BASIC ELIGIBILITY REQUIREMENTS

SECTION 1 – REQUIREMENTS

020101. AUTHORIZATION

a. OPNAVINST 6110.1, Physical Readiness Program

020102. CITIZENSHIP. Applicants for all officer programs must be citizens of the United States (born in the U. S. A. or naturalized or born abroad of U. S. parents). Dual citizens are eligible to submit Advance Documents (ADDOCs), but to be Final Selected (FINSEL) they must submit proof of renouncing second citizenship. Contact COMNAVCRUITCOM (N36) for further guidance or questions.

020103. INQUIRIES FROM FOREIGN NATIONALS

a. When written inquiries are received from citizens of foreign countries, they shall be forwarded to COMNAVCRUITCOM (N3) for reply.

b. Forwarding of recruitment information or material to a foreign country without consent of the country concerned is a violation of international law and is prohibited, regardless of the kind of communication used. However, it is permissible to give recruitment information or material to foreign nationals

Chapter 2 Section 1 1 COMNAVCRUITCOMINST 1131.2C appearing in person at recruiting offices in the United States or its possessions.

c. It is permissible to forward recruiting information or material to United States diplomatic officials in a foreign country.

020104. SOCIAL SECURITY NUMBER. Public Law 881 (84th Congress) mandates that members of the military participate in the social security system. In addition, Chief of Naval Personnel has directed that the social security number be the military personnel identification number per MILPERSMAN Article 1000-060. All applicants are required to have a social security number assigned prior to submitting an application for a Navy officer program.

020105. LEGAL ISSUES. Recruiters shall inquire with all applicants as to the status of any previous or current legal issues and properly document the applicant’s responses.

a. The Officer Recruiter (OR) and Officer Programs Officer (OPO) shall review Article 020201, Eligibility Determination and Article 020202, Mandatory Rejection, to ensure the applicant is still eligible for processing. Following this review, should the applicant still be eligible, final acceptability of the applicant will be determined by COMNAVCRUITCOM (N3) staff. COMNAVCRUITCOM considerations include, but are not limited to the following factors:

(1) Evaluation and recommendation of the Commanding Officer

(2) Nature of conviction and degree of participation

(3) Age at time of conviction

(4) Length of time since the conviction

(5) Established pattern of conviction/involvement

(6) Home environment at time of conviction

(7) Applicant’s motivation towards serving his/her country in the Navy

b. The single most important aspect of a waiver request is the Commanding Officer’s recommendation, particularly in the case of a felony waiver. While even the strongest recommendation cannot

Chapter 2 Section 1 2 COMNAVCRUITCOMINST 1131.2C make a noncompetitive applicant competitive, it does serve to influence the outcome of determinations when an applicant cannot demonstrate overwhelming potential, yet is not sufficiently below standards to warrant disapproval. Specific recommendations are desired. An endorsement that merely forwards a request will be considered as unfavorable. In all decisions for waiver of eligibility requirements or program qualifications, a detached, objective viewpoint is necessary to ensure success of the primary mission of Navy Recruiting Command.

c. Applicants who are charged and/or convicted of any criminal offense (other than traffic violations not to exceed $250) after final selection, but prior to shipping, must resolve all legal issues prior to executing and reporting to OCS/OIS. The applicant must provide documentation to COMNAVCRUITCOM (N31) for non-nuclear OCS applicants, COMNAVCRUITCOM (N33) for Nuclear applicants, and COMNAVCRUITCOM (N34) for non-nuclear OIS applicants to prove they are free of any further obligations. Resolution of legal issues is defined as being clear of all state, city, and/or county encumbrances. This includes, but is not limited to:

(1) All community service

(2) Unsupervised probation

(3) The payment of all fines

(4) Any other court-imposed requirements

d. Criminal/civil charges may result in the applicant’s release from the direct DEP pool depending on circumstances involved with the charges/allegations. Failure to inform COMNAVCRUITCOM in writing within 14 calendar days of the initial offense shall constitute grounds for immediate release from DEP pool and rejection of future applications and/or reconsiderations. For collegiates involved in criminal or civil actions, refer to Chapter 11 for further guidance.

020106. DEPENDENCY STATUS

a. There are no restrictions relative to dependency status for application to Navy officer programs with the exception of the Naval Academy.

b. For all applicants (including reserve applicants), any single parent or dual military couples having custody of one or

Chapter 2 Section 1 3 COMNAVCRUITCOMINST 1131.2C more children shall submit a Family Care Plan Arrangements form (OPNAV 1740/7) to the NAVCRUITDIST Commanding Officer/Executive Officer for review in order to obtain an endorsed Department of the Navy Family Care Certificate (OPNAV 1740/6), from the NAVCRUITDIST CO/XO as part of their application for commission. For reserve applicants, the plan shall be effective during any required training or mobilization periods. The OPNAV 1740/7 shall be retained in the applicant's NAVCRUITDIST file.

c. Applicants shall be advised that no preferential treatment with regard to assignments will be afforded single parents.

020107. PREVIOUS DISENROLLMENT FROM PROGRAMS LEADING TO A COMMISSION

a. Previous disenrollment, either voluntary or involuntary, from a program leading to a commission in any branch of the military is not automatically disqualifying; disposition is dependent upon the designator.

b. Selection boards will not make a final decision on an applicant without first reviewing the reason for the disenrollment. Applicants must provide a written statement regarding the reasons for the disenrollment or furnish documentation deemed sufficient by the program manager(s) from all officer communities for which the individual wishes to apply.

c. Applicants who have previously been enrolled in any ROTC program and have received pay entitlements, subsistence allowance, tuition, or fees are not eligible for the Baccalaureate Degree Completion Program (BDCP). See Article 030101.

d. Former USNA midshipmen and NROTC members of either the scholarship or college programs who have received pay entitlements, subsistence allowance, tuition, or fees under the provisions of these programs are eligible for Nuclear Propulsion Officer Candidate (NUCPOC), but may not be placed on active duty until graduation. See Article 030201.

020108. DUAL COMPENSATION. In accordance with 5 USCS §5533, a person who is drawing a government pension or disability compensation may submit an application for an officer program; however, a waiver of compensation is required and will become

Chapter 2 Section 1 4 COMNAVCRUITCOMINST 1131.2C effective at the time the applicant begins receiving any compensation prescribed for active duty, active duty for training, or inactive duty training (see NAVCRUIT 1100/26).

020109. ORTHODONTIA

a. Applicants wearing orthodontic retainer appliances, either fixed or removable, are acceptable for enlistment/ commissioning with a P1 profile and immediate active duty.

b. Applicants wearing orthodontic appliances (braces) are not qualified for active duty.

c. Individuals wearing fixed orthodontic appliances, who are otherwise mentally and physically qualified, may enlist/ commission in Officer Student Programs only. These applicants must present a letter from their orthodontist, on the date of initial physical examination, stating that orthodontic treatment shall be concluded and the appliances removed, at the individual’s expense, prior to transfer to OCS/OIS or DCO school.

d. Direct accession officer and DCO program applicants wearing fixed orthodontic appliances, who are otherwise mentally and physically qualified are prohibited from enlistment/ commissioning as the orthodontic treatment cannot be concluded and the appliances removed, at the individual’s expense, prior to transfer to OCS/OIS or DCO school.

e. Individuals who have not completed orthodontic treatment, or who have fixed orthodontic appliances in place, at the time of transfer to OCS/OIS or DCO school shall be disqualified from entering onto active duty.

f. Applicants must clearly understand that the Navy will not incur any obligation or cost connected with orthodontic appliances either during or after enlistment in an officer student program.

g. Retainer appliances require no further treatment and are not to be confused with orthodontic appliances (braces), which require continued treatment and are disqualifying.

020110. BODY ART AND ORNAMENTATION

a. Definition. Body art includes branding, body piercing, body mutilation and ornamentation. Types of this body art are,

Chapter 2 Section 1 5 COMNAVCRUITCOMINST 1131.2C but not limited to, tongue splitting/forking and facial ornamentation such as silicon implantations and horning. Types of body markings/art on any individual that will prohibit said individual from serving in the United States Navy are markings that are in direct conflict with the Navy’s high standards and conservative approach to personal appearance, are inappropriate by location, intent, content, or that are considered prejudicial to good order, discipline, and morale, or are of a nature to bring discredit to the Navy.

b. Direction. Each applicant shall be evaluated with regard to tattoos and/or body piercing, ornamentation, branding, and body mutilation when determining enlistment/commissioning eligibility. In addition to reviewing the particular form of body marking, the evaluator shall gain a complete understanding from the applicant on the meaning or purpose that the marking/art represents. Although a particular form of body marking may appear innocent or benign, certain symbols may represent membership in organizations or personal orientation toward known subversive, criminal or other behavior(s). Therefore, all Navy Recruiting personnel shall be cognizant of the Navy’s policy.

c. Process of Evaluation

(1) Use of the Navy Officer Recruiting Tattoo Screening Certificate, NAVCRUIT 1131/27 is mandatory for any applicant with body markings. The completed certificate shall be signed and dated by the OPO if all questions are answered "no". If the applicant answers "yes" to any question, the CO/XO shall conduct an interview (face-to-face or telephonically) with the applicant and the completed certificate shall be signed and dated by the CO/XO. The Screening Certificate shall be included as part of the applicant's Advance Documents (ADDOCS) and a copy placed in the applicant's District file.

(2) Officer Recruiting personnel shall conduct a screening for all tattoos/body marking(s). All applicants with one or more tattoos shall be photographed in crew-neck T-shirt and running shorts. The only clothing manipulation authorized is to have the applicant roll up his/her sleeves if the tattoo is on the upper arm. Only tattoos/markings visible as prescribed below shall be photographed by Officer Programs personnel.

(a) Location. All photographs shall be taken using a two person same sex rule in a location that provides for the applicants privacy. No photographs shall be taken out in the

Chapter 2 Section 1 6 COMNAVCRUITCOMINST 1131.2C open. In the event there is not a second same sex person in the Navy Headquarters (HQ) or Navy Officer Recruiting Station (NORS), using other service or Navy Recruiting personnel is authorized.

(b) Processing. Applicants with tattoos/body markings shall arrive at HQ or NORS with the proper clothing prescribed above and briefed as to what photographs shall be taken and by whom. They shall also read and sign the tattoo screening form acknowledging the screening process.

(c) Delivery. The Tattoo Screening form and, when required, Tattoos/Body marking(s) photographs shall be included with the ADDOCS and shall be reviewed by the appropriate COMNAVCRUITCOM Officer Programs Director (N31, N33, or N34) as part of the normal application review. Additional documents shall be on an as needed basis and requested if needed.

(3) COMNAVCRUITCOM Officer Programs Directors (N31, N33, N34) are responsible for final determination for applicants whose body marking(s) may be considered inappropriate for members of the Naval Service.

d. Criteria for Evaluating. The following criteria shall be used when screening/evaluating applicants for body marking(s). These criteria are content, location, coverage/size, and number.

(1) Content

(a) Prejudicial to Good Order and Discipline. Body marking(s) that are sexist, considered homosexual/bisexual express nudity, racist, vulgar, anti-American, anti-social, extremist group or hate organization oriented, eccentric in nature, or brings possible discredit to the Navy are prohibited. Any applicant who has body marking(s) that express an association with conduct or substances prohibited by Navy Drug Policy and UCMJ, to include illegal drugs, drug usage, or paraphernalia are prohibited. Any body mutilation (i.e., tongue splitting/forking, facial ornamentation (silicon implantations)) is prohibited.

(b) Gang or Extremist Groups. Any applicant who has body marking(s) relative to hate/gang membership or gang activity is ineligible for enlistment/commissioning. Markings in this category are prohibited and shall be disapproved. Local law enforcement and the respective NAVCRUITDIST Commanding Officer and CMEO can provide information and should be utilized when

(2) Location

(a) Head or Neck Area. Body marking(s) on the head and/or neck area are prohibited. Waivers to this rule may be considered only under unique circumstances (e.g. cosmetic eyebrow replacement, etc.). The neck area, for the purpose of definition, is that visible area above the collar line of a proper fitting crew neck T-shirt. If any part of a tattoo/body mark exceeds the top of a proper fitting crew neck T-shirt, no exceptions to policy shall be authorized.

(b) Dental Ornamentation. Gold veneer on the teeth, or any type of dental ornamentation, is prohibited and enlistment/commissioning is not authorized. Ornamentation considered decorative in nature is prohibited. In cases of gold teeth/caps that are considered functional, a signed and dated letter by a dentist describing the functional requirement is required.

(3) Coverage/Size

(a) Applicants with excessive tattoos/body markings are not eligible for enlistment/commissioning. The definition of excessive is as follows: "when a greater percentage of the body part is covered in tattoos/body marks than is not covered".

(b) While screening/evaluating an applicant for tattoo/body marking coverage, particular attention shall be given to how much of the tattoo can be seen while wearing a proper fitting crew neck T-shirt and running shorts. If it is apparent to the screener/evaluator that the person is “covered” with tattoos/body marks, the applicant shall be rejected. A single tattoo could be considered excessive if it takes up an entire forearm, leg, back, chest, etc. as well as several small tattoos/markings.

(c) The intent of the coverage/size rule is to reject applicants who have more tattoos/body markings than skin showing while in uniform. Using a proper fitting crew neck T-shirt and running shorts ensures that it is not of a size to be prejudicial to good order and discipline.

(d) Individual body marking(s) exposed while wearing the T- shirt and running shorts shall be no larger in size than the wearer's open hand, with all fingers touching, placed directly

(e) Final determination for applicants with entire body parts tattooed/ marked or numerous tattoos in the same location will be made by the respective COMNAVCRUITCOM Officer Programs Director (N31, N33, or N34). Example: full back/chest tattoos, forearms/legs covered with several small tattoos.

(4) Number

(a) All cases of five or more tattoos/body markings will be reviewed and approved by the appropriate COMNAVCRUITCOM Officer Programs Director (N31, N33, or N34) prior to enlistment/commissioning.

(b) The request must include the Navy Officer Recruiting Tattoo Screening Certificate, NAVCRUIT 1131/27, and digital photographs of each body marking(s).

(c) Numerous tattoos are not always disqualifying, however numerous tattoos all in the same area can be if it is determined to cross the coverage/size rule.

e. Removal/Alteration of Body Marking(s). Individuals who have any body marking(s) meeting the criteria described herein concealed and/or altered shall still be required to be evaluated by the appropriate COMNAVCRUITCOM Officer Programs Director (N31, N33, or N34) prior to enlistment/commissioning.

(1) Recruiters shall not render any opinion or guidance that removal, concealment, or alteration of any disqualifying body marking(s) will result in approval to enlist/commission.

(2) Applicants that received an Entry Level Separation (ELS) from RTC or been previously rejected by COMNAVCRUITCOM Officer Programs due to the Navy’s body marking policy, and have subsequently had the body marking(s) removed or covered, may be eligible to enlist/commission. In such cases, submit the NAVCRUIT 1131/27 and digital photograph(s) or description(s), as appropriate of the altered area(s) to the appropriate COMNAVCRUITCOM Officer Programs Director (N31, N33, or N34) via (N36) for evaluation and determination.

020111. BACCALAUREATE DEGREE COMPLETION PROGRAMS. Recruiters and processors shall ensure BDCP applicants are familiar with the BDCP provisions as well as the specific community’s program description provisions that they are applying for (i.e., Surface

Warfare (11650) option). See Article 030101.

020112. MILITARY SERVICE MEMBERS

a. ROTC Participants. Recruiters shall not attempt to recruit students for OCS who are receiving an ROTC scholarship. Where basic military training is required of all students (such as VMI and the Citadel) participants are eligible for Navy officer programs as long as they are not regularly enrolled by signed obligation in any ROTC program. If a member of an Army or Air Force ROTC unit requests application to an officer candidate program within six months prior to receipt of a college degree, and presents a statement signed by an authorized official of the parent service that he/she will be released from any contractual obligation for military duty incurred through membership in that service, the application may be accepted. Under no circumstances shall Navy recruiting personnel/activities initiate or assist with the initiation of a request for release from contractual obligation.

b. Officer Programs. Any applicant who has ever held a commission in any branch of the Armed Services is ineligible for commissioning through Officer Candidate School (OCS) and cannot be processed by COMNAVCRUITCOM. Recommend these individuals to their service personnel command for lateral transfer. Active commissioned officers must apply for lateral transfer through Commander, Navy Personnel Command via their service personnel command.

(1) Active Duty Commissioned Officers. Active duty commissioned officers of any branch of the Armed Services must request an inter-service transfer through their parent service.

(2) Inactive Duty Commissioned Officers. Inactive duty Commissioned Officers of any branch of the Armed Services (except the Navy) are generally eligible to apply for any direct commission program through COMNAVCRUITCOM. Specific requirements for each are listed by program in this instruction. Officers that hold a commission in the reserve component of another service in the same corps for which they are requesting transfer to active duty Navy, shall be processed as an inter- service transfer from the reserve component of their parent service to the reserve component of the Navy (reference MILPERSMAN 1300-080, Part 2). They then complete the recall to active duty process. This application can be completed as a

Chapter 2 Section 1 10 COMNAVCRUITCOMINST 1131.2C single application provided all documents for the inter-service transfer and recall to active duty are included in the application. Recruiters shall coordinate these applications closely with the respective program manager. Officers in the reserve component of another service who desire appointment in an active duty Navy status in a different corps from which they currently hold a commission are processed as a direct appointment – these officers must obtain a Conditional Release, DD Form 368 , signed by the approving authority of their parent service. Navy inactive commissioned officers are eligible to apply for medical programs through COMNAVCRUITCOM via active duty recall.

(3) U. S. Public Health Service (USPHS) Officers are eligible to apply, provided they obtain a conditional release (such as a DD Form 368) from the Public Health Service.

c. Commander, Navy Personnel Command (PERS-4911) has cognizance over inter-service transfer programs.

d. Other Service Enlisted Members (Active, Inactive and Inactive IRR). Members of other components of the armed service may apply for any officer program for which eligible provided a statement of conditional release (such as a DD Form 368) is submitted. Eligibility can be found under the “SOURCE” section by designator. Under no circumstances shall Navy recruiting activities actively pursue active enlisted members of other components of the armed service.

e. Navy Enlisted Members

(1) Active duty Navy enlisted members apply in accordance with OPNAV Instruction 1420.1 and submit an application through their chain of command.

(2) Active Naval Reservists (SELRES) apply through their local NAVCRUITDIST, but must obtain a Conditional Release, DD Form 368, signed by the Naval Reserve Activity (NRA) Commanding Officer, prior to submitting their application.

(3) Inactive Naval Reservists (Individual Ready Reserve (IRR)) apply through their local NAVCRUITDIST and do not require a conditional release with the exception of officer applicants applying for any medical program.

020113. EDUCATION CREDENTIALS. Applicants must meet the

Chapter 2 Section 1 11 COMNAVCRUITCOMINST 1131.2C specific educational requirements of each officer program for which they apply. All institutions attended to achieve the necessary educational criteria for a program must be properly regionally accredited as listed in the current or applicable American Council on Education (ACE) Accredited Institutions of Postsecondary Education Directory.

020114. SWIMMING REQUIREMENTS

a. The Third Class Swim Test is administered early in the training program at OCS and OIS. Candidates who are unable to successfully complete the swim test will be considered for attrition from the program. All officer candidates are expected to be able to swim prior to reporting to OCS/ OIS. An applicant's ability to swim is strictly based upon their self- admission on the swim skill questions of the Application for Commission (NAVCRUIT 1131/2). Applicants selected for OCS/OIS programs shall be encouraged in writing by the OPO to practice swimming prior to shipping to OCS/OIS.

b. The Third Class Swim Test consists of the following:

(1) Abandon Ship Jump: Jump from a 12-foot tower to simulate abandoning ship.

(2) 50-yd Swim: Using any single stroke or combination of the crawl, breaststroke, sidestroke, and elementary backstroke.

(3) Five Minute Prone Float: Remain afloat (face down), utilizing survival floating skills, for five minutes (drown proofing).

(4) Shirt and Trouser Inflation: Fill a shirt and pair of trousers with air to remain afloat.

c. Refer to Chapter 3, Sections 1, Articles 030105 and 030106, for further details on additional swim requirements for Aviation Officer and Naval Flight Officer programs.

020115. DIRECT COMMISSION OFFICER COURSE

a. The Direct Commission Officer (DCO) course (Q-9B-0024) is designed to provide newly commissioned Reserve Officers with instruction on essential subjects including naval leadership, military law, administration and other military subjects which will prepare them for the responsibilities of commissioned service and follow-on skill training. Introductory damage

Chapter 2 Section 1 12 COMNAVCRUITCOMINST 1131.2C control and third class swim qualification are also included. Officers must attend this course within one year of commissioning per SECNAVINST 1101.33.

b. Appointees are highly encouraged to complete the Naval Orientation Non-Resident Training Course (NAVEDTRA 82966) prior to attending the DCO course.

c. Officers who fail to complete indoctrination requirements may be involuntarily transferred to the IRR and not recommended for re-affiliation.

SECTION 2 – ELIGIBILITY DETERMINATION

020201. ELIGIBILITY DETERMINATION AUTHORITY

a. Final Selection Authority. Final selection authority for all officer candidates (other than NROTC) and Direct Appointment programs has been delegated to COMNAVCRUITCOM. In all cases, these selection decisions are based on the "whole-person" concept, taking into consideration all elements of an individual's application. In each case, recruiters must ensure that prospects/applicants understand that application submission and pro-board recommendation does not constitute final selection nor guarantee final selection. It is incumbent upon the recruiter to ensure that adequate, complete, and accurate information is available to selection board officials to aid them in making an informed decision.

b. Waiver Authority. Waiver authority resides with Commander, Navy Recruiting Command (COMNAVCRUITCOM) or higher authority for officer applicants.

c. Waiver Procedures. Unless requesting a medical waiver, requests for waiver consideration of eligibility requirement or program qualification and requests for determination of suitability for enlistment or commissioning shall be sent to COMNAVCRUITCOM (Attn: N31 for non-nuclear OCS programs, N33 for Nuclear programs, and N34 for non-nuclear OIS programs). The Commanding Officer’s endorsement of request for waiver is mandatory in this process.

d. Field Rejection Authority

(1) Officer recruiters shall review and examine the facts surrounding a prospect's application and background to determine whether they are suitable for appointment in the United States Navy. Proper evaluation of all information obtained will eliminate individuals who are definite risks with regard to future performance and those who may eventually bring discredit to the Navy. Nothing in this manual is meant to preclude rejection of a prospect for enlistment or appointment by recruiting personnel acting within the bounds of good judgment, if it is determined the prospect is not desirable for commissioned service.

(2) Commanding Officers shall ensure a thorough evaluation is conducted by a field review board for all prospects who show a possible cause for rejection at the field level. This review

Chapter 2 Section 2 1 COMNAVCRUITCOMINST 1131.2C board shall consist of at least two commissioned officers, one of which may be the officer recruiter. A decision of the field review board to reject the prospect shall constitute sufficient authority to discontinue processing. Reasons for field rejection include but are not limited to:

(a) Not meeting basic qualifications for the desired program

(b) Two or more DUI/DWI convictions (except in exceptional circumstances)

(c) Admitted sexual deviation

(d) On probation (supervised and unsupervised)

(e) Pending lawsuit

(f) Convicted of domestic violence

(3) Field rejection based on a qualitative judgment of professional experience is not permitted in the case of prospects for the Medical, Dental, Nurse, Medical Service, Judge Advocate General and Chaplain Corps. This does not preclude field rejection based on items (a) thru (f) as stated above. Furthermore, the recommendation of suitability/non-suitability reflected on the summary sheet must reflect a whole-person evaluation of the applicant, regardless of professional standing.

e. Notification of Rejection

(1) Non-selection letters following COMNAVCRUITCOM selection board action will be prepared by COMNAVCRUITCOM and mailed to the applicant by regular U. S. Mail.

(2) If it is determined that field rejection of a prospect is justified, the NAVCRUITIDIST shall prepare and send a notification letter to the prospect. The manner in which field- rejected prospects are notified is of great importance in maintaining favorable community relations and care shall be taken with regard to the applicant's feelings and self-respect. Rejected prospects must be made to feel that the Navy also regrets that they cannot be accepted, and that their interest in the Navy is sincerely appreciated.

(3) Notification of field rejection will be made in writing (see Exhibit 0202-01). Alterations to this letter are not authorized. This letter for Navy officer programs (reserve and

Chapter 2 Section 2 2 COMNAVCRUITCOMINST 1131.2C active duty) shall be signed by either the NAVCRUITDIST Commanding Officer or Executive Officer, and are considered formal correspondence and forwarded to the prospect via certified or registered mail.

020202. MANDATORY REJECTION. COMNAVCRUITCOM (00J) will determine enlistment/commissioning eligibility, with or without waiting periods, or mandatory rejection for any prospect/ applicant who has had charges dismissed or who has been released from probation, suspended sentence, or any other form of civil restraint for the purpose of enlisting. Field rejection is mandatory for the following categories of prospects/applicants:

a. Criminal Proceedings. Any prospect/applicant who is awaiting trial, awaiting sentence, or on parole.

b. Civil Proceedings. Any prospect/applicant who has pending court dates/civil unpaid fines. This prohibition includes all types of litigation.

c. Probation/Deferment. Any prospect/applicant who is on supervised conditional probation, unsupervised probation or deferred sentence.

d. Drug Trafficking. Any prospect/applicant who has been a trafficker (supplier) of illegal drugs.

e. Religious Non-Compatibility. Any prospect/applicant whose religious beliefs conflict with the principle that voluntary enlistees/re-enlistees are subject to unrestricted service on a 24-hours-a-day, 7-days-a-week basis.

f. Mental Reservations. Any prospect/applicant who has reservations about military service because of religious, moral, or ethical reasons.

g. Reservations regarding the U. S. Constitution. Any prospect/applicant who has reservations about upholding and defending the Constitution of the United States, and its guarantees of civil rights and equal protection under the law for all residents of the United States regardless of their race, creed, color, sex, religion, or national origin.

h. Pregnancy. A female prospect/applicant who is pregnant.

i. Gender Identity Disorders. Any prospect/applicant who demonstrates or states a history of transsexualism and other

j. Deviant Behavior. Any prospect/applicant who demonstrates or states a history of exhibitionism, transvestism, voyeurism, and other forms of deviant behavior.

k. Sex Offender. Any prospect/applicant required by any State or Federal court, statute, or administrative regulation, to register as a sex offender resulting from conviction of rape, carnal knowledge, forcible sodomy, sodomy of a minor, prostitution involving a minor, indecent assault, assault with intent to commit rape, assault with intent to commit sodomy, indecent act with a minor, indecent language with a minor, kidnapping of a minor (by a person not a parent), pornography involving a minor, attempt to commit any of the foregoing, conspiracy to commit any of the foregoing, or solicitation to commit any of the foregoing.

l. Domestic Violence. Any prospect/applicant who has a qualifying domestic violence conviction in accordance with the Lautenberg Amendment.

Note: Should a District desire to forward for consideration an applicant with such a conviction, COMNAVCRUITCOM 00J shall review the individual's application and statements regarding the offense prior to the application being reviewed for possible selection. Those applicants rejected by COMNAVCRUITCOM 00J shall be field rejected by the local NAVCRUITDIST. Any questions regarding whether a conviction is a qualifying Lautenberg domestic violence shall be directed to COMNAVCRUITCOM 00J.

m. Hate Crimes/Gang Related Activities. Any prospect/ applicant who demonstrates or states a history of or desire to perpetrate hate crimes or involvement in gang related activities or organizations.

n. Selective Service Act Non-Compliance. Any male prospect/applicant, lacking mitigating circumstances, that has not complied with the Selective Service Act (50 USC §451).

o. Body Markings/Art. Any prospect with body markings/art that are in direct conflict with the Navy’s high standards and conservative approach to personal appearance, are inappropriate by location, intent, content, or that are considered prejudicial to good order, discipline, and morale, or are of a nature to bring discredit to the Navy. See Article 020110 for further

SECTION 3 - MEDICAL DOCUMENTATION/PHYSICAL EXAMINATIONS

020301. PHYSICAL STANDARDS

a. Applicants must meet height, weight and body fat standards per OPNAVINST 6110.1.

b. Military Entrance Processing Station (MEPS) personnel shall measure applicants who exceed the screening limits for body fat. Male applicants measuring 22% or less body fat (23% if 40 years of age or older) and female applicants measuring 33% or less (34% if 40 years of age or older) are commission eligible.

c. Only for the purpose of determining the maximum acceptable height for entry in the Navy, round down from the nearest measured inch (for example, 78 3/4 inches will be rounded down to 78 inches).

Note: Height to the nearest 1/4 inch will be recorded on the Report of Medical Examination (DD Form 2808 formerly the SF88).

d. All applicants must meet the physical standards for the program for which they are applying, as prescribed in the Manual for Medicine (MANMED). In all cases except NROTC program applicants, the Medical Advisor, Navy Recruiting Command (00M) will make the final recommendation of physical qualification on those candidates who do not meet physical qualifications.

e. Aviation applicants must weigh between 105 – 235 lbs. Pilot applicants rarely meet anthropometric standards below 64 inches in height or above 76 inches in height. NFO applicants between 62 inches and 78 inches in height generally will meet anthropometric standards. Questions regarding anthropometric qualifications are to be directed to COMNAVCRUITCOM (N31).

020302. APPLICANTS PRE-SHIPPING PHYSICAL READINESS TEST REQUIREMENTS

a. All OCS applicants must pass the Navy PRT with a score of “Good Low” in all categories (Good-Low in sit-ups, pushups and run) for selection and prior to reporting to OCS.

b. The Officer Recruiter shall record the PRT results in the Physical Fitness Test for OCS Programs (Greater than 5000 ft) form (NAVCRUIT 1131/28) or the Physical Fitness Test for OCS Programs (Less than 5000 ft) form (NAVCRUIT 1131/29) depending on the geographical location the test is being performed (see

Chapter 2 Section 3 1 COMNAVCRUITCOMINST 1131.2C

Article 040143 for specific guidance).

020303. APPOINTMENT, ENLISTMENT, AND AFFILIATION PHYSICAL EXAMINATION

a. Purpose. This Article covers policy and physical examination procedures for non-prior service (NPS) and prior service (PS) applicants processing for appointment, enlistment, or affiliation in either the Active Component (AC) or Reserve Component (RC) of the Naval Service. Exhibit 0203-01, Officer Physical Examination Processing Flow Chart, is provided as a ready reference.

b. Physical Examination. A physical examination is defined as an assessment performed by an authorized military or military service contracted healthcare provider for the purpose of determining an individual’s acceptability for initial entry, continued service, release, separation, or discharge from military service. At a minimum, physical examination documentation includes Report of Medical History (DD Form 2807-1 formerly the SF93), Report of Medical Examination (DD Form 2808 formerly the SF88), and any supporting documentation (i.e., consultation documents).

c. Active Component Officer Applicant

(1) All Active Component (AC) officer applicants must meet accession commissioning physical standards.

(2) Officer applicants may be either processed at MEPS, Military Treatment Facility (MTF), or on a limited basis, examined by an authorized contract physician with NAVCRUITREG Commander approval.

(3) When the examiner determines the applicant is physically qualified or not physically qualified, the applicant’s complete physical examination documentation together with their application shall be forwarded to COMNAVCRUITCOM (N36) for further processing.

(4) COMNAVCRUITCOM (N36) will perform a quality control check of the submitted applicant’s application and physical documentation to COMNAVCRUITCOM (00M). COMNAVCRUITCOM (N36) will track the status of the applicant’s application and COMNAVCRUITCOM (00M) review. COMNAVCRUITCOM (N36) will keep the Navy Recruiting District (NAVCRUITDIST) informed of the applicant’s status as appropriate.

(5) COMNAVCRUITCOM (N36) or the appropriate program manager will inform the NAVCRUITDIST when the applicant has been approved or disapproved for continued processing.

(6) Applicants for Active Duty Direct Appointment in the Medical Corps will receive a physical examination upon invitation to COMNAVCRUITCOM Detachment, Medical Corps Program Office (One-Stop-Shop) in Bethesda, MD.

Note: Special physical examination requirements for select officer designator eligibility determinations, i.e., chest x- rays and complete blood count (CBC) for Navy diver designators must be obtained and forwarded to COMNAVCRUITCOM (N36) together with the applicant’s standard physical examination and officer application.

Note: Pregnant Female applicants are not eligible for further processing.

d. Reserve Component Officer Applicant

(1) PS Navy officer applicants processing for affiliation in their previous designator who have been separated from active duty service within the previous six months or who were drilling reservists within the previous six months whose separation from active duty or drill status was not related to a medical condition must meet retention physical standards.

(2) All other applicants not included in paragraph 3.b.(1) must meet accession physical standards.

(3) All Direct Commission Officer (DCO), Inter-service transfer (IST) and Navy Veteran officer applicants physical examinations shall be forwarded to COMNAVCRUITCOM (N36), which includes a COMNAVCRUITCOM (00M) physical examination review. DCO and IST applicants shall forward their physical examination and application to COMNAVCRUITCOM (N36) at the time of application submission.

(a) PS Navy officer applicants who have been separated from active duty service within the previous six months or who were drilling reservists within the previous six months whose separation from active duty or drill status was not related to a medical condition shall have their DD 214 (long form); separation physical documents, to include an updated DD Form 2807-1; current body composition measurements (height/weight and

Chapter 2 Section 3 3 COMNAVCRUITCOMINST 1131.2C if applicable, body fat); and any other supporting documentation, if applicable sent directly to COMNAVCRUITCOM (N36) for processing and eligibility determination provided all the following conditions are met:

1. their last period of active duty was in the U.S. Navy as a commissioned officer,

2. they have possession of their last complete military provided physical and supporting documentation examination,

3. the physical and supporting documentation examination was conducted within the last 24-months, and

4. the physical and supporting documentation examination was not performed at a Navy Reserve Activity.

5. All PS Navy officer applicants who do not meet all of the above conditions, refer to paragraph 3.c.(3)(b).

Note: Body composition measurements shall be conducted and recorded on medical documents by a healthcare provider or a Command Fitness Leader (CFL) only.

(b) PS Navy officer applicants who have been separated from active duty for a period greater than six months or who were in a non-drilling status greater than six months require a new complete physical examination and updated medical history, DD Form 2807-1.

(c) For Direct Commissioning Officer and Inter-Service Transfer applicants, see Article 020310.

(4) Officer applicants may be processed at either a MEPS, Military Treatment Facility (MTF), or on a limited basis, examined by an authorized contract physician with NAVCRUITREG Commander approval. The use of Navy Reserve Activities to conduct physical examinations is prohibited. PS Navy officer applicants with military physical examinations less than 24- months old may not require a new physical examination and could have their physical documents and application sent directly to COMNAVCRUITCOM (N36) for further processing, which includes a COMNAVCRUITCOM (00M) physical examination review, refer to paragraph 3.c.(3)(a).

(5) COMNAVCRUITCOM (N36) will perform a quality control check of the submitted applicant’s application before routing the

COMNAVCRUITCOM (N36) will track the status of the applicant’s application and COMNAVCRUITCOM (00M) review. COMNAVCRUITCOM (N36) will keep the NAVCRUITDIST informed of the applicant’s status as appropriate.

(6) COMNAVCRUITCOM (N36) or the appropriate program manager will inform the NAVCRUITDIST when the applicant has been approved or disapproved for continued processing.

Note: Special physical examination requirements for select officer designator eligibility determinations, i.e., chest x- rays and complete blood count (CBC) for Navy diver designators must be obtained and forwarded to COMNAVCRUITCOM (N36) together with the applicant’s standard physical examination and officer application.

Note: PS Navy officer female applicants who are pregnant may process for affiliation up to their 32nd week of pregnancy.

e. Validity Period of Physical Examinations

(1) Physical examinations performed by United States Military Entrance Processing Command (USMEPCOM) are valid for a period of 24-months from the date of examination.

(2) Military separation, release, and discharge physical examinations are valid for a period of 24-months from the date of examination.

(3) Physical examinations must be dated no more than 90-days prior to the date of contracting applicants processing for RC affiliation. Physical examinations dated more than 90 days prior to the date of contracting must be updated with the use of DD Form 2807-1 and signed by a credentialed provider (medical officer, nurse practitioner, or physician assistant).

Note: New body composition measurements are required whenever a physical examination is updated.

f. Processing Applicants Receiving Disability Compensation, or Severance Pay

(1) Waiver of Disability Compensation. Disability compensation is a monetary benefit awarded by the Department of Veterans Affairs (DVA) based on a service-connected disability. Members who were found “Unfit” via a final Physical Evaluation

Board (PEB) determination with a rating of 30% or higher are transferred to the Permanent Disability Retired List (PDRL), while those rated below 30% receive disability severance pay. In many cases, these individuals choose to waive their Navy disability retirement compensation in favor of DVA disability compensation, which is usually at an increased percentage. Applicants in this category who are subsequently found physically qualified and are authorized to enlist must waive their disability compensation, regardless of source, and, if contracted, the disability compensation waiver must be effective on the date of the member’s enlistment or affiliation.

(2) Severance Pay. Personnel previously discharged with disability severance pay are not precluded from affiliating provided they meet physical standards and are qualified in all other respects. To ensure proper monitoring of these personnel, all such cases must be submitted to COMNAVCRUITCOM (00M). In such cases, the medical examiner’s determination that the requirements of DODI 6130.4 are fulfilled (passed) is no longer final and may be reversed by COMNAVCRUITCOM (00M). Consideration for waiver will be given at time of COMNAVCRUITCOM (00M) review.

(b) Enlisted personnel in the above category who subsequently reenlist are not required to repay the disability severance pay previously received. Any disability compensation being received however, must be terminated effective the date of reenlistment/affiliation.

g. Human Immunodeficiency Virus (HIV) and Instrumented Drug Testing (IDT) Requirements

(1) Instrumented Drug Test (IDT)

(a) All Navy applicants shall be screened for the presence of Marijuana, Cocaine, and Amphetamines via the collection of a urine sample and an instrumented drug test (IDT). MEPS perform instrumented drug testing for all Navy applicants processed through a MEPS. This is accomplished by the MEPS drug and alcohol test (DAT) initiated during the applicant’s initial physical examination. Applicants for RC affiliation will be screened for drug use during their first full drill requirement after contracting.

(b) AC officer applicants not administered an IDT by the MTF or contract physician are not eligible for further processing until an IDT can be performed. In such cases, the

Chapter 2 Section 3 6 COMNAVCRUITCOMINST 1131.2C applicant may be taken to either the NAVCRUITDIST or a local Navy Reserve Activity (NRA) to have a urine sample collected by the command’s urinalysis coordinator for delivery to one of the Navy’s authorized drug laboratories for screening. The urine sample shall be mailed individually to the Navy drug lab with clear instruction for the sample to be screened for the possible presence of drugs. Applicant urine samples are prohibited from being mailed with urine samples collected from command members as part of the Navy’s random drug testing program.

(2) Human Immunodeficiency Virus (HIV)

(a) HIV screening is a mandatory element in the physical examination process. MEPS performs HIV screening for all Navy applicants processed through MEPS. Applicants for RC affiliation will be screened for HIV during their first full drill requirement after contracting.

(b) MTFs and contract physicians may or may not perform HIV screening. HIV screening may be performed by any licensed healthcare clinic or NRA with the capability to perform HIV screening in cases where HIV screening is not performed by either the MTF or the contract physician.

(c) All applicants must sign a HIV Statement of Understanding (NAVCRUIT 1131/45) prior to being screened for HIV.

020304. EXAMINATION OF FEMALE APPLICANTS. Female applicants shall be examined by a provider in accordance with the MANMED. The presence of a female attendant is strongly encouraged.

020305. SEROLOGICAL EXAMINATION REPORTS

a. Every reasonable effort should be made to ensure that the physical reports submitted as part of the application include results of a serological exam. Where this is not possible, process per procedures found in the MANMED, which stipulate that when such examinations are not practicable at time of application or commission, they may be accomplished at the member's first duty station.

b. All new accessions shall be screened for the presence of the Human Immunodeficiency Virus, Type III (HIV) antibody. This testing is part of the entrance physical examination at MEPS or at Navy medical facilities. Negative HIV test results will be recorded on the DD Form 2808. All active duty officer applicants and DCO applicants must have a negative HIV result

Chapter 2 Section 3 7 COMNAVCRUITCOMINST 1131.2C within 12 months prior to commissioning. Documentation of negative results for the HIV screening must be signed by a Medical Department Representative except in the case of physicals conducted by MEPS.

c. Testing. Individuals who have a positive ELISA test will have a Western Blot test completed on their blood sample. For Navy Reserve applicants, negative HIV results must be verified and documented within 12 months before affiliation of a direct commission officer; assignment of a veteran to a drill status requires the applicant to sign a Page 13 agreeing to have an HIV drawn on their first drill weekend.

d. Notifying Applicants of Positive Test Results for MEPS Test Only. Individuals who test positive for HIV are not eligible for enlistment/commissioning/appointment/affiliation. Positive Western Blot test results and HIV test results will be treated with the highest degree of confidentiality, released to no one without a demonstrated need to know per MANMED. The following procedure applies for notifying applicants of positive test results:

(1) MEPS will notify a Western Blot/HIV positive applicant by registered letter that he/she needs to return to the MEPS to discuss a medical problem, and to contact his/her recruiter to arrange an appointment at MEPS.

(2) The Commanding Officer will receive an EYES ONLY copy of the letter. Upon being contacted by the applicant, the recruiter shall contact MEPS and schedule an appointment for the applicant with the Chief Medical Officer.

(3) Applicants are to be transported to and from the interview by responsible NAVCRUITDIST personnel. In no case will the recruiter inform an applicant of the positive test results.

(4) The medical officer will inform the applicant of the positive HIV test results, the implications of such results, and will offer the individual the opportunity for a second HIV antibody test.

(5) In those instances where the applicant acknowledges receipt of the letter, but does not return to the Navy medical facility within 30 days, the MEPS will send a second registered letter that specifically advises the applicant of the positive test results.

(6) When the NAVCRUITDIST receives acknowledgement of the second letter, the case will be considered closed.

e. Non-MEPS Positive Test Results Handling. Positive test results will be handled with extreme sensitivity and confidentiality. Under no circumstances shall a non-medical professional or recruiting personnel release test results to any applicant.

020306. DRUG AND ALCOHOL TEST (DAT). All officer candidates shall be administered a DAT as part of their physical examination for application for commission or appointment. In addition, they will be tested again within 72 hours of arrival (normally 24 hours) at their respective school (OCS/OIS/DCO). Candidates shall be made aware of these tests and advised that any positive result from a DAT will result in their immediate disqualification and release from active duty. Active duty collegiate programs (NUPOC, BDCP, CEC, HSCP) must have received the results of the DAT prior to commission/enlistment due to delay in reporting to respective schools. Inactive duty collegiate programs (HPSP, JAG students, etc.) will be tested upon commencing active duty (normally when reporting to respective schools).

020307. CONSULTS

a. The expense involved in obtaining additional medical information that is not available through the MEPS or military medical facilities, and which is required prior to an applicant's physical determination by COMNAVCRUITCOM (00M), must be borne by the applicant.

b. Statements from optometrists will be accepted on all matters pertaining to eye examinations, except definitive diagnosis of disease. If there is evidence of disease, then the opinion of an ophthalmologist regarding the type and severity of the disease process should be sought. Ophthalmologists are considered qualified to make statements concerning all diseases and conditions of the eyes. In all instances, the examiner should be informed of precisely what information is desired. When the desired information can be supplied by either an optometrist or ophthalmologist, no preference should be indicated to the applicant.

020308. CORRECTION OF MINOR PHYSICAL DEFECTS

Chapter 2 Section 3 9 COMNAVCRUITCOMINST 1131.2C

a. COMNAVCRUITCOM representatives will not recommend that any medical or surgical treatment be taken for the sole purpose of meeting the physical standards for enrollment in any officer program. Such corrective procedures should be done only with a view toward attaining a better state of physical qualification and only on the advice of the individual's personal physician. Correction of such defects will be the sole responsibility of the applicant, financially and otherwise, and no assurance, implied or otherwise, will be given that he/she will be accepted if disqualifying defects are corrected.

b. Elective surgical procedures, such as radial keratotomy, PRK and Lasik, which are performed to improve visual acuity, may not be accepted by the Navy as corrective. The performance of any corrective procedure may result in a condition, which disqualifies the applicant.

020309. REQUIREMENTS FOR RE-EXAMINATION

a. Applicants whose applications are pending, or who request reconsideration after failure to select for reasons other than physical disqualification, are not required to undergo a complete physical reexamination unless a period of two years has elapsed since the date of the last physical examination.

b. Applicants who are enlisted/commissioned must have a physical within two years of the projected commissioning date/graduation from OCS/OIS per MANMED 15-15. If the physical will expire prior to initiation of OCS/OIS, a new physical examination is required.

c. A complete physical examination and report are required in each instance where the applicant has suffered an illness, injury, or has elective surgery that has created a material change in his/her physical condition.

d. The Manual of Medicine (MANMED 18-44) states that pregnancy is a physically disqualifying condition. OPNAVINST 6000.1 states that women with pregnancies that existed prior to entrance or during initial training (i.e., Recruit Training or Officer Candidate School (OCS)) shall be discharged as unqualified for military service. Direct Commission Officer (DCO) applicants are not eligible to be commissioned if they are pregnant. Applicants previously disqualified for pregnancy may resubmit after being evaluated by an OB/GYN and obtaining a Release of Care certificate by the treating physician.

020310. NOTIFICATION OF PHYSICAL STATUS. In all cases of physical disqualification, the applicant shall be notified by the officer recruiter, including those who are temporarily disqualified.

020311. DOCUMENTATION REQUIRED IN THE APPLICATION PACKAGE

a. Applicant's Medical Prescreen of Medical History (DD 2807- 2) form is required for all applicants that require a physical, if using MEPS.

b. Original Report of Medical Examination (DD 2808) and Report of Medical History (DD 2807-1), as well as any supporting consultations. In some cases the servicing MEPS may require return of the original forms if additional information is needed. In such cases, a clear, legible copy may be substituted for the original in the application.

c. Copies of medical examinations stamped as "Working Copy" will not be evaluated by COMNAVCRUITCOM, 00M or BUMED, and must not be submitted.

020312. COURTESY REVIEWS

a. Purpose. The purpose of courtesy reviews is to provide an initial medical risk assessment to aid the NAVCRUITDIST in determining if an applicant should initiate application processing based upon knowledge of a known medical condition. Applicants shall not be sent to MEPS to obtain physicals for courtesy reviews.

b. The request for courtesy review shall be faxed [(901) 874- 9488] directly to COMNAVCRUITCOM (00M) with the following:

(1) An Officer Applicant Courtesy Review Cover Sheet (NAVCRUIT 1131/30).

(2) All civilian supporting medical documentation available including surgical reports (if applicable).

(3) A Medical Prescreen of Medical History Report (DD Form 2807-2)

(4) A statement from the applicant concerning the condition (if applicable).

(5) In the case of a prior military members or military

c. The OPO (or OIC of a NORS), or, in the absence of the OPO or OIC, the Executive Officer shall review and approve all courtesy review requests by signing and dating the Officer Applicant Courtesy Review Cover Sheet (NAVCRUIT 1131/30) prior to faxing the request to COMNAVCRUITCOM (00M).

d. COMNAVCRUITCOM (00M) will provide the NAVCRUITDIST with one of the following recommendations based on the documents provided:

(1) Processing warranted

(2) Processing not warranted

(3) Insufficient information to provide an assessment

e. In all cases, 00M will consider the assessment complete, and destroy all received documents after issuing their reply to the courtesy review request. This includes cases where insufficient information was provided.

f. In the case of "Processing warranted", see chapter 4 for application submission guidance. If during the normal 00M physical review, as part of the FINDOC process, 00M requests additional information, the additional information shall be submitted through COMNAVCRUITCOM (N36).

g. In the case of "Processing not warranted", the NAVCRUITDIST shall inform the applicant of 00M's initial assessment. As courtesy review risk assessments do not constitute field rejection criteria, the NAVCRUITDIST shall ask the applicant if they still wish to proceed with processing. If the applicant decides to complete processing, see chapter 4 for application submission guidance.

h. In the case of "Insufficient information to provide an assessment", the NAVCRUITDIST has two options:

(1) The applicant can seek; at the applicant's own expense, additional civilian medical documentation to assist 00M in making a medical risk assessment. If the applicant chooses to do so, the NAVCRUITDIST shall refax all documents included in the initial courtesy review request, any new documents obtained by the applicant and a new Officer Applicant Courtesy Review Cover Sheet (NAVCRUIT 1131/30).

(2) The applicant may submit an application. See chapter 4 for application submission guidance. Only after the applicant is RECPRO "Y" for any designator choice, should the applicant be permitted to complete a physical at MEPS.

i. Courtesy Reviews do not replace processing of the official physical. COMNAVCRUITCOM (00M) courtesy review risk assessments are only preliminary recommendations. They are not a final medical finding.

020313. COMNAVCRUITCOM MEDICAL WAIVER PROCEDURES. All medical program applicants and all other applicants who have been professionally recommended will have their medical documentation reviewed by COMNAVCRUITCOM (00M). The following procedures apply:

a. If the applicant is found to be Physically Qualified (PQ), no additional action is required.

b. If an applicant is found to be Temporarily Not Physically Qualified (TNPQ), COMNAVCRUITCOM (00M) will forward a letter directly to the NAVCRUITDIST stating the additional information that is needed prior to a final determination of physical qualification.

c. If an applicant is Not Physically Qualified (NPQ), a letter stating the reason for physical disqualification will be forwarded to the NAVCRUITDIST from COMNAVCRUITCOM (N36) and the applicant will be processed for non-selection.

020314. FLAG REVIEW PROCEDURES. Requests for Flag Review of a Not Physically Qualified (NPQ) applicant are only to be completed following acceptance of a non-selection letter due to NPQ. The following procedures apply:

a. The NAVCRUITDIST CO must write a formal request for flag review endorsing the applicant.

b. The CO’s formal request and all additional medical documentation not previously considered shall be forwarded to COMNAVCRUITCOM (00) for final determination.

020315. CONDITIONS PERMANENTLY DISQUALIFYING. The following list is to assist in ensuring the applicant will meet the goal of worldwide suitability for assignment/ worldwide deploy ability:

a. Medical Conditions Not Waiverable:

(1) Acquired Immune Deficiency Syndrome (AIDS), AIDS Related Complex (ARC), HIV Antibody, or history of any of the above

(2) Single kidney – regardless of cause

(3) Loss of an arm or leg

(4) Seizure disorder with seizure and/or medication within five years

(5) History of Cancer with treatment within five years (except basal cell carcinoma)

(6) Diabetes Mellitus Type I or Type II

(7) Loss of one eye

(8) History of Cataract surgery

(9) History of any Keratoconus (protrusion of the cornea)

(10) History of Glaucoma

(11) Refractive Surgery: Radial Keratotomy (Lasik and PRK may be considered for waiver)

(12) History of Aphakia (lens replacement of the eye)

(13) Severe Allergic reaction (Anaphylaxis) to insects or food

(14) Cirrhosis

(15) Corneal transplant history

(16) Crohn’s Disease and Ulcerative Colitis (Intestinal Ulcers)

(17) Severe deformities of the mouth, throat, or nose that interfere with speech or mastication of ordinary food

(18) Severe Scoliosis (spine curvature) or Kyphosis. Mild cases may be considered waiverable

(19) History of eating disorders: Anorexia Nervosa and Bulimia

(20) Headaches, recurrent, severe, which require daily prescription medication or interfere with daily activity

(21) Hepatitis, chronic: Hepatitis B or Hepatitis C carrier

(22) Malignant Hyperthermia/Hyperpyrexia (adverse reaction to anesthesia)

(23) Multiple Sclerosis (nerve disease involving muscle weakness and uncoordination) and Muscular Dystrophy (progressive atrophy/wasting of the muscles)

(24) Severe orthopedic injuries that result in functional limitations secondary to residual muscle weakness, paralysis, or marked decreased range of motion

(25) Otitis Media (middle ear infection/ inflammation), chronic or currently active

(26) Pes Cavus (abnormally high arches of the feet with increased extension of the toes), severe, symptomatic (other than routine orthotic use)

(27) Pneumonectomy, removal of entire lung

(28) Pregnancy

(29) Prosthetic replacement of joints

(30) Psychiatric Conditions: Schizophrenia; Major Depression, recurrent; Bipolar Disorder; Panic disorders; Sexual

(31) History of Retinal disease or detachment

(32) Undescended testicle unless surgically removed or confirmed to be congenital absence

(33) Severe chronic skin disorders. Atopic Dermatitis; Eczema; Psoriasis. Mild cases may be considered waiverable

(34) Spinal Fusion, greater than two vertebral spaces, congenital or surgical involving any number of vertebrae, by any method

(35) History of drug and/or alcohol abuse or diagnosed substance dependence

(36) History of Neurofibromatosis

(37) Non-repaired Congenital (birth) heart defects

(38) History of Intestinal Bypass or Stomach Stapling

(39) Severe head injury within the past five years

(40) Latex allergy

(41) Anabolic Steroid Use. Admitted steroid use within the previous two months. Any indication of high steroid dosage and/or chronic use must have internal medicine consultation to evaluate late or residual steroid effects. The MEPS Chief Medical Officer may consider waivers on an individual basis after attaining internal medicine consultation or appropriate history. If a waiver is recommended, request must be forwarded to CHBUMED (Code 25) via COMNAVCRUITCOM (00M). Dosage strength of steroids used must be documented in the waiver request. The following test results must be sent with the request for waiver:

(a) Microscopic urinalysis

(b) Liver function study

b. Medical Conditions which may be Submitted for Waiver Consideration. Applicants who appear to be, in all other respects, qualified for commission but reveal a history of one or more of the following conditions shall be advised that treatment records or a summary from their attending physician will be of value to the MEPS physician during the pre-commission physical examination and may reduce the possibility of temporary medical disqualification (note that this list is not all- inclusive).

(1) History of Ophthalmologic Disorders such as excessive refractive error: +/- 8.00 diopters sphere, +/- 4.00 diopters cylinder. Additional physical requirements by designator may supercede these levels.

(2) Lasik and PRK surgery to include Preoperative refractive measurements

(3) History of Respiratory disorders such as childhood Asthma, Reactive Airway Disease or Exercise-Induced Asthma, pneumothorax (traumatic or spontaneous)

(4) History of Orthopedic surgery or injury (ORIF, retained hardware, ACL or Arthroscopic, Bankhart repair, bunionectomy)

(5) History of Gynecological disorders such as Endometriosis, Cervical Dysplasia, or abnormal PAP smear

(6) History of Cardiovascular disorders such as repaired congenital heart malformation or conductive disorder (WPW) treatment

(7) History of Abdominal/Gastrointestinal disorders such as Hernia repair (must be 60 days postoperative with release from care statement), GERD, hemorrhoids

(8) History of Neurological disorders such as back pain, surgery or asymptomatic mild Scoliosis, sleepwalking, childhood epilepsy, concussion

(9) History of Urinary disorders such as kidney stones, proteinuria, or childhood enuresis

(10) History of Psychiatric disorders such as mood,

(Must provide medical treatment records/transcripts regarding work or school performance after discontinuation of medication. Applicant must have been off medication for one year.)

(11) History of Dermatological disorders such as mild skin disorders (i.e., acne, pilonidal cyst, contact dermatitis, urticaria, warts, etc.)

(12) History of Ear, Nose, and Throat (ENT) disorders such as middle ear surgery, sinusitis, allergic rhinitis

(13) Pure tone hearing loss at 500, 1000, 2000 Hz of not more than 30 db on average with no individual level greater than 35 db at these frequencies in either ear.

(14) Pure tone hearing loss at 3000 Hz and 4000 Hz not more than 35 db at these frequencies in either ear.

SECTION 4 - DRUG AND ALCOHOL ABUSE

020401. POLICY

a. Navy Regulations prohibit, except for authorized medical purposes, the introduction, possession, sale, or use of any narcotic or other controlled substances onboard any ship, craft or aircraft of the Department of the Navy, or within any naval activity or other place of jurisdiction of the Department of the Navy. Furthermore, they prohibit the possession of marijuana, narcotic substances or other controlled substances by persons in the naval service (except for authorized medical purposes).

b. It is the policy of the Department of the Navy that alcohol/drug dependent personnel or current alcohol/drug abusers will not be permitted to enter the Naval service. However, it is recognized that some people have clear potential to become creditable performers despite limited exposure to alcohol or drug abuse.

c. Recruiting procedures shall include positive measures to screen alcohol/drug abusers at the point of application for admission. They shall also provide an administrative procedure for the granting of pre-service drug abuse waivers to good risk applicants for initial entry into the service.

020402. DEFINITIONS. For the purposes of promulgating pre- service drug and alcohol abuse evaluations and drug waiver policy, the following related definitions are utilized:

a. Alcohol Abuse. The use of alcohol to an extent that it has an adverse effect on the user's health or behavior, family, community, or the Navy or leads to unacceptable behavior as evidenced by one or more alcohol induced incidents.

b. Alcohol Dependence. The psychological and/or physiological reliance on alcohol resulting from use on a periodic or continuing basis. (See also "Physical/Psychological Dependence" and "Alcoholism")

c. Alcohol - Induced Incident. Misconduct due to intoxication.

d. Alcoholic. An individual who is suffering from the disease of alcoholism.

e. Alcoholism. A disease characterized by psychological

f. Controlled Substance. Those substances listed in Schedules I-V established by Section 202 of the Comprehensive Drug Abuse Prevention and Control Act of 1970, as updated and republished under the provisions of that Act. Substances listed include but are not limited to marijuana, narcotics, hallucinogens/psychedelics and specific depressants and stimulants.

g. Depressants. Sedative-hypnotic drugs of diverse chemical structure all capable of inducing varying degrees of behavioral depression. Depending on dose, can have a sedative, tranquilizing, hypnotic (sleep), or anesthetizing effect. Most common categories of depressants include: barbiturates (e.g., Phenobarbital, secobarbital), tranquilizers or the benzodiazepines and methaqualone.

h. Detoxification. Medical and psychological management of the alcohol and drug withdrawal processes.

i. Drug Abuse. Illegal or non-medical use or possession of drugs.

j. Drug Abuse Paraphernalia

(1) All equipment, products, and materials that are used, intended for use, or designed for use in injecting, ingesting, inhaling, or otherwise introducing into the human body controlled substances in violation of law.

(2) Common forms of property that can fall within the definition of drug abuse paraphernalia include:

(a) Hypodermic syringes.

(b) Needles.

(c) Other objects used, intended for use, or designed for use in injecting controlled substances into the human body.

(d) Metallic or other containers used for mixing or other preparation of heroin, morphine, or other narcotic substances prior to such an injection. (e) Objects used, intended for use, or designed for use in ingesting, inhaling, or otherwise introducing marijuana,

Chapter 2 Section 4 21 COMNAVCRUITCOMINST 1131.2C cocaine, hashish, or hashish oil into the human body, such as chamber pipes, carburetor pipes, electric pipes, air-driven pipes, chillums, bongs, ice pipes or chillers, and other pipes, with or without screens, hashish heads, or punctured metal bowls, designed for the purpose of smoking marijuana or hashish; roach clips (meaning objects used to hold burning material, such as a marijuana cigarette, that has become too small or too short to be held in the hand).

(f) Cocaine spoons.

k. Drug Dependent. Having a psychological or physiological reliance on a drug resulting from use on a periodic or continuing basis. (See also "Physical/Psychological Dependence" and "Prescription Dependence".)

l. Drug Possession. The exercise or actual physical custody and control, or the exercise of dominion and control, over a controlled substance. Merely being in the presence of another person who is in possession of a substance, or merely knowing the location of a substance, does not constitute possession. The substance does not; however, have to be in the hands of a person or otherwise on the person. Possession may be established by the fact that the substance was found on the premises or in a place over which a person exercises dominion and control. Two or more persons may be in possession of a substance.

m. Drug-related incident. Any incident in which drugs are a factor. For the purposes of this manual, voluntary self-referral, use or possession of drugs or drug paraphernalia, or drug trafficking constitute an incident. Other types of incidents must be carefully evaluated to determine if drugs are an underlying factor where medical care is required or suspicious public or domestic disturbance has taken place.

n. Drug Trafficking or Supplying. The wrongful distribution (includes sale or transfer) of a controlled substance for monetary or material gain or profit.

o. Experimental/Casual use of Marijuana. One who has illegally or improperly used marijuana for reasons of curiosity, peer pressure or other similar reasons and who positively and clearly rejects any further use of marijuana. Marijuana use for more than a few times for reasons of a deeper and more continuing nature than those motivating the drug experimenters or casual users shall not be waived.

p. Hallucinogens/Psychedelics. A group of diverse, heterogeneous compounds all with the ability to induce visual, auditory, or other hallucinations and to separate the individual from reality. Depending on substance and dose, can cause disturbances in cognition and perception. Most common categories are:

(1) LSD

(2) Mescaline and peyote

(3) Psilocybin

(4) Psychedelic amphetamine variants (STP, MDA)

(5) Although a unique drug, for purposes of this manual, phencyclidine (PC) will be labeled in this general drug class.

q. Marijuana. Any intoxicating product of the hemp plant, cannabis (including hashish), or any synthesis thereof. For purposes of this manual the terms marijuana and cannabis are used interchangeably.

r. Narcotics. Any opiates or opiate derivatives, including their synthetic equivalents. Included as opiates are Morphine, Codeine, Heroin, Methadone, Talwin, Percodan, Darvon, etc.

s. Physical/Physiological Dependence. An alteration to an individual's physiology or state of adaptation to a drug or alcohol evidenced by a pattern of pathological use, impaired social or occupational functioning, tolerance or withdrawal symptoms when use is abruptly discontinued.

t. Polydrug Abuse. The abuse of two or more drugs during the same relative time period not necessarily simultaneously, where none can be considered the primary drug of abuse to the exclusion of others.

u. Prescription Dependence. The dependence on drugs prepared for and dispensed to an individual under the written direction of a physician. An individual may become dependent upon prescription drugs either through no fault of their own or through the manipulation of the medical system. Each incident of prescription dependence must be handled on a case-by-case basis to determine the individual's role in the addiction.

v. Psychological Dependence. The craving or need for the mental or emotional effects of alcohol or other drugs that manifests itself in repeated use and leads to a state of impaired social or occupational functioning.

w. Recovering Alcoholic. A person whose alcoholism has been arrested through abstinence.

x. Recovering Drug Abuser. A person whose illegal use of drugs has terminated and whose drug dependence, if applicable, has been arrested through abstinence.

y. Stimulants. Widely diverse category made up of central nervous system stimulant drugs that increase the behavioral activity of an individual. Most common categories of abused stimulants include:

(1) Cocaine

(2) Amphetamines

(3) Methamphetamines.

z. Cannabis. (See marijuana in subparagraph (q) above.

020403. WAIVER CRITERIA FOR DRUG USE

a. Nuclear Propulsion Programs. No officer or officer candidate will be accepted into the Nuclear Propulsion Program including officers assigned to Naval Reactors' staff, who has:

(1) Been addicted to any illicit drug or is physically or psychologically dependent on any illicit drug or alcohol.

(2) Been a drug trafficker or manufacturer per OPNAVINST 5355.3.

(3) Abused illicit drugs (other than cannabis). Note: Waivers for pre-service experimental cannabis use may be granted by COMNAVCRUITCOM (with Chief of Naval Personnel (Pers-42) concurrence), for Nuclear Propulsion Officer Candidates, Nuclear Power School Instructors, and Naval Reactor Engineers.

(4) During processing and in personal history questioning, the following will be accomplished for applicants for the Navy Nuclear Propulsion Program:

(a) Applicants will acknowledge, by signature, that they may be subject to further background investigation and that any false statements made during application may subsequently result in removal from the program. The certification will also indicate to what extent the applicant meets the criteria in the above paragraph and will contain a signed statement rejecting the illegal use of drugs.

(b) If the applicant admits to drug abuse and requests consideration, the following information concerning the circumstances of past drug abuse involvement will be obtained:

1. Type(s) of drug(s) abused

2. Number of times, approximate dates and amounts

3. Period over which taken

4. Last involvement

5. Civil involvement

(c) The NUPOC Pre-Service Drug Abuse Statement (NAVCRUIT 1131/8) shall be used to document the statements made by applicants for nuclear programs regarding drug use. This form will be submitted with the application kit to COMNAVCRUITCOM. COMNAVCRUITCOM will review all pre-service drug abuse statements and grant waivers, if appropriate (with PERS-42 concurrence). Applicants for these programs may be granted a pre-service drug abuse waiver by COMNAVCRUITCOM (with PERS-42 concurrence) for experimental use of marijuana only.

b. All Non-Nuclear Officer Programs. No individual will be accepted in any officer program, exclusive of the nuclear field programs above, who has:

(1) Been addicted, or physically or psychologically dependent on any drug or alcohol

(2) Been a trafficker of illegal drugs

(3) Abused narcotics (4) Abused dangerous drugs

(5) Abused marijuana within the past year

c. Pre-service drug abuse waivers may be granted for a

Chapter 2 Section 4 25 COMNAVCRUITCOMINST 1131.2C non-nuclear field officer applicant as part of the normal application process (no form is required - the required expanded explanation on the Application for Commission (NAVCRUIT 1131/2) is sufficient). Pre-service drug abuse waiver authority for applicants in non-nuclear related officer programs is COMNAVCRUITCOM with the concurrence of the DCNO (Manpower, Personnel and Training) for the community for which they are requesting to enter. Pre-service drug abuse waivers shall not be considered for any applicant for a non-nuclear field officer program who has:

(1) Abused narcotics within one year of the date of application submission.

(2) Abused dangerous drugs within one year of the date of application submission.

(3) Abused marijuana within six months of the date of application submission.

d. No applicant will be considered for a pre-service drug abuse waiver who does not reject further abuse.

e. Those applicants requiring drug waivers will be considered for a pre-service drug abuse waiver based upon the type and extent of drug abuse, expressed attitude toward past and future drug abuse, suitability under the whole-person concept, and the recommendation of the cognizant NAVCRUITDIST CO, XO or OPO.

f. Those applicants who are not eligible for drug waiver consideration under the parameters stated above are subject to mandatory rejection at the field level. This does not preclude submission of an application at a later date if the pre-service drug abuse waiver criteria can be met at that time.

020404. PREVIOUS OR CURRENT ALCOHOL ABUSE. Previous or current alcohol abuse, including documented alcohol-related incidents or offenses, will be a factor in the whole-person evaluation made by the selection board for all officer programs. Although not a mandatory rejection factor, significant history of alcohol abuse is considered a major deterrent to an applicant's qualifications and will normally result in non-selection.

020405. DRUG ABUSE WHILE ATTENDING INDOCTRINATION TRAINING. Officer candidates in OCS, officers in OIS, and reserve officers attending the DCO course who are identified as drug abusers by urinalysis or other methods will be disciplined as appropriate

Chapter 2 Section 4 26 COMNAVCRUITCOMINST 1131.2C and processed for separation. Officer accessions with enlisted status or an enlisted obligation will be immediately disqualified for commissioning and treated as enlisted members for disposition, as appropriate.
