WHEREAS, NJSA 40A:11-6 provides that a purchase, contract or agreement may be made, negotiated or awarded without public advertising for bids and bidding therefore, notwithstanding that the cost or contract price will exceed the amount set in the prevailing bidding threshold, when an emergency affecting the public health, or welfare requires the immediate delivery or performance of services provided:

A written requisition for the performance of such work or labor, or the furnishing of materials, supplies or service is filed with the contracting agent describing the nature of the emergency, the need for invoking this section, certified by the officer or director in charge of the department wherein the emergency occurred, or such other officer or employee as may be authorized to act in place of said officer or director, and the contracting agent in charge, being satisfied that the emergency exists, is hereby authorized to award a contract for said work or labor, materials, supplies or services; and

WHEREAS, an emergency situation at the Department of Public Works, 277 So. Maple Ave, Basking Ridge, NJ 07920 as identified in a departmental memo dated November 29, 2005 from Peter A. Messina, P.E. Township Engineer and attached to this resolution. In meeting the criteria set forth above, necessitating the immediate repair of the facility roof which sustained damage caused by recent heavy rains with significant damage to the interior facility which poses a safety and health concern of the employees; and

WHEREAS, solicitation of three (3) quotes were obtained by reputable contractors as follows:

Contractor Price Cipollini Roofing $ 39,000.00 Champion Roofing $ 61, 220.00 Thomas S. Belardo $ 67,500.00

WHEREAS, the Treasurer has certified that funds are available in the Bernards Township budget; the line item appropriation to the ordinances to be charged is Capital Ordinance (s) # 1460-01, Account C-04-55-460-G01 ($ 17,578.35), and #1406A, account C-04-55-406-BA1 ($ 21,421.65); and

NOW, THERFORE, BE IT RESOLVED by the Township Committee of the Township of Bernards, Somerset County, New Jersey does hereby authorize the purchasing agent to issue a purchase order to Cipollini Roofing, 203 E. Blackwell Street, Dover, NJ 07801, in the amount of $ 39,000.00 for the emergency purchase described herein in accordance with NJSA 40A:11-6.

I agree to the terms as stated in the Resolution and by signing this document I, Boris Gershfield, am committed to follow all terms of this award.

Bolcato CPA, Treasurer of the Township of Bernards, hereby certify that adequate funds are available for the above referenced purchase in the amount of $ 39,000.00. Monies are available in Capital Ordinance (s) # 1460-01, account C-04-55-460-G01 ($ 17,578.35), and #1406A, account C-04-55-406-BA1 ($ 21,421.65).

EXPLANATORY STATEMENT

In accordance with 40A:11-6 Emergency Contracts please consider this notice of the need for performance of a contract for the repair of the roof over the office and service bay portion of the Engineering Services Building. Until last month, there were no signs of the magnitude or severity of the impending leaks.

The nature of the emergency is the rapidly deteriorating roof system which, during the heavy rains of October, leaked significantly and damaged ceilings, insulation, carpeting and other material items. Tarps were placed over many desks and equipment.

There is great concern for water damage to the structure and its contents over the winter when snow and freezing temperatures can combine to magnify and expand the leaks. Without repairs as soon as possible, there is potential for significant additional damage to the building contents and may make the building uninhabitable.
