ORDER (Date of Hearing: May 30, 2017) Whereas the petitioners Shri Mohan Lal Sarawagi S/o late Vishwanath Prasad, 201 Jawahar Nagar Vistar Colony Bhelupur, Varanasi, have filed petition no. 1188/2017, in the matter of Petition /Revision under section 67(2) of the Electricity Act, 2003 against impugned order of the Respondent No. 6 dated 10.9.2016 and 4.11.2016 passed under Section 67 (2) of the Electricity Act, 2003 and Section 3(3) of works to Licensee Rules 2006.

The respondent counsel requested the Commission to grant some time to file the objections.

The Commission enquired the petitioners whether they have any objection. They submitted that they have no objection. The Commission grants 15 days time to file the objections with a copy to the petitioner. The Petitioner is directed to file the reply, if any, in next seven days.

During the hearing on 30.5.2017 the respondent counsel Shri Puneet Chandra submitted that 10 days time may be granted to file the counter. The petitioners objected to it and further submitted that respondents may be directed to pay the compensation as per the provisions of the guidelines, for payment of compensation towards damages in regard to right of way for transmission lines, issued by Govt. of India / Ministry of Power dated 15.10.2015 and respondent has to pay the compensation under the provision of sub-section (e) of Section 67 (2).

Page 2 of 3 The Commission directed the petitioners to calculate the compensation in the light of guidelines issued by Govt. of India / Ministry of Power dated 15.10.2015 within 10 days with a copy to the respondent who would file the Counter / WS in the next 10 days with a copy to the petitioner. List on 4.7.2017 at 11:30 hrs.
