HAMILTON CREEK ASSOCIATION PARKING RULES AND REGULATIONS

1. Passenger vehicles are defined as any vehicle whose primary purpose is the transportation of passengers and is used for personal and non-commercial purposes. This would include passenger automobiles, pickup trucks, mini-vans, full size passenger vans, and sport utility vehicles. This definition may be modified from time to time as vehicle designs change. 2. Passenger vehicles may be parked on shoulders of roads not exceeding 12 hours in a 24 hour period but only if not obstructing traffic, snow removal or road maintenance and only if driveway parking is full (example: party overflow). Construction vehicles used during new home construction are covered separately under the Design Guidelines. 3. Each single-family residential dwelling is required to provide an enclosed garage space to shelter a minimum of two passenger vehicles and sufficient driveway space for the parking of two guest automobiles, unless otherwise approved by the Architectural Control Committee. Homeowners are strongly encouraged to use their enclosed garage first, out of courtesy and respect for their neighbors. However, up to two non-abandoned and actively used (see 4. below) passenger vehicles may be parked on a regular basis on the driveway. 4. No abandoned or unused passenger vehicle or any other vehicle of any kind may be parked or stored outside of an enclosed structure. A vehicle will be considered abandoned or unused if it meets any of the following criteria: A. Any vehicle that cannot be mechanically operated for 7 days. B. Any vehicle that does not comply with motor vehicle laws or regulations and therefore cannot be legally operated on public streets. C. Any vehicle not bearing a current or valid state license plate. D. Any vehicle that has not been driven under its own propulsion or has not been moved for a period of 7 days or longer. 5. Periodic movement of the vehicle, either under its own propulsion or by other means, for the purpose of circumventing this time frame, shall not exempt a vehicle from this definition of unused or abandoned passenger vehicle. 6. No motor home, trailer, camper, bus or boat may be parked outside of an enclosed structure except for loading/unloading and for no more than a total of four consecutive days and no more than 14 days during a one year period. Parking for any period of time during any day is considered as one whole day. 7. Boats, trailers, motorcycles, snow mobiles, campers, motor homes and all other non-motorized and motorized vehicles except passenger vehicles as defined above, must not be parked outside of an enclosed structure, except as allowed under paragraph 5. 8. Any type of vehicle that is parked on a road or shoulder of a road and is obstructing traffic, snow removal or road maintenance or results in a potential safety hazard is subject to immediate towing at the vehicle owners risk and expense. The Board of Directors and/or management company reserves the right to tow or request ticketing of the vehicle by the appropriate law enforcement agency. 9. Temporary variances may be granted by a Board of Director member for exceptional circumstances. Variances should be properly documented and communicated to all Board of Director members and the Chairperson of the Covenants Compliance Committee. 10. Violators of Parking Rules and Regulations will be subject to Hamilton Creek Covenant and Rule Enforcement.
