BUILDING & LOCAL LAW SERVICES HOARDING FACT SHEET
When a permit is required for hoardings on a Council road or land
A requirement for hoardings may be brought about by:
(a) a determination by the relevant building surveyor that precautions are required to protect the safety of the public; or
(b) a desire by the builder or land owner to place hoardings on Council land for construction or similar purposes; or
(c) any other valid reason, as determined by Council.
Under the Building Regulations it is the relevant building surveyor* who is responsible to: decide when precautions are required through a building project seek details of precautions from the designer/builder approve suitability of precautions give details of any precautions projecting the street alignment to Council for consent andreport before issuing any building permit.
*the relevant building surveyor may be a private or municipal building surveyor dealing with the building permit application –
For any hoarding requirement not covered by the Building Regulations, similar assessment criteria will be adopted by Council.
Requirement for Local Law permit
[Clause 526 of the General Local Law 2008 (No.1)] (a) A person must not, without a permit, erect any hoarding, scaffolding, protective barrier or like structure on a road, public space or Council land. Hoarding permit applications with relation to building works requiring a building permit will not be decided unless a separate Council report and consent has been first obtained pursuant to the Building Regulations. An additional application process applies if Council becomes aware that report and consent is required. It is an offence pursuant to section 62 of the Road Management Act 2004 to obstruct a road unless the obstruction is authorised by the Road Management Act 2004 or any other Act. The granting of a permit under Stonnington City Council’s General Local Law 2008 No. 1 is evidence of approval for an activity that would otherwise be prohibited under section 62 of the Road Management Act 2004.
Application Lodgement
Applications for Local Law permits for hoardings and similar structures over Council land are to be made to Council’s Building & Local Law Services Unit at the Prahran offices (Cnr Chapel & Greville Streets Prahran, by post to PO Box 21 Prahran 3181 or email [email protected].
Application Requirements 1. A completed and signed Local Law permit application form.
2. A copy of any consent & report pursuant to reg 604 of the Building Regulations (where applicable).
3. A copy of a fully dimensioned and detailed site plan showing the hoarding or other structure over the street.
4. Payment of the permit fee (refer Council web site for current fee)
5. Evidence of a public liability insurance policy with minimum cover of $5,000,000 for the period of the permit.
Enforcement
The placement of hoardings and other temporary structures over Council land without a current permit issued by Council is an offence which may result in an infringement notice being issued or the breach being prosecuted in the Magistrates’ Court. A permit is only current during the period for which it is issued and upon payment of the appropriate fees, including any additional fees for extensions of time that may be granted.
***** It is the responsibility of the Permit holder to ensure that where an extension of time is required that permission is sought from Council and that any additional fees are paid to Council. ******
Authorised Council Officers will monitor the municipal district to ensure that, where required, appropriate Local Law permits have been obtained, are current, and that any conditions are being complied with.
