BILL NO. 2592-15 ORDINANCE NO. 2553-15
AN ORDINANCE VACATING A PORTION OF WALNUT STREET AND REVERTING OWNERSHIP OF SUCH PROPERTY TO SAKELARIS CAMDENTON PROPERTIES, LLC AND MID-COUNTY FIRE PROTECTION DISTRICT IN PROPORTIONS AS DESCRIBED HEREIN AND RETAINING AN EASEMENT FOR SEWER LINES
WHEREAS, Sakelaris Camdenton Properties, LLC and Mid-County Fire Protection District own all of the property along a portion of Walnut Street as described herein; and
WHEREAS, Sakelaris Camdenton Properties, LLC and Mid-County Fire Protection District have by agreement requested said portion of Walnut Street to be vacated by the City of Camdenton; and
WHEREAS, RSMo. 88.673 provides that the Board of Aldermen shall have power to vacate public streets and that whenever a public street is vacated, ownership of such street shall revert to the owners of lots adjacent thereto; and
WHEREAS, said portion of Walnut Street is no longer necessary to be used as a roadway; and
WHEREAS, the City of Camdenton wishes to retain a sewer easement for a sewer line that runs in the roadway area; and
WHEREAS, the Board of Aldermen of the City of Camdenton is in agreement to vacate such street.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF CAMDENTON, MISSOURI, AS FOLLOWS:
Section 1. That portion of Walnut Street a City street in the City of Camdenton, Missouri described as:
All that part of a 30.0 foot street known as Walnut Street which is adjacent to Lots 1, 2, 3, 4, 5 and 6, Block 14, “LYON’S ADDITION TO CAMDENTON”, a subdivision of Camden County, Missouri
shall be vacated and shall no longer be a City street.
Section 2. That pursuant to RSMo. 88.673, ownership of that portion of Walnut Street being vacated herein shall revert to Sakelaris Camdenton Properties LLC and Mid-County Fire Protection District as legally described in Corporation quit claim deeds from the City to each party respectively.
Section 3. That the City of Camdenton hereby retains an easement for the city sewer as described in Exhibit A attached hereto and incorporated herein by reference.
Section 4. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
Section 5. This ordinance shall be in full force and effect from and after its passage by the Board of Aldermen and approval by the Mayor.
