be published by the minister responsible for spatial planning, in the Official Gazette of the Republic of Slovenia.

Article 6 (application of other rules) (1) In the design, construction and maintenance of buildings, instead of the Eurocodes rules, application may be made of the rules from other standards, technical guidelines or other technical documents, if thereby, while observing the Eurocodes principles, it is possible to ensure at least an equal level of fulfilment of the requirements from these Rules. (2) In applying rules referred to in the preceding paragraph, the actions on the construction taken into account may not be less than the actions determined in compliance with the groups of standards SIST EN 1991 and SIST EN 1998 (e.g. useful loading in buildings, chart of snow loads, chart of projected seismic accelerations), while observing the partial factors of loading in compliance with standard SIST EN 1990.

Article 7 (execution of construction works) Construction works that might affect the mechanical resistance and stability of buildings must be carried out in compliance with the Slovenian standards on the method of executing construction works, and especially with the groups of standards on execution of concrete structures and on execution of steel and aluminium structures.

IV. DESIGN DOCUMENTATION

Article 8 (citing the basis for design) In the technical report of the design construction plan the responsible designer must in order to obtain a construction permit set out expressly whether the plan has been made on the basis of the Eurocodes rules or on the basis of Article 5 (1) (2) of these Rules or of Article 6 of these Rules.

Article 9 (auditing obligation) (1) Auditing of designs in order to obtain a construction permit shall, alongside cases set out in the Construction Act, also be obligatory where the designer is designing a less complex structure in compliance with Article 5 (1) (2) of these Rules or with Article 6 of these Rules. (2) The subject of auditing referred to in the preceding paragraph shall be exclusively control of the flawlessness and accounting regularity of those components of the construction plan in the design for obtaining a construction permit, serving to demonstrate that the submitted design fulfils the essential requirement of mechanical resistance and stability of the structure on a level at least equal to that if the Eurocodes had been applied. (3) The responsible auditor shall enter into the summary of the auditing report, under the terms of the regulation governing design and technical documentation, only those data that are essential for the scope of the audit referred to in the preceding paragraph. By signing the audit

4 Predlog – 13. 5. 2005 report the auditor confirms only that the audit indicates that the design fulfils the essential requirement of mechanical resistance and stability of the structure.

V. INSPECTION

Article 10 (inspection) Implementation of the provisions of these Rules shall be overseen by inspectors competent for overseeing the construction of individual types of structure in compliance with the regulations on organisation of the state administration or with other regulations laying down their competence and tasks.

VI. TRANSITIONAL AND FINAL PROVISIONS

Article 11 (transitional period) Designers and contractors of construction works must harmonise the performance of their work with the provisions of these Rules no later than by 31 December 2007.

Article 12 (production and execution of designs under already concluded contracts) (1) Design and technical documentation for which contracts were made prior to 1 January 2008 may be elaborated and works proceeding from it executed pursuant to the regulations referred to in Article 13 of these Rules. In such case the responsible designer must expressly set out in the technical report of the design construction plan for obtaining a construction permit that the existing regulations were applied in the design. (2) Irrespective of the provision of the preceding paragraph, after 1 January 2009, only designs made in compliance with these Rules may be attached to requests for construction permits.

Article 13 (cessation of validity and entry into force) (1) On the day these Rules enter into force, the following shall cease to be valid: - Decision on which buildings shall be deemed to be important buildings pursuant to the seismological service act (Uradni list SRS*, no. 12/86), and - Decree on the size and execution of buildings in earthquake zones (Uradni list SRS, no.18/63).

(2) On the day these Rules enter into force, the following shall cease to apply:

Article 14 (entry into force) These Rules shall enter into force on the fifteenth day after their publication in the Official Gazette of the Republic of Slovenia, and shall begin to apply on 1 January 2006.
