Dear Sir, TSEWA regularly posts details of legal cases filed / being filed in AFT Delhi to get justice to the Ex-Servicemen and family pensioners. The details of how to become a member of TSEWA and join the legal case, eligibility, legal fees, last date without late fee, last date with late fees and particulars of All India Coordinator are given. Yet few veterans who join late request me to repeat the same. For their benefit I am giving all the relevant details so that you know which case helps you. LEGAL CASE IN BRIEF ALL INDIA CO-ORDINATOR LEGAL FEE WITHOUT LEGAL FEE WITH LATE FEE LATE FEE AFT Case No:1. The inf and Armd please ensure your rank and name is included in Corps Officers serve in their last rank for longer periods having been the transaction details and a copy of the same is promoted two to three years earlier than their course-mates and earn required to be sent along with membership form more increments, hence they drew more pension. For example a Col of Inf with 10 increments in last rank draws more pay hence more pension where as an Officer from Corps of Engrs of same seniority with say four increments in last rank draws less pay and less pension though both might serve for 30 years. But 6th CPC changed this well settled principle of pension fixation. All Officers who serve get same full pension whether they serve for 26 years or 34 years with no benefit given to their increments. Pre – 2006, 53 Maj Gens filed a case in AFT Chandigarh quoting judgment of hon’ble Supreme Court of Maj Gen SPS Vains Vs Union of India for getting pension proportionate to their length of service. They won the case and got higher pension than minimum of Rs 30,350 (full pension). Maj Gen A with 30 years’ service gets minimum pension of Rs 30,350 + DR and Maj Gen B who puts in 38 years’ service also gets same pension. No credit is given to 8 increments earned by Maj Gen B. As per judgment of hon’ble AFT Chandigarh, now Maj Gen B gets more than Rs 30,350 (could be as high as Rs 36,000 pm + DR). This case has nothing to do OROP Once the pension is enhanced as on Jan 2006, there is no more increase in pension till 2013 (as per OROP pension equalisation). Whereas OROP means pension increase every year after 2006 till 2015. Hence our legal case in no case jeoperdises agitations for OROP being launched in various localities in the country. The case has been filed in AFT (PB) Delhi on 22 Delhi 2015. 870 Officers and single ladies of deceased officers have joined in this case by 14 Jan 2016. Thumb rule to know whether you are eligible or not is : Do you as pre – 2006 pensioner get the same pension as on Jan 2016 compared to another post – 2006 officer who retired in Jan 2006. Then you are eligible to join till 31 Jan 2016 by paying late fee called Impleader fees of Rs 1000. If you are a post- 2006 Officer, then you are not eligible to join this case as you are getting much higher pension than pre – 2006 officer of same length of service and same number of increments in the last rank. This was followed by many disabled soldiers. All disabled soldiers of all ranks (from Sepoy to COAS) whether you are PMR, superannuated or invalided who are in receipt of disability element i.e. 20% and above percentages are eligible to join this case. They are likely to get handsome arrears from Jan 2006 to date of judgment. This case is being filed in AFT (PB) Delhi on 15 Feb 2016.
