 Providing a test case for the ACLU was George Rappalyea’s idea. He called the town leaders together, asked Scopes to do it, contacted the ACLU, and set it up (Linder, “Rappalyea” 2).  Town leaders met at the drugstore’s soda counter and agreed to Rappalyea’s idea because 1. they could help the ACLU overturn the Butler Act (they were pro-evolution), and 2. they could get good publicity money (Linder, “Rappalyea” 2; “Scopes is Indicted” 2-3).  Later, their opponents asked Bryan to join the prosecution, and they asked Darrow to join the defense, in part because Scopes wanted him (Linder, “Scopes” 3). John Scopes’s “crime” and the arrest:  Scopes agreed to be the teacher for the ACLU test case because he believed that teaching evolution was the right thing to do (“Monkey Trial”). He was also pressured somewhat by his father (Linder, “Scopes” 2).  Scopes was arrested on May 7, 1925 (Linder, “Bryan” 3). The exact language of the crime is listed in the NY Times article (“Scopes is Indicted”).  The arrest was just a formality- it interrupted his tennis game; he didn’t go to jail. Later, he wasn’t sure he ever really taught evolution. (“Monkey Trial” + Linder, “Scopes” 2).
