APPEAL BY MR SEAN BELL REGARDING OCCASIONS, ASCOT AVENUE, RUNCORN WA7 4YW

Thank you for sending me full copies of the third party representations in respect of the above appeal application. The submissions I have previously made already explain our case in detail and respond to virtually all the points in the letters. My comments on these third party letters are therefore confined to correcting matters of fact.

In his email dated 27 August 2009, Mr Finnegan makes reference to the shop being lit up until the early hours under the heading ‘C. LIGHT’. The shop will actually close at 10:30 p.m. No illuminated fascia signs are proposed for the reasons given by Mr Finnegan. Nor will there be any security lights left on overnight.

Mr Finnegan also refers to the mis-use of surveys. We have not relied on any surveys for this appeal. I have, however, commented on the distribution of appeal objectors on p.3 of my letter dated 30 March 2010.

Mr Davenport refers in his letter dated 25 August 2009 to the shop being open from 5 p.m. until 11:30 p.m. seven days a week. At no time is it proposed to open the shop until 11:30 p.m. The correct opening hours are given in my Design and Access Statement which was submitted with the appeal application, i.e:

 Monday to Saturday 11:30 – 13:30 and 16:30 – 22:30.  Sunday 17:00 – 22:00.  Bank Holidays closed.

Mr Davenport also alleges that the shop owner “does not care about the local area because he does not live locally”. The owner does actually live in Frodsham, but the property is leased to the appellant who will run the fish and chip shop with his partner. They do live locally in Thirsk Close which is just 360m from the appeal shop measured in a straight line or 410m along the road. I

It is clearly in Mr Bell’s interest to ensure the take-away is properly run and does not become a bad neighbour use. Mr Davenport’s concerns on this issue are therefore unfounded.
