BY-LAW NUMBER 46-2007
A By-Law to Amend Township Of Albemarle By-Law No. 25-86, As Amended, Being the Zoning By-Law For the Former Township Of Albemarle, Now in The Town Of South Bruce Peninsula.
THE COUNCIL OF THE TOWN OF SOUTH BRUCE PENINSULA, PURSUANT TO SECTION 34, 36 & 41 OF THE PLANNING ACT, R.S.O. 1990 ENACTS AS FOLLOWS: 1. That Schedule ‘A’ to the Township of Albemarle Zoning By-Law No. 25-86 as amended, is hereby further amended by changing therein the zoning designation of 760 Highway #6; CON 3 EBR PT LOT 27 (Albemarle), Town of South Bruce Peninsula from “RU2 Restricted Rural and I-Institutional” to “C5-b Travel Trailer Park and Commercial Campground Special / EH - Environmental Hazard / RU2-Restricted Rural / RU2 – l Restricted Rural Special” as shown on Schedule ‘A’ attached hereto.
2. Notwithstanding their C5 zoning designation the lands delineated as C5-b on Schedule “A” to this By-law may be used in compliance with the C5 zoning provisions contained in this By-law excepting however that:
i) The permitted uses are limited to a private camp defined as: “A privately owned and operated establishment which operates throughout or part of the year for recreational, education or religious purposes, which provides accommodation for ten or more persons, or to any group or groups which contract accommodation for a period having a minimum duration of two days which includes campgrounds, facilities for serving meals and may or may not include bunkhouses or similar facilities, where a program is offered in conjunction with the provision of equipment or supplies or services related to angling, sailing, swimming, skiing, skating, snowshoeing or crafts, or similar indoor or outdoor recreational activities or any of them during all or part of the year, and may include education or conference facilities.”
3. Notwithstanding their RU2 zoning designation the lands delineated as RU2-l on Schedule “A” to this By-law may be used in compliance with the RU2 zoning provisions contained in this By-law excepting however that:
i) The permitted uses are limited to a paintball range defined as: “An outdoor facility used for the discharging of paintball guns for the purpose of target practice, simulative combative games, or similar competitions. Excluded from these facilities shall be general hunting and the unrestricted and nonrecurring discharging of firearms. ii) A maximum 20 space parking facility is permitted as an accessory to the paintball range. 4. Those lands described as 760 Highway #6; CON 3 EBR PT LOT 27 (Albemarle), Town of South Bruce Peninsula and shown on the attached Schedule ‘A’ are herby designated as a Site Plan Control Area referred to in Section 41 of the Planning Act, R.S.O. 1990, as amended.
5. And that this By-law shall come into force and effect on the final passing thereof by the Council of the Town of South Bruce Peninsula, subject to compliance with the provisions of the Planning Act, R.S.O. 1990, as amended.
