MOTION TO WITHDRAW PRESENT COUNSEL AND SUBSTITUTE NEW COUNSEL

COMES NOW, Respondent, by and through undersigned counsel, and requests that the Court allow ATTORNEY 1 to withdraw her representation and permit ATTORNEY 2 to substitute in as counsel of record pursuant to 8 C.F.R. §1003.17. In support of this motion Respondent states the following:

1. ATTORNEY 1 of LAW FIRM began representing Respondent in January of 2006 on a pro bono basis in her application for asylum, withholding of removal, and relief under the Convention Against Torture (CAT). Respondent made an affirmative application for asylum on February 2, 2006 and the Asylum Office referred Respondent’s case to the Immigration Court on April 1, 2006.

2. Respondent is currently set for a merits hearing on December 15, 2008 before Judge Katsivalis.

3. On August 31, 2006, ATTORNEY 1 left LAW FIRM and is no longer able to represent Respondent. ATTORNEY 2, also of LAW FIRM, has agreed to take over the responsibility and representation of Respondent’s case.

4. ATTORNEY 1 wishes to withdraw from Respondent’s case and ATTORNEY 2 wishes to enter her appearance in ATTORNEY 1’s place.

5. Respondent is aware that ATTORNEY 1 wishes to withdraw from her case and that ATTORNEY 2 will be entering her appearance.

1 WHEREFORE, Respondent requests that ATTORNEY 1’s appearance be withdrawn and that ATTORNEY 2 be entered as the attorney of record in this matter.
