COMMISSION DELEGATED REGULATION (EU) 2016/364 of 1 July 2015 on the classification of the reaction to fire performance of construction products

This document redefine class F. It will no longer mean NPD but the lowest performance. It is implicit that you can declare class F only if you have test results for it.

1.1.2 Annex 3 – DoP model

This document allows flexibility to the development of DoP but clear rules on how to fill the document.

2 1.1.3 Annex 5 – AVCP tasks

COMMISSION DELEGATED REGULATION (EU) No 568/2014 of 18 February 2014 amending Annex 5 of the CPR regulation concerning the assessment and verification of consistency of performance of construction products (AVCP)

This document clarifies the tasks of manufacturers and notified bodies as regards assessment and verification of consistency of performance.

1.1.4 E-supply of a DoP

COMMISSION DELEGATED REGULATION (EU) No 157/2014 of 30 October 2013 on e-supply of a Declaration of Performance (DoP)

This documents indicates the conditions for making a DoP on construction products available on a website. The manufactures have to ensure that

◥ The content of a DoP is not altered after it has been made available on the website

◥ The website is monitored and maintained so that the DoP is continuously available

◥ The DoP can be accessed by the recipients of construction products free of charge for a period of 10 years after the product has been placed on the market

◥ Information is provided to the recipients on how to access the website

◥ Every single product, or batch of the same product, they are placing on the market is linked to a given DoP by means of the unique identification code of the product-type

1.2 CWT- CWFT DELEGATED ACTS

1.2.1 Metal lath and beads for internal plastering, external rendering and feature profiles

COMMISSION DELEGATED REGULATION (EU) No 1293/2014 of 17 July 2014 on the conditions for classification, without testing, of metal lath and beads for internal plastering covered by the harmonised standard EN 13658-1, metal lath and beads for external rendering covered by the harmonised standard EN 13658-2 and metal beads and feature profiles covered by the harmonised standard EN 14353, with regard to their reaction to fire.

Those products are deemed to satisfy class E of performance for reaction to fire (set out in Table 1 of the Annex to Decision 2000/147/EC), without testing, where they have an exposed surface containing organic material.

COMMISSION DELEGATED REGULATION (EU) No 1292/2014 of 17 July 2014 on the conditions for classification, without testing, of certain uncoated wood floorings under EN 14342 with regard to their reaction to fire.

If those products fulfil the conditions set out in the Annex, no further testing is required.

1.2.3 Wood-based panels and solid wood panelling and cladding

COMMISSION DELEGATED REGULATION (EU) No 1291/2014 of 16 July 2014 on the conditions for classification, without testing, of wood-based panels under EN 13986 and solid wood panelling and cladding under EN 14915 with regard to their fire protection ability, when used for wall and ceiling covering.

3 If those products fulfil the conditions set out in the Annex, no further testing is required.

1.3 AVCP DELEGATED ACTS

1.3.1 Ventilation ducts and pipes for air ventilation

COMMISSION DELEGATED DECISION (EU) 2015/1936 of 8 July 2015 on the applicable systems to assess and verify constancy of performance of ventilation ducts and pipes for air ventilation.

This Decision applies to ventilation ducts and pipes intended to be used in construction works for air ventilation (does not apply to ducts and pipes used for fixed fire-fighting system).

AVCP for all essential characteristics except for reaction to fire is 1.

For reaction to fire only:

AVCP Products for which a clearly identifiable stage in the production process results in an 1 improvement of their reaction to fire performance (e.g. an addition of fire retardants or a limiting of organic material) Products for which an applicable European legal base exists to classify their reaction 4 of fire performance without testing Products not belonging to the subfamilies indicated in rows 1 and 2 3

1.3.2 Geosynthetics and related products

COMMISSION DELEGATED DECISION (EU) 2015/1958 of 1 July 2015 on the applicable systems to assess and verify constancy of performance of geosynthetics and related products.

Products covered:

◥ Geosynthetics (membranes and textiles) used for separation, protection, drainage, filtration, or soil reinforcement.

◥ Geocomposites used for separation, protection, drainage, filtration, or soil reinforcement.

◥ Geogrids used for separation, protection, drainage, filtration, or soil reinforcement.

◥ Geomembranes used for separation, protection, drainage, filtration, or soil reinforcement.

◥ Geonets used for separation, protection, drainage, filtration, or soil reinforcement.

4 Reports

4.1 REPORT ON DANGEROUS SUBSTANCES

REPORT FROM THE COMMISSION TO THE EUROPEAN PARLIAMENT AND THE COUNCIL as foreseen in Article 67(1) of Regulation (EU) 305/2011

The European Parliament introduced this article in the regulation to get more information on how the CPR was implemented as regards dangerous substances, in particular considering the content of dangerous substances in construction products.

The main headlines of the report are the following:

◥ Products that are substances or mixtures under REACH and belong to a specific subset of substances (hazardous, persistent, SVHC… – see art.31 REACH) must be accompanied by a Safety Data Sheet.

◥ For products that are articles, only information to allow safe use (at min., SVHC present in a concentration above 0.1% in weight – see art.33 REACH).

◥ Safety Data Sheets or information covered by art.33 must be provided together with the DoP and in all steps of the supply chain till the final end user (see art.66 (5) CPR).

◥ The Commission considered that the specific needs for information on the content of hazardous substances in construction products, are sufficiently addressed by the current provisions of the CPR (see art.4 and 6 (5)).

REPORT FROM THE COMMISSION TO THE EUROPEAN PARLIAMENT AND THE COUNCIL on the exercise of the power to adopt delegated acts conferred on the Commission pursuant to Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 2011 on the harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC

This report provides information on the delegated and implemented acts published or under preparation during the first years of implementation of the CPR.
