TOWN OF NORMAN WELLS
BY-LAW NO. 97-07
Being a By-Law of the Municipal Corporation of the Town of Norman Wells in the Northwest Territories to provide for the removal of snow, ice, dirt, garbage or other obstructions from the brick walkway system in the Downtown Core by adjacent property owners or occupiers, pursuant to Section 72 © of the Cities, Towns & Villages Act, RSNWT, 1987(1), C-8.
Whereas the Town of Norman Wells, after consultation with representatives of the Norman Wells & District Chamber of Commerce and town core property owners, has expended municipal funds to beautify the town core through the construction of a brick walkway system, and
Whereas the Council are desirous of maintaining a clean and safe environment in the downtown core for residents of the community,
Now Therefore, the Council for the Town of Norman Wells, at a duly assembled meeting, enact as follows:-
1. Each property owner/occupier of a property abutting on a sidewalk shall remove or cause to be removed snow in excess of 2 inches, ice, debris, garbage or any other obstruction and take such other reasonable measures as shall be necessary to ensure the safety of pedestrians using the sidewalk.
2. Snow removal shall be completed within 24 hours of any snowfall of more than 2 inches or by the end of the owner/occupier’s next business day.
3. Each property owner/occupier of the downtown core shall assume responsibility for their specific areas as outlined on Schedule ‘A’ which is attached and forms a part of this by-law.
4. No person shall cause any injury or damage to any sidewalk by spreading salt, striking, picking or cutting the same with any ice bar, pick, crowbar or other such metal instrument or mechanical device, whether such person is engaged in removing snow, ice, debris, dirt, sand or gravel from such sidewalk.
5. If damage does occur either the person known to be responsible for the damage or he owner/occupier responsible for their specific designated area will be assessed the cost of repair.
6. Where the Town of Norman Wells, as represented by the Town Manager or his designate, finds that a sidewalk is not being maintained to their satisfaction, the Town Manager may, by notice in writing served in person or sent by registered mail to the owner or occupier of the property affected to:-
a) Order the person responsible to complete the required work within a specified period of time outlined in the written notice, and
2) Should the required work not be completed within the specified period of time, the Town may complete the work with all associated costs being invoiced to the property owner/occupier responsible. Costs shall be determined using a rate of $40.00 per hour plus any materials.
By-Law No. 97-07 Page 2 7. If invoices issued pursuant to this by-law remain unpaid by the end of the current calendar year, such amounts may be added as property taxes payable against the property.
8. Schedule ‘A’ is attached and forms part of this by-law.
9. This by-law shall come into force and effect immediately upon third and final reading.

Enclosed for your information and records is a copy of the above noted by-law which received third reading on December 16th and came into effect that same day. Every effort was made to ensure that concerns raised were incorporated into the by-law wherever possible, through consultation with all the owner/occupiers of the downtown core and representation of the same as well as other Chamber of Commerce members at Town Planning & Land Use meetings when the details of the by-law were being finalized. It is our hope that this by-law represents all concerned parties in a fair and equitable manner.

Dear Val & Larry:
The attached draft By-Law No. 97-07, which outlines areas of responsibility for clearing/maintaining the brick walkway system, was developed as a result of discussions held with the Town Planning & Land Use Committee and members of both the Chamber of Commerce and representatives of the owner/occupiers of the downtown core. The general agreement was that the Town would accept responsibility for the cost of construction of the walkway and for keeping the parking lot free of snow with the owner/occupiers being responsible for keeping the walkway free of snow and ice. It should be noted that your efforts in this regard have not gone unnoticed and are greatly appreciated by everyone that uses the walkway system.
We would ask that you review each individual area of responsibility on the attached map (Schedule ‘A’) and the contents of the by-law and provide us with your comments or suggestions. The by-law has received first reading by Council and will proceed to second reading at the meeting scheduled for November 4th. Should you have any questions or wish to discuss the by-law, please give me a call at your convenience.

I have attached a copy of correspondence I have sent out to all owner/occupiers of the downtown core asking for comments or suggestions on the by-law outlining responsibility for maintaining the walkway system free of snow, ice and debris.
10. Only one written response was received (from Larry Wallace at the Rayuka) which I have also attached.
11. The Northern Store questioned the type of de-icing agent that should be used and whether or not an ice-chipper should be used.
12. Chris from Ramparts advised that he was using his snow plow to clear their area but was concerned about the section (fire lane and loading/unloading zone access) where he had to use a shovel as some of the bricks are installed a little unevenly in order to achieve the angle required to lower that area. He was worried about damaging bricks in this area.
13. Richard Thomas of the Dental Clinic asked that a set rate be established and included in the by-law which would indicate the cost should the Town be required at any time to do the work on the owners behalf and charge those costs back (Section 3(b). This would allow him an idea of costs should he be out of town for any period of time. January 12, 1998
