The Special Meeting of the Governing Body of the Borough of Bloomingdale was held on the above date in the Council Chambers of the Municipal Building, 101 Hamburg Turnpike, Bloomingdale, NJ. Mayor Dunleavy called the meeting to order at 8:30 a.m.

PUBLIC NOTICE STATEMENT

Mayor Dunleavy stated that adequate notice of this meeting was posted in the Bloomingdale Municipal Building and provided to The Suburban Trends; The North Jersey Herald & News; and all other local news media on November 6, 2014.

PUBLIC COMMENT

At this time, Councilman Yazdi moved to open the meeting to Public Comment; seconded by Councilman Dellaripa and carried on voice vote.

Since there was no one who wished to speak during Public Comment, Councilman Dellaripa moved that it be closed; seconded by Councilman Yazdi and carried on voice vote.

SPECIAL BUSINESS:

Adoption of Resolution No. 2014-11.1: Transfers

Councilman Yazdi offered the following Resolution and moved for its adoption:

RESOLUTION - #2014-11.1 OF THE GOVERNING BODY OF THE BOROUGH OF BLOOMINGDALE

RESOLUTION RE: Authorizing the Transfer of 2014 Appropriations Reserves

WHEREAS, Title 40A:4-58 provides that should it become necessary during the last two months of the fiscal year to expend for any of the purposes specified in the budget an amount in excess of any respective sums appropriated therefore and there shall be an excess in any appropriation over and above the amount deemed to be necessary to fulfill the purpose of such appropriation, the Governing Body may by resolution setting forth the facts adopted by not less 2 than 2/3 vote of the full membership thereof, transfer the amount of such excess of those appropriations deemed to be insufficient; and

WHEREAS, the Governing Body further finds and declares that the Treasurer has determined that the following transfers are both necessary and appropriate; and

NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the Borough of Bloomingdale that the Borough Treasurer is hereby authorized to make the following transfers in the FY2014 Budget.

Councilman Dellaripa seconded the motion and it carried as per the following roll call: Council members: D’Amato; Dellaripa; Sondermeyer and Yazdi all YES. ABSENT: Council Members: Costa and Hudson (Excused)

Adoption of Resolution No. 2014-11.2: Authorizing paid leave to Bloomingdale DPW employee

Councilman Yazdi offered the following Resolution and moved for its adoption:

RESOLUTION #2014-11.2 OF THE GOVERNING BODY OF THE BOROUGH OF BLOOMINGDALE 3

Granting paid Leave to Bloomingdale DPW Employee James Mara

WHEREAS, the Governing Body (“Governing Body”) of the Borough of Bloomingdale (“Borough”) finds and declares that James Mara an employee of the Borough’s DPW Department; and

WHEREAS, the Governing Body further finds and declares that the Employee has been out of work on paid leave as of November 7, 2014; and

WHEREAS, the Governing Body further finds and declares that the Employee has sick leave days accrued that could be used for salary compensation during the duration of his paid leave;

NOW, THEREFORE, BE IT RESOLVED that the Governing Body of the Borough of Bloomingdale does hereby grant paid leave to Borough Employee James Mara during the period of November 7, 2014 until no later than January 5, 2015; and

BE IT FURTHER RESOLVED that the Municipal Clerk be and is hereby directed to formally notify the State Public Employees Retirement System of said status and to cause the same to be included in the records maintained for said employee.

Councilman Sondermeyer seconded the motion and it carried as per the following roll call: Council members: Dellaripa; Sondermeyer; Yazdi and D’Amato all YES. ABSENT: Council Members: Costa and Hudson (Excused)

Adoption of Resolution No. 2014-11.3: Agreement between the Borough of Bloomingdale and John’s Lawn Service

Councilman Yazdi offered the following resolution and moved for its adoption:

RESOLUTION #2014-11.3 OF THE GOVERNING BODY OF THE BOROUGH OF BLOOMINGDALE

Authorizing the execution of an agreement between the Borough of Bloomingdale and John’s Lawn Service

WHEREAS, the Borough of Bloomingdale had a need for repair of sidewalk at Knolls Road; and

WHEREAS, such services would not exceed the bid threshold and therefore did not require the solicitation of formal quotes, pursuant to N.J.S.A. 40A:11-3; and

WHEREAS, proposals were solicited for repair to sidewalk at Knolls Road for the Borough of Bloomingdale by the Mayor; and

WHEREAS, the Mayor reviewed the received quotes and recommended the award of a contract for the repair of sidewalk at Knolls Road to John’s Lawn Service; and

WHEREAS, the Treasurer of the Borough of Bloomingdale has certified that sufficient funds are available for this purpose.

NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Bloomingdale, County of Passaic, State of New Jersey, as follows:

1. The contract for repair of the sidewalk at Knolls Road is hereby awarded to John’s Lawn Service

2. The Mayor and the Borough Clerk are hereby authorized to execute an agreement with John’s Lawn Service for the repair of sidewalk at Knolls Road of the Borough of Bloomingdale in an amount not to exceed $18,000. 4

This Resolution shall take effect immediately.

Councilman Sondermeyer seconded the motion and it carried as per the following roll call: Council Members: Sondermeyer; Yazdi; D’Amato and Dellaripa all YES. ABSENT: Council Members: Costa and Hudson (Excused)

Adoption of Resolution No. 2014-11.4: Authorizing sale of vehicles on Gov Deals

Councilman Sondermeyer offered the following Resolution and moved for its adoption: RESOLUTION #2014-11.4 OF THE GOVERNING BODY OF THE BOROUGH OF BLOOMINGDALE

AUTHORIZING SALE BY ONLINE AUCTION OF BOROUGH VEHICLES

WHEREAS, the Borough of Bloomingdale has title to the following vehicles:

 2001 Ford E150 Van; white four-door; 111,357 miles - VIN #1FTRE14261HB44844

 2000 Ford Crown Victoria; white/Black four-door; 138,739 miles – VIN #2FAFP71W3YX179090

 1999 Dodge 3500 Mason Dump with salter in back; orange; 30,668 miles – VIN #3B6MF3663XM570289

 1997 Ford Crown Vic; white four-door; 59,358 miles- VIN #2FALP71W3VX193117

WHEREAS, the vehicles are of no useful life based upon their condition and the repairs needed and are no longer needed for public use; and

WHEREAS, the Borough wishes to dispose of the vehicles, which is municipal public property; and

WHEREAS, the Borough of Bloomindale desires to list the vehicles for sale at on an online auction hosted by GovDeals.com which sale is going to be conducted pursuant to Local Finance Notice 2008-9; and

WHEREAS, the terms and conditions of the agreement that will be entered into with the vendor are available on the vendor’s website and available in the Borough Clerk’s office.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Bloomingdale, in the County of Passaic and State of New Jersey, that the Mayor and Borough Clerk are hereby authorized to sell the above listed vehicles described above in an online auction hosted by GovDeals.com.

Councilman D’Amato seconded the motion and it carried as per the following roll call: Council Members: Yazdi; D’Amato; Dellaripa and Sondermeyer all YES. ABSENT: Council Members: Costa and Hudson (Excused)

AUTHORIZATION FOR EXECUTIVION SESSION

Councilman D’Amato offered the following Resolution and moved for its adoption:

MOTION FOR EXECUTIVE SESSION

BE IT RESOLVED by the Governing Body of the Borough of Bloomingdale on the 10th day of November 2014 that: 5

1. Prior to the conclusion of this Official Meeting , the Governing Body shall meet in Executive Session, from which the public shall be excluded, to discuss matters as permitted pursuant to N.J.S.A. 10:4-12, sub-section (s): ( ) a. ( ) Confidential or excluded matters, by express provision of Federal law or State statute or rule of court.

( ) b. ( ) A matter in which the release of information would impair a right to receive funds from the Government of the United States.

( ) c. ( ) Material the disclosure of which constitutes an unwarranted invasion of individual privacy.

( ) d. ( ) A collective bargaining agreement including negotiations.

( ) e. ( ) Purchase, lease or acquisition of real property, setting of banking rates or investment of public funds, where it could adversely affect the public interest if disclosed.

Councilman Yazdi seconded the motion and it carried on voice vote. ABSENT: Council Members: Costa and Hudson (Excused)

RECONVENED

Mayor Dunleavy reconvened the meeting at 9:11 a.m. and noted that no action was taken during the Executive Session.

ADJOURNMENT

Since there was no further business to be conducted during this Special Call, Councilman D’Amato moved to ADJOURN at 9:11 a.m.; seconded by Councilman Yazdi and carried on voice vote. ABSENT: Council Members: Costa and Hudson (Excused)
