Seniority Shall Be Established for Staff Within Each Tenure Area in Accordance with Education

Seniority shall be established for employees within each tenure area in accordance with NYS Education Law, Board of Regents Rules, and Commissioner of Education and judicial decisions. Circumstances such as interruptions in service, part-time service and long-term leaves shall be calculated in accordance with the laws in effect at the pertinent time. The Board of Regents Rule, §30(f) now provides:

“Seniority means length of service in designated tenure area, rather than length of service in the BOCES, such service need not have been consecutive but shall during each term for which seniority credit is sought, have constituted a substantial portion of the time of the professional educator.”

Reduction in Professional Staff Work Force

If it becomes necessary to reduce staff, individual employees will be retained based on the following criteria:

Certificated Employees:

1. length of actual full-time service within the tenure area; and

2. if such full-time service is equal, teachers’ respective appointment dates will be used.

Civil Service Employees:

1. seniority or retention standing is based upon an employee’s date of original appointment on a permanent, continuous basis in the classified service within Eastern Suffolk BOCES; classified service includes competitive, non-competitive, labor, and exempt classes; and

2. if such full time service is equal, an employee’s score on the respective Civil Service list shall be the deciding factor.
