ORDER OF AFFILIATION

BUTLER COUNTY EXECUTIVE ORDER # 2016-001

The purpose of this order is to outline the responsibilities and chain of command of the Butler County Fiscal Court, Butler County Emergency Management Director, and the Butler County Rescue Squad.

The Butler County Rescue Squad is the only officially recognized Land/Water Search and Rescue Squad in Butler County. By virtue of this order, they are officially affiliated with the Butler County Fiscal Court and the Butler County Emergency Management Agency and must comply with KRS Chapter 39F.

The County Judge Executive hereby grants the Butler County Rescue Squad the authority to operate in the county of Butler and places the Rescue Squad under the direction of the Butler County Emergency Management Director (KRS 39F.020).

In granting this authority to operate, it is recognized that all assets, property, funds, or interests acquired, donated, or raised for the benefit and/or the operation of the Butler County Rescue Squad shall and will be deemed the property of the County of Butler, or when acquired through state funds, the property of the Commonwealth of Kentucky.

The Butler County Fiscal Court shall be responsible for the fiscal accountability for all funds donated to the squad by the county. The Butler County Rescue Squad shall be responsible for all funds donated to the squad by outside resources. The treasurer of the Butler County Rescue Squad shall assure all payments of outstanding debts in a timely manner, accurate financial records be maintained, and proper documentation in the same. The Butler County Rescue Squad shall not charge for any of their services.

The Butler County Rescue Squad will be responsible of the management, inventory, and accountability of any and all assets listed above; however they may not acquire an interest in the same. An annual inventory will be submitted to the Butler County Emergency Management Director who in turn will submit that inventory to the State Emergency Management Agency.

In all county declared states of emergencies, the Butler County Rescue Squad will fall under the direction and control of the Butler County Emergency Management and/or the Butler County Judge/Executive. The rescue squad shall operate under their own chain of command during the state of emergency.

By-Laws of the Butler County Rescue Squad shall/will conform to applicable state and federal laws and regulations as defined in KRS 39F.020, and may not limit the authority of the County Judge Executive and/or the Butler County Emergency Management Director in the provision and management of the Butler County Rescue Squad services to the county. This affiliation agreement does not influence the organizational by-laws, standard operational Page 1 of 4 procedures/guidelines, or other powers of the Rescue Squad’s Incident Management/Command system, except during a declared emergency (City, County, State, or National).

The Butler County Fiscal Court will provide official license plates and insurance for all rescue vehicles. The Butler County Fiscal Court shall appropriate a yearly allocation in the county budget to cover cost of operational expense by the Butler County Rescue Squad.

The Butler County Rescue Squad shall serve the citizens of Butler County by providing fully trained and equipped personnel who will take the lead role in the following types of missions:

(1) Ground Search/Rescue and, (2) Rough Terrain Search/Rescue and, (3) Evacuate residents in emergency situations and, (4) Establish Evacuation Routes if needed and, (5) In bad weather place spotters when personnel is available and, (6) Water rescues/recovery’s and, (7) Swift Water rescues and or recoveries and, (8) Vehicle/Farm extrication and, (9) Confined Space Rescue operations and, (10) Traffic Control (when State resources are not needed or unavailable) and, (11) Urban Search status post any disaster and, (12) Post Incident Damage Assessment and, (13) Emergency Helicopter landing zone setup and, (14) Heavy Rescue Operations.

The Butler County Rescue Squad will respond and assist, but not take the lead role in, to other agencies and departments upon request with the following types of missions:

(1) Structure, Industrial, and Forestry fires and, (2) Electrical emergencies or recoveries and, (3) Assist all Butler County Volunteer Fire Departments with scene management and, (4) Assist coroner or his deputy in the recovery of corpse if not accessible by ambulance or hearse at their request and, (5) If personnel and equipment are available, may assist in heavy snow emergencies. I.e. transport of doctors, nurse, etc. to work, and/or to deliver critically needed medications and, (6) Assist with Emergency and/or Non-emergency communications and, (7) Activation and staffing of the Emergency Operations Center (EOC) and, (8) Cave or deep cave rescue operations and, (9) Trench Rescue and, (10) Emergency Shelter Setup during times of disasters or crisis.

The Butler County Rescue Squad will not respond to the following types of missions:

(1) Search for criminals and, Page 2 of 4 (2) Hazardous materials incidents in the hot zone and, (3) Rescue operations that deal in hostage situations and, (4) Chemical Weapons or Munitions accident and, (5) Nuclear or Biological incidents or accidents and, (6) Mine Rescues and, (7) Any rescue attempt or requests deemed “too dangerous” by the Butler County Search and Rescue Squad Officer in charge (OIC) and, (8) Any other specialized rescue operation not covered in this document for which the Butler County Rescue Squad is not equipped nor trained to accomplish.

The Butler County Rescue Squad may be called to respond by any of the following services or agencies:

(1) Butler County Judge/Executive (2) Butler County Emergency Management Agency Director (3) Butler County SAR Coordinator (4) Area 3 Kentucky Emergency Management Area Manager (5) State SAR Coordinator (6) Division of Emergency Management

The Morgantown/Butler County 911 dispatch center will “page out” the Butler County Search and Rescue Squad on any incident when any assistance is requested. If there is a question on the validity of the request, the dispatch center shall verify the request with the Chief or Assistant Chief of the Butler County Rescue Squad.

The responsibilities of all parties to this order of affiliation shall conform to those responsibilities as provided in KRS Chapter 39F.

This order of affiliation can be updated, modified, amended, or cancelled upon consent of the parties concerned. If a vacancy should occur in any of the positions on this order, the order will remain in effect for thirty days while the order is renegotiated.

The effective date of this order of affiliation shall be for one year. It shall remain in effect for one year from the signing date, at which time the order of affiliation may be renegotiated, updated, modified or cancelled.

This affiliation agreement was approved and adopted by the Butler County Fiscal Court
