<p>BILL NO. 2592-15 ORDINANCE NO. 2553-15</p><p>AN ORDINANCE VACATING A PORTION OF WALNUT STREET AND REVERTING OWNERSHIP OF SUCH PROPERTY TO SAKELARIS CAMDENTON PROPERTIES, LLC AND MID-COUNTY FIRE PROTECTION DISTRICT IN PROPORTIONS AS DESCRIBED HEREIN AND RETAINING AN EASEMENT FOR SEWER LINES</p><p>WHEREAS, Sakelaris Camdenton Properties, LLC and Mid-County Fire Protection District own all of the property along a portion of Walnut Street as described herein; and</p><p>WHEREAS, Sakelaris Camdenton Properties, LLC and Mid-County Fire Protection District have by agreement requested said portion of Walnut Street to be vacated by the City of Camdenton; and</p><p>WHEREAS, RSMo. 88.673 provides that the Board of Aldermen shall have power to vacate public streets and that whenever a public street is vacated, ownership of such street shall revert to the owners of lots adjacent thereto; and</p><p>WHEREAS, said portion of Walnut Street is no longer necessary to be used as a roadway; and</p><p>WHEREAS, the City of Camdenton wishes to retain a sewer easement for a sewer line that runs in the roadway area; and</p><p>WHEREAS, the Board of Aldermen of the City of Camdenton is in agreement to vacate such street.</p><p>NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF CAMDENTON, MISSOURI, AS FOLLOWS:</p><p>Section 1. That portion of Walnut Street a City street in the City of Camdenton, Missouri described as:</p><p>All that part of a 30.0 foot street known as Walnut Street which is adjacent to Lots 1, 2, 3, 4, 5 and 6, Block 14, “LYON’S ADDITION TO CAMDENTON”, a subdivision of Camden County, Missouri</p><p> shall be vacated and shall no longer be a City street.</p><p>Section 2. That pursuant to RSMo. 88.673, ownership of that portion of Walnut Street being vacated herein shall revert to Sakelaris Camdenton Properties LLC and Mid-County Fire Protection District as legally described in Corporation quit claim deeds from the City to each party respectively.</p><p>Section 3. That the City of Camdenton hereby retains an easement for the city sewer as described in Exhibit A attached hereto and incorporated herein by reference.</p><p>Section 4. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.</p><p>Section 5. This ordinance shall be in full force and effect from and after its passage by the Board of Aldermen and approval by the Mayor.</p><p>Read the first time this 4 day of August 2015.</p><p>Read the second time and passed and approved this 4 day of August 2015. ______John D.
