Exclusive Brokerage Listing Agreement

This agreement made on the below date by and between Hutchinson’s Boat Works, Inc. of Alexandria Bay, NY (hereinafter called “HBW”) and the “Owner” whose signature appears below. Witnesseth: In consideration of the listing of the boat described below and of the efforts to be made to sell said boat, the undersigned Owner hereby employs and appoints HBW, it’s exclusive agent, to sell said boat at the price and on the terms listed. If a purchaser ready, willing and able to purchase said boat is secured by HBW during the term of this agreement, at a price and on terms herein granted, or at a price mutually agreed upon by the undersigned Owner and HBW, then the undersigned Owner agrees to pay HBW a commission equal to 10% of the selling price up to $100,000 and 8% of the selling price on the balance of selling price over $100,000. Minimum commission is $1000.00. Selling price is understood to include the value of any trade-in Owner agrees to accept. If a sale or exchange is made during the term of this agreement or within sixty (60) days after the expiration hereof, to any party with whom HBW has had contact regarding the boat involved in this agreement, then the undersigned Owner agrees to pay HBW the above stated commission. Only HBW signage shall be posted upon boat during the term of this listing. During the term of this agreement boat shall only be listed with HBW and no other broker. This agreement is unrelated to storage at HBW and dockage charges. If boat is kept at HBW while for sale, storage or dockage charges will apply. If HBW picks up a boat , cleans a boat or provide any other services or materials at the Owner’s request, additional charges will apply. Seller is responsible to have the boat ready for Sea Trial at Seller’s expense, including launching. No for sale by owner signs are permitted on HBW premises. Seller agrees to supply pictures of the boat or allow access for HBW to take pictures. Seller is expected to provide a complete list of options on the boat. Seller must supply copies of titles/documentation/registration.
