The HEAD, Eastern Regional Station of National Dairy Research Institue, Kalyani, Nadia W.B. on behalf of I.C.A.R., D.A.R.E. , Min. of Agriculture, Govt. of India invites tenders from the reputed and eligible contractors/firms having valid labour contract licence for Sl. No. 1 & 2 and valid electrical licence for sl. No. 3 with EPF and ESI registration certificate for carrying out the following works on work contract basis.

1. Job work contract for providing security arrangement at this Institute. 2. Job work contract for Sweeping, Cleaning work at this Institute. 3. Job contract for repairing/maintenance work of electric system.

Terms and conditions:

1. A complete set of tender documents in English may be purchased by interested eligible contractors/firms after the submission of written application to the Head, ERS of NDRI, Kalyani against payment of Rs. 200/- ( Two hundred only which is non-refundable) each for Sl. No. 1 and Rs.100/- each for sl. No. 2 & 3 to the Cashier . 2. No tender will be considered without EMD. The eligible contractors/firms may also download the same from the website of NDRI (www.ndri.res.in), in which case, they also need to pay the cost of Tender Form by DD in favour of ERS of NDRI payable at S.B. I, Kalyani or cash for each tender form before submitting the tender documents. 3. An earnest money of Rs. 50,000/- ( Rupees Fifty thousand ) only may be deposited in the form of demand draft / pay order in favour of ERS of NDRI, payable at SBI, Kalyani or any nalionlized bank at kalyani. The particulars of the earnest money deposited must also be superscribed on the top of the envelope by indicating draft/pay order number and date, failing which the tenders will not be opened .and tender will not be considered, if earnest money is not deposited with the tender. 3. The tenderer is being permitted to give tenders in consideration of the stipulations on his part that after submitting his tenders, he will not resile from his offer or modify the terms and conditions thereof. If the tenderer fail to observe and comply with the foregoing stipulation the aforesaid amount of EMD will be forfeited by the Institute. In the event of the offer made by the tenderer not being accepted, the amount of earnest money deposited by the tenderer will be refunded to him after he has applied for the same, in the manner prescribed by the Institute. 4. The Schedules of the tender form should be returned intact and pages should not be detached. In the event of the space provided on the schedule form being insufficient for the required purpose, additional pages may be added. Each additional page must be numbered consecutively and be signed in full by the tenderer. In such cases reference to the additional pages must be made in the tender form. If any modification of the schedule is considered necessary it should be communicated by means of a separate letter alongwith the tender. Overwriting/erasing in rates to be quoted by the tenderer will not be allowed otherwise the tender may be rejected. 5. The tenders are liable to be ignored if complete information as required is not given therein or if the particular asked for in the schedules to the tenders is not fully filled in. Individual signing the tenders or other documents connected with the contract may specify whether he signs it in the capacity of ( i) a sole proprietor of the firm or constituted attorney of such sole proprietor, or ( ii) a partner of the firm if it be partnership in which case he must have authority to refer to arbitration dispute concerning the business of the partnership whether by virtue of the partnership agreement or power of attorney or ( iii) constituted attorney of the firm if it is a company. 6.If tenderer does not accept the offer, after issue of letter of award by Institute within 15 days , the offer made, shall be deemed to be withdrawn without any notice & earnest money forfeited. 7. In case of partnership firms , where no authority has been given to any partner to execute the contract/agreement concerning the business of the partnership, the tenders and all other related documents must be signed by every partner of the firm. A person signing the tender form or any other document forming part of the contract on behalf of another shall be deemed to warranty that he has authority to bind such other and if , on enquiry appears that the persons so signing had no authority to do so, the Council/Institute shall without prejudice to other civil and criminal remedies cancel the contract and hold the signatory liable for all costs and damages. Each page of the tender and the schedules of the tender and annexure, if any, should be signed by the tenderer.

The technical bid and the financial bid should be sealed by the bidder in separate covers duly superscribed and both these sealed covers should be put in a bigger cover which should also be sealed and duly superscribed. The Technical bid will be opened by the committee at first instance as per fixed schedule and these will be evaluated by the competent committee from tendered specification point of view. At the second stage, financial bids of only the techn ically acceptable offers/bids will be opened as per fixed schedule for further evaluation and ranking before awarding the contract. The Institute is not bound to accept the lowest or any other tenders and also reserve to itself the right of accepting the tender in whole or in part. You are however at liberty to Tenders for the whole or any portion or to state in the tenders that the rates quoted shall apply only if the tenders are considered fully. Other conditional Tenders will not be accepted. 10. An amount at a rate of 5% of total contract value ( Rs. In figures) (Rs. In words) as a security deposit for the contract is to be deposited by the selected agency/successful tenderer only after receiving a communication from the Institute. In the event of non-deposition of the same the earnest money will be forfeited. 11.No interest on security deposit and earnest money deposit shall be paid by the Institute to the tenderer. 12. Necessary Income Tax will be deducted as per Govt. rules. 13.The HEAD , ERS of NDRI, Kalyani reserves the right to reduce or terminate the period of contract or to extend its duration in the interest of the Institute, for any justifiable reasons, not mandatory to be communicated to the tenderer. 14. Decision of the HEAD, ERS shall be final for any aspect of the contract and binding to parties, disputes arising if any on the contract will be settled at his /her level by consultation and in case of failure of settlement dispute shall be referred to the arbitrator to be appointed by the Director, Institute. The decision of the sole Arbitrator appointed shall be final and binding on the parties. Arbitration proceedings shall be governed by the Arbitration & Constittution Act, 1996. 15. Successful Tenderer will have to enter into a detailed contract agreement with on non-judicial stamp paper of Rs.100/- ( Rs_One hundred only ) for each work. The following documents/vouchers are required to be enclosed with the Tender which are the terms and conditions of the quotation’s documents. i) For Security job/work contract PSRA Licence ( Private Security Agency ACT) should be required mandatory. ii) Labour licence also required in the Tender document. iii) Minimum turnover of the firm not less than Rs. 10,00,000.00/ year . iv) Last three years continuous experience of the firm in the field of providing such services in Central Govt. establishments/Autonomous bodies of Govt. of India/Corporations of Govt. of India/reputed public or private organization provide the details in enclosed form. v) Duly certified copies of the satisfactory services where the Tender is providing services for the lost three years. vi) Valid Employee EPF registration certificate issued by local Govt. etc. vii) Valid Employee ESI registration certificate issued by local Govt. viii) Copy to Service Tax Payment Registration / Licence.

1. The Security Guard should follow strict attendance and alternative arrangements are to be made by the agency whenever anyone of staff is to go on leave /rest under intimation to this office. 2. Changing of staff should be intimated to In-charge, Security Section, NDRI, Kalyani. 3. The staff provided should also maintain secrecy and discipline in the premises of Institute. 4. The staff provided should be capable of reading and writing in English with a minimum qualification of Middle Standard. 5. The contractor shall keep a complaint register and it shall be open to verification by the authorized officer of NDRI for the purpose. All complaints should be immediately attended to by the Agency. 6. The security Guards on duty must be in complete uniform ( cap, belt whistle, name badge, shoes & identity Card etc.) with colour specifications and pattern approved by NDRI should be supplied by the contractor alongwith Lathi, Torch light for night shift, Cycle/Bike for patrolling duty etc. at his own cost. 7. The agreement is terminable with one month notice on either side. 8. The contractor shall not sublet the work without prior written permission of the NDRI, Kalyani. 9. The contractor or his workers shall not misuse the premises allotted to them for any purpose other than for which the contract is awarded. 10. The selected agency shall provide the necessary personnels at NDRI, Kalyani as pr labour acts prevalent in Central. The agency shall employ good experienced and reliable persons with robust health of age group of 21 to 50 years . In case any of the personnel so provided is not found suitable by the NDRI, the NDRI, shall have the right to ask for his replacement without giving any reason thereof and the agency shall on receipt of a written communication will have to replace such persons immediately. No security guard will perform double duty/shift. 11. The persons so provided by the agency under this contract will not be the employee of the NDRI and there will be no employer-employee relationship between the NDRI, and the person so engaged by the contractor in the aforesaid services. 12. Payment for service contract will be made monthly upon submission of pre-receipted bill.

Contd.. P/10 10 13. The rate to be quoted should include cost of each and every item including transportation cost, manpower cost including all. State/Central taxes etc. also. The Institute shall not bear any extra charge on any account whatsoever i.e. EPF contribution, ESI contribution, Bonus , Uniform, Liveries, OTA etc.

14. The contractor will discharge all his legal obligations in respect of the workers to be deployed by him for the execution of the work in respect of their wages (strictly as per minimum wages) and service conditions and shall also comply all the rules and regulations and provisions of law in force that may be applicable to them from time to time. The contractor shall indemnify and keep indemnified the NDRI from any claims, loss or damages that may be caused to it on account of any failure to comply with the obligations under various laws. In case of any dispute, the decision of HEAD, ERS shall be final and binding on the contractor. 15. Income Tax will be deducted from the payments due for the work done as per rule. 16. They should not leave their points unless and until the reliever comes for shift duties and will maintain all the registers, which are kept at concerned section.

17. The contractor must employ Ex-servicemen only. 18. The contract is subject to the condition that the tenderer will comply all the laws and acts of Central Govt. State Govt. relating to this contract made applicable from time to time. 19. Payment of the wages to the security guards deployed by the Agency will be made through Account Payee cheques and copy of payment sheed duly signed by the guards and verified by the agency should be made available to In- charge, Security section every month before verifying the monthly bill. 20. The security agency shall be responsible for all/any loss whatsoever including on account of theft and mishandling etc. In case, institute sustain any loss on account of theft etc. the same will be intimated to the agency and the amount thereof, as decided by the institute, will be recovered from the agency from their bill(s) /performance security with the approval of the competent authority. 21. Risk Clause: ERS of NDRI reserves the right to discontinue the service at any time, if the services are found unsatisfactory by giving a show-cause to be replied within a week and also has the right to award the contract to any other agency at the risk and cost of current agency and excess expenditure incurred on account of this can be recovered from performance security or pending bills or by rising a separate claim.

22. The HEAD, ERS of NDRI, Kalyani reserves the right to reject any or all quotations in whole or in part without assigning any reason . Therefore.,the decision of HEAD, ERS of NDRI, Kalyani shall be final and binding on the contractor/agency in respect of clause covered under the contract. Contd… P/11

---11 -- GENERAL INFORMATION & OTHER TERMS & CONDITIONS OF THE CONTRACT FOR Watch and ward security services at ERS of NDRI, Kalyani, Nadia ( W.B).

TERMS & CONDITIONS: 1.Consolidated rate for entire work of security services as per specifications , terms & conditions should be provided on monthly basis including payment of wages to the workers, ESI, EPF Bonus payment etc. with respect to the workers payment of service tax, service charges as applicable. 2.The persons so provided by the agency under this contract will not be the employee of the Institute and there will be no employer-employee relationship between the Institute/Council and the person so engaged by the contractor in the aforesaid services.

3.The security guards to be deployed must be Ex-serviceman (Army, Navy, Air- force, CISF, BSF, Paramilitary Force, ITBP) with proper concerned service documents to be submitted to ERS . They should be of sound health and clean record, preferably below 50 years of age. 4.The watch & ward duty will be round the clock and 7days of the week of the Institute premises including total farm area of 100 acres all office buildings, laboratory complex, cattle sheds and forage,estate buildings, all residential quarter areas, guest house, students hostel, farmers’ hostel, seed godown, deep tube well house, main gate and south gate area electric motor room, plantation crops in the field including fruit plantation and other tree plantation, agromet observatory etc.

5.Deployment of requisite number of security guards at the specified duty post/area (24 hrs.) must always be maintained. No shortfall/absence of any guard at any duty post will be accepted. 6.All the personnel deployed will perform their duty in proper uniform and will maintain a smart turnout. The agency, shall at its own cost, provide suitable uniform to the personnel with identity cards. If any guard is found on duty without uniform a penalty of Rs. 500/- only for each such incidence per guards will be levied for deduction from the bill of the contractor.

7.The security services shall have to be provided for the entire campus (nearly 100 acres) with office buildings, sectional offices, staff quarters, garages, cattle sheds with animals, fodder fields, chaff cutter, feed milling plant, Agromet Observatory, deep tube-well and all govt. properties, guest house, student hostels in the premises. 8.All essential items for security services like Torch , Lathi, Gumboot, Mosquito Coil, Register, Pens, Paper, etc. at the main gate, Bicycles(if required), are to be provided by the Agency. ----- 12 ------10. It will be the duty of the security Agency, to keep the entire ERS-campus free of stray dogs. 11. The security guard should ensure that proper gate pass has been issued by the competent officer for the items taken out of the campus. In case of any doubts, they should immediately contact the authorized officer of security. 12. They should maintain a Visitors register at the main gate and should enter the name, address of the visitor after proper verifying/ checking his identity. All materials, vehicles including private cars are to be cheeked and entered in the register and then only be allowed to enter into the campus. It is the duty of the security agency, to keep the campus free from any type of trespassers and un- authorized persons. One register will be maintained by the security agency for recording Institute vehicle movement ( in/out) with date and time. 13. They should inspect the office buildings, Cattle sheds, Boundary wall other structures erected so, trees, electric poles etc. on regular basis. If any damage is done to those due to natural calamity (storm, heavy rainfall etc.) it should be brought to notice of the competent authority immediately. 14. Any loss, theft, or damage to the Govt. property, Farm animals, Farm Fodder, property of the employees including those who are residing in the staff quarters, students, trainees etc. shall be compensated by the agency if the cause of such loss theft or damage is found on account of default negligence and/ or lapse of the employees of the Agency, at the sole discretion of the Institute and will be binding on the contractor. 15.The security guard provided should maintain secrecy and discipline in the premises of the institute. 16.The security staff provided should be capable of reading and writing Hindi and English (Desirable qualification middle standard) preferably. 17.The contractor shall not sublet work. 18. After physical inspection of the institute campus thoroughly requirements of personnel ( for the providing watch and ward security services on job contract basis at the Institute campus) shall have to be furnished along with the tender. Description of security points and point wise work specifications are enclosed separately vide page No. 17 . Adeuate relieving security guards shall also have to be provided so that security guards remains deployed in all 04 security points in three shifts ( round the clock) in case of weekly rest /leave/other exigency of the regular security guards. 19. I t is the overall responsibility of security agency to keep proper watch/vigil on his deployed guards at this Institute to make the security arrangements totally full proof. The security agency will maintain necessary records of guard turn out and make liaison with the In-charge security/office as well as local police authority, in case of emergency. A detailed break up of rate quoted regarding payment of wages, service charge, ESI, EPF payment , service tax etc. should be provided separately with the tender document. However, the tenders should indicate only the lump sum amount on monthly basis in respect of all the services covered under this job contract in specified column for quoting rates and rates should not be proposed on the basis of manpower to be deployed under the contract . No request for alteration in the rates once quoted will be permitted within one year. 19.The Head, ERS NDRI Kalyani reserves the right to reject any or all quotations/tenders in whole or in part without assigning any reason. Therefore the decision of the Head shall be final and binding on the contractor/Agency in respect of clauses covered under the contract. Contd….. P/13

20.Payment of service contract will be made upon submission of signed bill in triplicate. Acquaintance roll of engaged security person along with details of EPF, ESI contribution deposit challan should be provided to the office positively by 5th of the next month for enabling payment of the bill amount for the previous month. The contractor will have to make payment to the workers by A/c payee cheque for every month latest by 5th of the next month.

21.The contract is subject to the condition that the Agency will comply with all the laws and acts of central Govt./State Govt. (regarding minimum wages and other conditions including ESI/EPF ) relating to this contract made applicable time to time. The payment to the contractor should be made following the minimum wages of Govt. of India/ Govt. west Bengal whichever is higher during the contract period.

22.The security duty will be carried out 24 hr. a day in three shifts that is Morning shift -6.00am to 2.00pm., Evening shift -2.00 pm to 10.00 pm and Night shift - 10.00 pm to 6.00 am. Security personnel should not leave their duty points unless and until the reliever comes and resumes his shift duty.

24.Any misconduct /misbehavior on the part of the manpower deployed by the Agency will not be tolerated and such persons will have to be replaced immediately.

25.The contractor shall be responsible for the faithful compliance of the work, offered so. Any breach or failure to perform the same may result in termination of the work order and the security deposit will be forfeited.

26.An amount equivalent to two days contract amount subject to minimum of Rs. 5000/- will be levied as liquidated damages per day. Wherever and whenever it is found that the work is not up to mark at any point, it will be brought to the notice of the Agency and if no action is taken within one hour, liquidated damage clause will be invoked.

27. If there is any irregularity, slackness found on the part of the guards of the agency while performing duty during the contract, the sufficient penalty in monetary value as described by a duly constituted committee, subject to maximum 10% of the contract value, will be imposed and deducted from the payment to the contractor due for the month. Thereafter, contract can be terminated by the Head, ERS of NDRI, Kalyani, whose decision shall be final and binding on the security agency. 28.Service/Income tax will be deducted from the payment due for the work done as per rule. 29. Commercial/Financial bid of only those Agency will be opened who qualify in technical bid. 30. The Agency should have valid Licence under PSRA ( Private Security Licence Act 2005) and necessary proof to be submitted along with tender documents, otherwise the tender will not be considered. 31.The Head, ERS, NDRI, Kalyani reserves the right to discontinue the service of the security Agency at any time if works are found unsatisfactory by giving a showcase notice to be replied within a week and also has the right to award the contract to any other Agency at the risk and cost of current Agency and excess expenditure incurred on account of this, can be recovered from the security deposit money or pending bills or by raising a separate claim. 32.The guard/Agency should contact the local police station in case of any emergeny in security related matter beyond office hours and also intimate the office authorities as early as possible. 33.They should provide extra security coverage during visit of VIP’s (DG, Director, Other Dignitaries) and while conducting Animal Auction in the Institute campus without payment of any additional charges besides the regular rate quoted by the Agency & accepted by the Institute. 34.Incharge, security , ERS of NDRI, will have overall controlling power for running effective work contract in relation to the above watch and ward security contract. 35.As part of the watch & ward duty the security guard will also check locking of doors, windows of office, laboratory complex, cattle yard, forage office and farm area, estate campus etc. and inform any irregularity noticed to the In-charge, Security and if there is any electric fault at any part inside the Institute premises beyond the normal office hours , necessary intimation to be provided to the representative of the Estate Section/Electric department for rectification of the same as per procedure. 36. No security guard will be allowed to perform duty in two consecutive shifts i.e. without giving proper break for rest purpose.

37. The agency /contractor should provide photographs, complete identity proofs, address details with phone number, antecedent clearance by police for all security guards, supervisors engaged for the job after award of contract and before initiation of work. At the time of deployment of security personnel, the Institute will verify all such records. All the guards on duty should bear proper identity card(s) clearly visible from outside.

38. Notwithstanding anything contained in the terms & conditions as mentioned, it is expressly understood that the Institute at its sole discretion may terminate the security contract without assigning any reason thereof.

39.No guard can be changed without approval of the In-charge, Security Section, failing which suitable penalty will be imposed.

40. No security point should be left unmanned/un-guarded, on any circumstances. In case, any guard of the agency wants to take any type of leave, suitable reliever in liew of him should be provided before his departure on leave.

41. The selected contractor will have to deposit performance security of appropriate amount and also execute an agreement in Non-Judicial stamp paper of appropriate value before starting of work.

42. Initially the work contract will be awarded for one calendar year ( 365 days) , the period of which may be decreased/increased depending upon the performance of the agency at the sole discretion of the Institute. In case, the security agency wishes to withdraw their services, they should have to serve a prior notice at least 60 days in advance from the proposed date of withdrawal of services for making alternative arrangement by the Institute. However, the performance security amount will be forfeited if the contractor wishes to discontinue during the initial contract period.

43. The successful bidder will have to response to the work order communicated to him through phone/mail/letter/fax etc. by the Institute through deposition of performance security amount within 10 days of issue of communication of the time specified by the Institute. In the event of non-compliance by the contractor without any valid reason the work order will be terminated and the EMD amount deposited will be forfeited at the sole discretion of the Institute.

44. The Institute is not liable to make any compensation for any loss/damage/death inflicted on the workers engaged by the contractor for performing security services as per specifications and terms & conditions.

45. The agency/contractor will have to maintain necessary records/registers of muster roll, wages, bonus payment, deduction of ESI , EPF etc. made for guards in specific format as per instruction of Min. of labours, Govt. of India, for production before the competent authorities on demand for verification and further necessary action. Also, the agency should submit a declaration with every bill preferred for payment regarding compliance of aforesaid instructions including copies of challan for deposition of ESI, EPF payment.

46. The contractor will discharge all his legal obligations in respect of Security personnel to be employed/deployed by him for the execution of the work in respect of their wages and service conditions and shall also comply with all the rules and regulations and provisions of law in force that may be applicable to them from time to time. The contractor shall indemnify and keep indemnified the Council from any claim, loss or damages that may be caused to it on account of any failure to comply with the obligations under various laws. In case of any dispute, the decision of Secretary, ICAR shall be final and binding on the contractor.

47. Usally the minimum wages of the workers get revised twice a year and the contractor shall be liable to make payment to the workers at the revised rate as applicable time to time including payment & deduction with respect to ESI, EPF etc. of the concerned workers on the basis of the revised minimum wages. Howerver, the contractor will not get any additional payment on this account, excepting the amount as per his quoted & accepted rate by the Institute for the entire contract period and the enhanced period if any.
