The undersigned, hereinafter called the Bidder, declares that he/she has carefully examined the Contract Documents in Sections A through D, including the Project Specification and Drawings prepared by Flowing Solutions (Exhibit A) and the Borrow Areas Map (Exhibit B) for the Stevenson Shoreline Restoration and Recreation Enhancement Project – Stevenson Waterfront, Stevenson, WA. The Bidder further declares that the bidder is satisfied as to the quantities involved, including materials and equipment, and conditions of work involved, including the fact that the description of the work and materials, as included herein, is brief and is intended only to allow for itemized bidding under the requirements of the Contract Documents, Project Specifications and Drawings; and that this bid is made according to the terms of the drawings and documents referenced above, which are hereby incorporated herein and made a part of the bid.

The submission of this bid shall constitute an acknowledgement by the Bidder upon which the Port may rely that the Bidder has thoroughly reviewed and inspected all applicable federal, state and local statutes, ordinances and regulations relating to the work and all permits that have to be applied for and/or issued pertaining to the work. The failure or neglect of a Bidder to receive or examine any of the Contractor Documents, Project Specifications and Drawings, statutes, ordinances, regulations and permit requirements shall in no way relieve the Bidder from any obligations with respect to the bid or to the Contract. No claim for additional compensation will be allowed which is based upon a lack of knowledge or misunderstanding of this or any of the Contract Documents, Project Specifications and Drawings, statutes, ordinances, regulations, environmental assessments or impact statements, permit requirements, or other materials, referenced or incorporated herein.

The Bidder shall submit with the bid a bid bond not less than five (5) percent of the amount of the bid. The Bidder hereby agrees that if this bid is accepted, the Bidder will, within a maximum

Port of Skamania County, Stevenson, WA SECTION B 1 of 10 of five (5) calendar days after Notification of Award of Contract, execute a Contract with the Port and provide PERFORMANCE and PAYMENT BONDS; and will, to the extent of his/her bid, furnish all machinery, tools, apparatus and other means of construction for doing the work and all materials necessary to complete the work in the time frame specified per agreement.

The Bidder understands that the Contract involves “public works” and that workers shall receive the prevailing rate of wage as published by the Washington State Department of Labor & Industries. The relevant trades and job classifications and corresponding prevailing wage rates are listed below.

The Bidder further proposes to accept as full payment for the work proposed herein the amounts computed under the provisions of the Contract Documents, Project Specifications and Drawings and based on the following schedule of lump sum and unit prices. The Bidder agrees the lump sum prices and/or the unit prices represent a true measure of the labor and materials required to perform the work, including all allowances for overhead and profit for each type and unit of work called for.

Contract will be paid as a percentage complete, less any retainage. The appropriate quantities in the Bid Response schedule are taken from the Plans. These quantities are not guaranteed to be exact. The Bidder must be confident that the listed quantities are satisfactory. Items not listed in the Bid Response schedule are considered incidental work and shall be included in all bid items as necessary.

Bid Response items below are further clarified in two categories: Base Bid Items and Option Items.

Base Bid Items

Item 1 Mobilization, Bonding and Insurance: Lump sum. Payment for mobilization, bonding and insurance shall be made upon the mobilization to the site, less retainage.

Item 2 Turbidity Curtain: Lump sum. Total estimated: 500 feet. Includes installation and maintenance.

Item 3 Traffic Control: Hourly labor cost per hour. Total estimated: Two (2) flaggers, 395 straight time hours and 100 overtime hours estimated each (total 790 straight time hours and 200 overtime hours). Includes individuals with documented safety training and all safety equipment, signs and radios.

Item 5 Excavator #1, 450 Class, 100,000 lbs or greater GVW: Hourly Equipment and Operator Unit Price. Total estimated: 352 straight time hours and 88 overtime hours.

Item 6 Biodegradable Hydraulic Fluid Conversion Excavator #1, Lump Sum.

Item 7 Excavator #2, 336 Class, 80,000 lbs or greater GVW: Hourly Equipment and Operator Unit Price. Total estimated: 156 straight time hours and 39 overtime hours estimated.

Item 8 Biodegradable Hydraulic Fluid Conversion Excavator #2, Lump Sum.

Item 14 Excavator #3, 336 Class, 80,000 lbs or greater GVW: Hourly Equipment and Operator Unit Price. Total estimated: 150 straight time hours and 35 overtime hours estimated. The hours within this item could be used for additional hours for Excavators 1 or 2 OR a third excavator if needed. Total hours not guaranteed.

Item 15 Dump Truck #3, 15 Yard Capacity or Greater: Hourly Equipment and Operator Unit Price. Total estimated: 150 straight time hours and 35 overtime hours estimated. The hours within this item could be used for additional hours for Dump Trucks 1 or 2 OR a third truck if needed. Total hours not guaranteed.

Item 16 Loader #2 Mobilization,: Lump sum.

Item 19 Accessible Pathway Excavation: Lump sum. Unit price per square foot. Total estimated: 6500 square feet.

The undersigned, as Bidder, acknowledges that Bidder will comply with the provisions of RCW 39.12 relating to prevailing wage rates the same which shall be included in the Bid and Agreement.

By submission of this bid, each Bidder certifies and in the case of a joint bid each party thereto certifies for its own organization that this bid has been arrived at independently without consultation, communication, or agreement about any matter relating to this bid with any other Bidder or with any other competitor.

The undersigned agrees, if awarded a contract, to begin work not later than five (5) calendar days after issuance of the letter notice to proceed and to complete the Scope of Work on or before March 31, 2018. Accessing materials from Rock Creek as shown in Exhibit B Borrow Areas Map must be complete on or before September 30, 2017.

Bidder Responsibility Criteria

It is the intent of Owner to award a contract to the low responsible Bidder. Before award, the Bidder must meet the following responsibility criteria to be considered a responsible bidder. The Bidder may be required by the Owner to submit documentation demonstrating compliance with the criteria. The Bidder must: 1. Have a current certificate of registration as a contractor in compliance with RCW 18.27, which must have been in effect at the time of bid submittal; 2. Have a current Washington Unified Business Identifier (UBI) number; 3. If applicable: 3.a. Have Industrial Insurance (workers’ compensation) coverage for the bidder’s employees working in Washington, as required in RCW 51; 3.b. Have a Washington Employment Security Department number, as required in RCW 50; 3.c. Have a Washington Department of Revenue state excise tax registration number, as required in RCW 82; 4. Not be disqualified from bidding on any public works contract under RCW 39.06.010 or 39.12.065(3). 5. Submit with the bid a bid bond equal to five (5) percent of the amount of the bid. All responses must be received by the Port of Skamania County no later than 4:00 pm on Friday, July 21, 2017.
