VILLAGE OF MILLSTADT VILLAGE HALL July 20, 2009 7:30 P.M.

The meeting was called to order by Weldon Harber, with the following trustees answering to roll call: Ralph Bowley, Mike French, Al Lehr, Linda Lehr, Laura Schaefer and Mike Todd. The Pledge of Allegiance was recited.

A motion was made by Laura Schaefer to approve the July 6th minutes. Mike Todd seconded the motion. The motion carried unanimously.

COMMUNICATIONS OR CORRESPONDENCE: The Mayor presented awards for Service to the Village to Wellington Lemmer for his service as a Zoning Board member, to Bruce Nowak for his service as Mayor, and to Janice Dreyer for her service as Village Clerk.

COMMITTEE ON ACCOUNTS AND COMPUTERS: Ralph Bowley stated that each trustee had a copy of the where the Village is currently within the budget. Everything is inline. Ralph Bowley stated that he had reviewed bills. Ralph made a motion to pay the bills. Al Lehr seconded the motion. The motion passed unanimously.

PERSONNEL: none

PUBLIC WORKS: SEWER: Al Lehr stated that everything is going well at the new sewer plant. Randy Burk stated that nothing has happened in the last 2 weeks. Linda Lehr asked for clarification on why the Village was still retaining money. Randy stated it was because of the lack of record keeping by the contractor. Randy Burk stated that he had the operator remove the hoist from the lift station on the easement on Charles Herman’s property. It has been put in storage.

WATER: Al Lehr stated that the colors for the new water tower needed to be decided because of the bids being due the following week. Randy Burk presented some different types of color combinations. Discussion followed about which color to choose. Mike Todd made a motion to use the white tower with blue lettering and red blades. Ralph Bowley seconded the motion. The motion passed unanimously. Bids will open August 4th. Construction will probably begin in October and it will probably be a 6-month construction period. The IEPA has sent a letter stating that everything has been submitted and the village can proceed forward. Don Traiteur stated that there had been a water line leak near MCS due to a joist splitting apart. It was sitting in a hole that the contracting company had left open. Don stated that water was lost for 25 minutes but no one called about having low water pressure. REFUSE: Al Lehr stated that the trash company missed a couple pick-ups the previous week. There had been some new drivers and they came back to pick up the missed trash.

1 MOSQUITO CONTROL: none

STREETS, ALLEYS AND SIDEWALKS: Mike Todd stated that CDB denied the curb project. The Optimist Club will be having their annual Chili Cook-Off on October 11th and request closing Legion Drive. Mike Todd made a motion to close Legion Drive on October 11th. Laura Schaefer seconded the motion. The motion carried unanimously. Mike Todd stated that the 60/40 project would start in the middle of September. Advertising for bids will be in the Millstadt Messenger. Mike also stated that there will be a meeting the following week to decide which streets will be oil and chipped at the end of August.

PUBLIC BUILDINGS, MAINTENCE, AND EQUIPMENT: none

CABLE SERVICES AND CELL TOWERS: Linda Lehr stated that each trustee received a copy of the new Charter Franchise Agreement. One of the provisions is that there will be an increase in the profit that the village gets from 3% to 5%. The new agreement will go into effect 45 days after it is passed. The agreement ends October 2013. Linda Lehr made a motion to approve the proposed franchise agreement with Charter Communications. Laura Schaefer seconded the motion. The motion carried unanimously. Linda Lehr made a motion to approve Ordinance 1036 allowing the Village to do business with Charter Communications under the new franchise agreement. Ralph Bowley seconded the motion. The motion carried unanimously.

ORDINANCES AND RESOLUTIONS: Mike French presented the Village of Millstadt Census 2010 Proclamation in which the Village agrees to take part in the census. The proclamation states that there will be committees and it breaks down the responsibilities of the committees. Mike French made a motion to accept the proclamation. Linda Lehr seconded the motion. The motion carried unanimously. Mike French stated that the proposed masonry ordinance had been presented. There is a clause to prohibit monotony. The ordinance has also been presented to the Zoning Board. Mike French made a motion to send the masonry ordinance draft to Village Attorney Mike Flynn for his recommendation. Al Lehr seconded the motion. The motion carried unanimously.

ANNEXATIONS: Ralph Bowley stated that he’s finished getting plot numbers in Cedar Creek. There are 70 plots and only 28 property owners. Ralph has the spreadsheet set up and has gotten people to help with the one on one contact.

PARKS, POOL AND RECREATION: Laura Schaefer stated that she had worked with the Boy Scouts to weed, mulch, and trim at the Police Station on the previous Wednesday. They will probably spend one more day working at the park.

2 rd The next Park Board meeting will be Thursday July 23 at 7:30pm at West End Tavern in the back room. Don Traiteur stated that they leveled out the dirt at King’s Creek. The village workers will be out the next day if it doesn’t rain and they will hopefully start digging the following week. Don also stated that someone cut a 4x10 hole in the fence at the 1st base dugout on diamond 3 and took the fencing off the 3rd base dugout of diamond 2. The cuts looked like it was made with bold cutters and the cuts were perfect. The police did a report but there are no leads on who or why. There isn’t enough time or material to fix it and it doesn’t cost enough to send it to the insurance company.

CEMETERY: Al Lehr stated that the lawn mowing has been kept up.

COMMUNITY CENTER: Linda Lehr stated on July 25th, the RSVP band would be playing at th the Community Center at 12:30pm. On July 29 , there will be a trip to the movie theater for a free th movie. There is a board meeting on August 24 at 7:30pm at the Community Center.

PLANNING COMMISSION & ECONOMIC DEVELOPMENT: Mike French stated that there st is a Planning Commission meeting on July 21 at 7:30pm at the Village Hall.

TIF: Mike French stated that Jim Kane wanted to email Rick Schmidt about the IMG project. The project will need to be updated and it will need to be bid. Hopefully it will begin in September. Randy Burk will check to make sure the estimate is still good.

PUBLIC SAFETY: Police Department - none Emergency Service and Disaster Agency - none Fire Department - none Ambulance - none

BUILDING COMMISSIONER: Steve Muskopf stated the following permits were issued: Johnson 543 Admiral Wendt Parkway Single Family Residence Froese 4621 Eyman Road Single Family Residence LJ Schaefer Const Co 10 Travertine Circle Single Family Residence

OLD BUSINESS: The next Village Board meeting will begin at 7:00pm.

3 NEW BUSINESS: The Mayor stated that there would be Local Officials’ Day at the State Fairs in Springfield and DuQuoin. If anyone is interested, they must request a pass from Tracy Holmes.

CLERK’S REPORT: Tracy Holmes stated that the clerk’s report had been submitted. Linda Lehr made a motion to accept the clerk’s report. Ralph Bowley seconded the motion. The motion carried unanimously.

TREASURER’S REPORT: Tracy Holmes stated that the treasurer’s report had been submitted. Ralph Bowley made a motion to accept the treasurer’s report. Mike Todd seconded the motion. The motion carried unanimously.

CITIZENS COMMENTS: none

ADJOURNMENT: Ralph Bowley made a motion to adjourn the general Village Board meeting and was seconded by Mike Todd. The motion carried unanimously.
