GENERAL TERMS AND CONDITIONS FOR THE SALE AND USE OF SKI LIFT TICKETS REMOTE SALE OF FIXED PRICES

 General Points

The terms and conditions apply to all ski lift tickets providing access to the ski area of Sainte Foy (hereafter called The Ski Area). Dates of opening and closure of the Ski lifts are given as a rough guide onto posters in cash desks and onto web site: www.saintefoy.net

If one provision of these terms and conditions was to fail, it would be considered as being governed by practices in force in the ski lift sector and for companies with their registered office in France.

The acquisition of a ski lift ticket (hereafter called the Ticket) implies the understanding and acceptance of all these terms and conditions of sale and use, without prejudicing the standard avenues of redress.

The Ticket has a determined area of validity, duration, category and is only valid for the ski lift operator area in which it was issued. The prices are displayed at the lift operator ticket offices. Infomation is also found on www.saintefoy.net.

Every Ticket is stictly for personal use, and is neither refundable nor transferable.

Fixed prices pluri daily (2 days and more) concern consecutive days.

 Holder’s Photograph

All Tickets valid for three or more days are issued with a recent identity photo, full face without sunglasses or headgear. This is to be provided by the future ticket holder.

 Ticket Validity

The ticket gives its holder the right to circulate freely on any of the ski lifts in the skiing area for which it has been issued and during its period of validity, without any sort of priority. The valid sectors of the ticket are defined on the winter slope plan in question and during ski lift opening hours as displayed at the ticket offices, subject to weather conditions and snow coverage. In order to present Tickets to the lift operators at the departure and arrival points of each lift, the Ticket holder must keep the Ticket on them throughout the period of validity.

 Fraud – Absence or Non-Conformity of Ticket – Compliance with Police Regulations

Any person without a Ticket or whose Ticket is irregular concerning the ski area in question, will be liable to prosecution and compensation as listed below. The same will apply to those who fail to comply with the police regulations displayed at the ski lift departure points.

The operator’s authorised agents will note these breaches which, depending on circumstances, will give rise to : - Payment of a lump sum compensation, equal to FIVE times the value of a one day Ticket offered by the lift operator in question. (Articles L 342-15, R 342-19 et R 342-20 « code du tourisme ») - Legal Prosecution

In addition to the lump sum compensation or prosecution stated above, the operator’s agents have the right to immediately withdraw any named or personalised Tickets (name, price reduction, photo, etc.) that does not correspond to its user.

 Ticket Prices

Public prices for Tickets are displayed the operators Ticket office. They are also found in the Tourist Office and in leaflets of the resort in question.

The age of the holder will be determined as his age on the day Ticket being issued becomes valid.

 Reductions on Ticket prices

Reductions on Ticket prices will only be issued upon presentation at the Ticket office, the justification of the reduction in question or the sending of documents (photocopy of passport or identity cards). No reductions will be made after the purchase of the Ticket. The student price rate is applied on production of the student card (after the high school: B.T.S, university).

 Payment Methods This payment is made in cashdesk either by check pulled at a bank account opened in France, emitted in the order of the developer, or in cash there Euros, or by bank card (except card American Express) or by holiday vouchers emitted (by the ANCV (on which no depiction of change will be made).

 Ticket Loss or Theft

Any Ticket that has been stolen or lost should be reported and a form filled out as soon as possible at the operators Ticket office. Should the holder want to ski the same day as the declaration, another ticket must be bought.

For Tickets equal to or above two days there are two options :

 Either the holder has bought a « Carre Neige » in which case if the Ticket is found the Operator will reimburse the price of the new Ticket bought or in certain cases it the assurance themselves which reimburse the holder. (See details of assurance)  Or the holder hasn’t bought this assurance and must therefore buy a new Ticket and see with their own assurance.

The found ski passes are to be to be deposited in Cash desks (Phone.: 04 79 06 95 15)

 Reimbursement

Any Ticket issued which has not been used or partially used will not be reimbursed nor exchanged regardless of reason – Illness, accident or any other personal reason and regardless of the validity of the Ticket. The lack of snow does not constitute a case of absolute necessity justifying the repayment of the Ticket Ticket holder must enquire with specialised insurance companies for details on this subject.

 Interruption of Ski Lift Operation

A total stoppage of more than one day of the totality of the Ski Lifts of Sainte Foy will be the only circumstances giving rise to compensation for the loss suffered by the Ticket holder. The Ticket holder must complete the form available at the Operators office before any compensation is considered. Only Tickets bought directly at the Operators office are eligable for compensation.

The customer can benefit: - Or of an immediate continuation - Or of credit note in the day (s) of ski to use at the latest at the end of the 3rd winter season according to the one in conformance with which the compensation is granted.  Compliance with Safety Rules

All Ticket holder must comply with the safety rules of the ski lift operators, espacially the police regulations at the departure points, the pictograms illustrating them and any instructions given by the operator’s staff. The same applies with the municiple order on the safety of the ski slopes. The holder is adviced to take account of the « 10 Rules of Conduct for Slopes Users » published by the International Ski Federation (ISF). The off-piste skiing is practised by the holder of the Ticket at its risks and dangers

 Interllectual Property

All brands, models and graphics shown on various Tickets, posters and prices are registered and all reproduction is strictly forbidden.

 Complaints

« Any complaint must be sent to the State control over the Ski lifts of Sainte Foy within 3 days after the delivery of fixed prices.The holder is anxious to verify quickly fixed prices otherwise, beyond this deadline, he will take the cancellations at his expense ».

 Applicable law regulation of the disputes

« It is expressly agreed that the French version of the present CGVU is the only one to be valid ». « Consequently, in case of difficulty of interpretation/application of the one some of measures, of the present CGVU, i twill be advisable to refer exclusively to the French version ». « The present CGVU is both subjected for their interpretation and their implementation, in the French Law ». « For lack of amicable settlement, only the administrative Court of Grenoble will be competent ».
