1 [1203-1] 1 2 3 4 5 6 7 8 9 A BILL 10 11 TO AMEND SECTION 50-11-10, AS AMENDED, CODE OF 12 LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE 13 FEDERAL MIGRATORY BIRD TREATY AND 14 PROHIBITIONS CONCERNING THE HUNTING OF 15 WATERFOWL, SO AS TO REVISE PROVISIONS 16 PERTAINING TO THE HUNTING OF MIGRATORY BIRDS 17 AND WATERFOWL AND PROVIDE PENALTIES FOR 18 VIOLATIONS OF THIS SECTION. 19 Amend Title To Conform 20 21 Be it enacted by the General Assembly of the State of South 22 Carolina: 23 24 SECTION 1. Section 50-11-10 of the 1976 Code, as last amended 25 by Act 181 of 1993, is further amended to read: 26 27 “Section 50-11-10. (A) The Federal Migratory Bird Treaty Act 28 and its implementing regulations are the law of this State. 29 However, the board annually may set special seasons, bag limits, 30 and methods for hunting and taking waterfowl migratory birds 31 consistent with the regulations federal law. A violation of the 32 Migratory Bird Treaty Act or its implementing regulations or 33 related state law a violation of a special condition set by the board 34 is a misdemeanor punishable by a fine of not less than fifty nor 35 more than one hundred dollars or thirty days’ imprisonment. 36 (B) If a person is convicted of one or more of the following 37 offenses, he must be fined not less than two hundred nor more than 38 five hundred dollars or imprisoned not more than ninety days In 39 addition, it is unlawful to: 40 (1) trespassing to hunt trespass while hunting waterfowl; 41 (2) hunting take or attempt to take waterfowl over bait;

1 [1203] 1 1 (3) shooting waterfowl over bait take or attempt to take 2 waterfowl more than fifteen minutes before or after regularly 3 designated hunting hours; 4 (4) hunting waterfowl more than fifteen minutes before or 5 after regularly designated hunting hours; 6 (5)(4) possessing possess more than one waterfowl over the 7 legal limit; 8 (6)(5) hunting hunt waterfowl out of season. 9 (C) A person who violates a provision of subsection (B) is 10 guilty of a misdemeanor and, upon conviction, must be fined not 11 less than two hundred dollars nor more than five hundred dollars 12 or imprisoned not more than thirty days for each offense. In 13 addition a person convicted of violating a provision of subsection 14 (B) must lose his hunting and fishing privileges for one year.” 15 16 SECTION 2. Section 50-21-135 of the 1976 Code, as last 17 amended by Act 181 of 1993, is further amended to read: 18 19 “Section 50-21-135. (A) There is established a no wake zone 20 on the Ashley River within one hundred yards of the Dolphin Cove 21 Marina in Charleston County. These boundaries must be marked 22 clearly with signs. The signs must be designed and installed as 23 specified by the department. 24 (B) There is established a no wake zone on that portion of 25 Adam’s Creek lying within three hundred fifty yards on each side 26 of the Rockville Marine Boat Yard on Wadmalaw Island. The 27 boundaries of this no wake zone must be marked clearly with signs 28 designed and installed as specified by the department.” 29 30 SECTION 3. This act takes effect upon approval by the 31 Governor. 32 ----XX----
