RE: Notice of Payment Due for Late Filing of Campaign Treasurer’s Report, ______, July 1, 2011 – September 23, 2011 ( G1-32 nd Days Prior)

We are in receipt of your Campaign Treasurer's Report of Contributions and Expenditures (G1-32nd Day Prior), covering the period from July 1, 2011 through September 23, 2011, which was untimely received in this office on October 6, 2011. Said report was due September 30, 2011 and therefore is deemed to be six (6) days late.

Pursuant to Florida Statute 106.07(8)(b), the fine shall be $50 per day for the first 3 days late and, thereafter, $500 per day for each late day, not to exceed 25 percent of the total receipts or expenditures, whichever is greater, for the period covered by the late report.

You are hereby assessed a fine of $1,650.00. $1,650.00 dollars represents $50 dollars per day for the first 3 days and $500 per day for the remaining 3 days late. Said fine shall not be an allowable campaign expenditure and shall be paid only from personal funds of the candidate. Said fine must be paid to this office with a check payable to the City of Miami, within 20 days after receipt of this notice.

The Florida Elections Commission has the authority to waive this fine in whole or in part. For this to occur, you must, within 20 days after receipt this notice of payment due, request an appeal or dispute of a possible hearing before the Florida Elections Commission.

You are entitled to appeal or dispute the fine, based upon, but not limited to, unusual circumstances surrounding the failure to file on the designated due date. In doing so you must send notice to the Florida Elections Commission specifying the unusual circumstances surrounding the failure to file on the designated due date. This notice may be accompanied by any evidence supporting the claim. ______10/11/2011 Page 2

The Florida Elections Commission must consider the mitigating and aggravating circumstances contained in s. 106.265(1) when determining the amount of a fine, if any, to be waived.

Failure to timely file such a notice with the Florida Elections Commission constitutes a waiver of entitlement.

Additionally, if you also desire a hearing before the Florida Elections Commission, include a request for the hearing with your notice of appeal or dispute. If you are desirous of an appeal or hearing, please contact within 20 days of this notice:

If you do appeal or dispute the fine you must also notify me, the City Clerk of the City of Miami, in writing, within the same 20-day period of your intention to bring the matter before the Florida Elections Commission.
