MEETING CALLED TO Board President Michael Crimmins called the Special Meeting ORDER of the Board of Education to order at 7:15 p.m.

PUBLIC HEARING CODE Board President Michael Crimmins asked for comments from OF CONDUCT REVISION the public regarding the revision in the Code of Conduct. Alex Shepard, Elmira Free Academy student representative, raised concerns he had with the changes made to the new dress code. Mr. Graham voiced his concerns also.
CONSENT ITEMS Mr. Graham asked that page 403 of the minutes from the June 15, 2004 Regular Meeting be changed to read “Barton Graham strongly criticized the Board on the timing of the extension of Mr. Gosden’s contract. He said that this was an unnecessary, confrontational tactic aimed at the three new members of the Board.”
Mr. Graham moved, seconded by Mr. Woods, to amend the minutes as noted above.

Bids That the Board accept the highest responsive, responsible bids for Used Vehicles and Buses for a grand total of $24,292.00 (tabulation in Clerk’s supplemental file for this meeting).
That the Board accept the lowest responsible bids meeting specifications from Sofco, Inc. of Big Flats, NY and Horwitz Supply of Horseheads, NY for Cafeteria Food Service Containers for the school year 2004-05 (tabulation in Clerk’s supplemental file for this meeting).
That the Board approve the lowest responsive, responsible bid meeting specifications in the amount of $35,440.00 and award contract for Purchase of Air Handling Units to Trane (tabulation in Clerk’s supplemental file for this meeting).
That the Board approve the lowest responsive, responsible bids meeting specifications in the total amount of $2,207,840.00 and award contracts for alterations at various district schools (tabulation in Clerk’s supplemental file for this meeting).
Donations That the Board accept the gift of $200.00 donated to Ernie Davis Middle School by SPTO for guitars and, furthermore, that the General Fund budgeted expenditures for 2004-05 be increased by $200.00 at budget code A2210-39-39-0500.
That the Board accept the gift of $1,000.00 donated to Elmira Free Academy by The Community Foundation of the Elmira- Corning Area, Inc. in conjunction with the Outstanding Educator Program and, furthermore, that the General Fund budgeted expenditures for 2004-05 be increased by $1,000.00 at budget code A2610-39-36-0525.
That the Board accept the gift of $250.00 donated to the Elmira City School District Special Education department by the Elmira Corning Verizon TelecomPioneers.
23 Reimbursements That the Board approve the receipt of reimbursements totaling $81.35 and that the 2003-04 General Fund expenditure code A2610-04-36-0460 be increased by $16.00, and that the 2003-04 General Fund expenditure code A2110-04-56-0500 be increased by $33,35, and that the 2003-04 General Fund expenditure code A2110-04-56-0500 be increased by $32.00.

The instruction of Individual Freedom and Law courses for the 2004-05 school year in the amount of $2,919 per section of the course, and furthermore authorizes the Superintendent of Schools to enter into an agreement for the institution of the course with officers designated by the Elmira City Police Department and the Chemung County Sheriff’s Department to teach them (Copy in Clerk’s supplemental file for this meeting.)

NEW BUSINESS Easement Mrs. Skidmore moved, seconded by Mr. Hurley, that the Board approve the easement request by NYSEG in consideration of their payment to the Elmira City School District of $1.00 for an 25 easement to install a new gas line on the Hendy Avenue Elementary School property.

Washington Floor Plans Mrs. Skidmore moved, seconded by Mrs. Long, that the Board approve the schematic design for the capital construction work to be undertaken at Washington Elementary School as presented at the June 15, 2004 Board of Education meeting and, authorizes the district’s architect to prepare the plans and specifications for said design for submittal to the New York State Education Department for approval and issuance of a building permit.

Change Orders EFA Mrs. Skidmore moved, seconded by Mrs. Mattoon, that the Board of Education approve the Elmira Free Academy Change order No. GC-040 in the amount of $10,803.00.

Broadway Elementary Mrs. Skidmore moved, seconded by Mr. Hurley, that the Board of Education approve the Broadway Elementary School Change Order No. E-035 in the amount of $21,712.03.

Pine City Elementary Mrs. Skidmore moved, seconded by Mrs. Long, that the Board of Education approve the Pine City Elementary School Change Order No. G-31 in the amount of $11,911.00.

Code of Conduct Mrs. Skidmore moved, seconded by Mrs. Long, that the Board approve a revision to the Elmira City School District Code of Conduct – Dress Code.

Mrs. Skidmore moved, seconded by Mrs. Long, to add the following under Prohibited Student Conduct: “Bullying, which includes any intimidating physical, verbal or psychological negative act against another carried out repeatedly over time.”

President Crimmins ruled the motion out of order.
Mr. Hurley appealed the ruling.
