On June 20, 2017, at the Oxford Township Building, 780 Hanover Street, New Oxford, PA 17350, the Board of Supervisor's regular meeting was called to order by Chairman Mario Iocco at 6:30pm by the Pledge of Allegiance to the American Flag. The Quorum consists of Supervisors Mario Iocco, Jim Lafferty and Harry McKean. Sitting with the Supervisors was; Solicitor John Baranski, Engineer Terry Myers, Treasurer Deb Greenholt, Alternate Zoning and Code Officer Ed Strevig and Secretary Beverly Shriver.

Chief Staab/EARP Report: May Report; EARP completed 17 Supplemental Reports, 99 Incident Reports, wrote 4 Non-Traffic Citations, 1 Misdemeanor Arrest and 1 Felony Arrest. They conducted 113 Vehicle Investigations which consisted of 79 Traffic Tickets, 26 Written or Verbal Warnings and 7 Accident Reports. There was a thief at the laundry mat.

EARP Commission Report: McKean reported the renegotiated Union Contract Agreement is in the officers hands for review.

Fire Company Reports: United Hook & Ladder: May Report: Shriver reported there were 47 Fire and Rescue calls, 5 were in the Oxford Township. EMS Report: Total number of calls 441; 52 calls were in the Township, 56 overall nursing home calls.

Irishtown Fire Company: No Report.

Public Comments Non-Agenda Issues: None.

Motion on Tabled Fee Schedule: Iocco asked to have this tabled for more time to check something out. McKean second by Lafferty motioned to table the Fee Schedule. 3 Aye Votes

Motion on Part-Time Zoning Officer and Code Enforcement Officer Advertisement: The Board of Supervisors were given a copy of an ad used previously. It was decided resume’s in by July 10th. Run ad in Gettysburg Times every other day for 5 days and Merchandiser 2 weeks, and check out monster.com. and PSATS too. McKean second by Lafferty motioned to place the advertisement for a Part- Time Zoning and Code Officer. 3 Aye Votes

York Adams Tax Bureau and Adams County Tax Collection Committee Representative’s Report (Rep. Robert Martin & Janet Martin): Meeting was cancelled; no report.

Solicitor’s Report: Scozzaro’s Noise Exemption for 2017: The LCB has two meetings; June 22nd and another July 22nd with the full board to rule. July 22nd is the expiration date for Scozzaro’s.

Property Acquisition at 2620 Red Hill Road: Baranski resent the letter of interest by email to the Bank again. No response. Noted Baranski was using a Red Hill Road address instead of Carlisle Pike address. Baranski will resend the letter using the correct street address.

Cohen Law Group Demand Funds Letter: Baranski did receive a full Cohen Law Audit (5 pages). They recommend that the Township send a demand funds letter to them to recover unpaid franchise fees. Baranski is working on that letter to be sent out this week. Baranski explained the Board did receive the full audit; that is the 5 page audit report unless they want to see their worksheets resulting in this report. The

Board was satisfied if Baranski had enough information to write his demand letter. Baranski is capable writing the letter with the information he received.

Fence Ordinance in Chapter 11 and Chapter 27: Baranski will draft an ordinance taking the fence ordinance out of Chapter 11. Baranski will have an ordinance for the next meeting to review and vote on; this does not take a hearing.

Update-Per Capita Taxes Personal Care Facility at The Brethren Home Community: This was always paid in the past; but a new person in the position feels The Brethren Home residents in the personal care facility should not be paying the $10 per capita tax. The school district is letting them go since they use their facilities. Adams County wants to collect it and so does the Township. The regulations regarding the PA Property Tax and Rent Rebate, lists renters as residents of nursing homes. The definition of a renter; you rented and occupied a home, apartment, nursing home, boarding home, or similar residence in PA. Baranski will work on this and keep the Board of Supervisors updated.

Engineer’s Report: Vulcan –NPDES Renewal: As required by their permit a notice was put in the Hanover Evening Sun Tuesday, June 6th; that Vulcan is trying to renew their NPDES Permit which is their storm water discharge. They are not proposing to change any current water handling procedures; nor will there be any change to the consumptive water use or negative impacts to the receiving stream. There is a request to increase the combine discharge from 28.8 million gallons per day based on the monthly average to 36 million gallons per day. However this increase in discharge will only incur in response to heavy rainfall events. Written comments or requests for a public meeting or informal conference should be submitted to DEP by July 27th. The impaired stream is because of surface mining; the Township is not contributing to the surface mining. The Township received a tentative waiver to the MS4 requirement. The Township still has to go through the process of applying again by September 16, 2017. Iocco noted he is not opposed to DEP renewing their permit; just don’t make the Township responsible and have the taxpayers spend a significant amount of money administering an MS4 Permit. Or if Vulcan wants to continue discharging and they want to pay all the Township’s costs associated with the MS4 requirements, he would be ok with that. The Board of Supervisors would like C. S. Davidson Inc. to do a letter voicing the Township concerns and request a meeting with the Township to discuss the discharge from Vulcan.

Oxford Glen Street Walk-Thru: Last Thursday, Rick Groft, Nate Simpson and Terry Myers met with the Developer and walked the streets in Oxford Glen. C. S. Davidson is developing a punch list and the maintenance security amount for each section. Jeff Stough did submit the description of the streets for adoption. Jeff Stough’s process is to get the streets paved and adopted this year; deadline August 15th. The adopted street should be recorded before the first week in September. There is some sunken curbing that needs to come out. J. A. Myers has to make sure the inlets are set at the right height; everything is very flat. The developer is aware the Township will not adopt streets with water pockets.

Summerfield Plan: RGS letter dated May 22nd, PennDOT said they were not making the developer do a traffic study since it would come back with the same recommendations. Short range conclusion for both Shank Road and Red Hill Road: 1. Restrict access to right in, right out only 2. Island shall be mountable to allow emergency vehicle access. The Township sent them an email; we want them to do the study. Iocco wants to see; 1. Jameston Road have a traffic signal; once Phase I is finished 2. Make improvements to Rt. 94. Rt. 94 from Cross Keys down; is scheduled to be resurfaced and improve Red Hill Road. Terry Myers will schedule a meeting with the new owner for the July 12th Board of Supervisors meeting to discuss traffic issues.

Roadmaster’s Report: The plow parts are installed. They did road repairs on Brickyard Road. Solar powered LED blinking stop lights run about $2,000 each. Iocco is in favor of installing them on both sides of the road. McKean is looking to see what price he can get through the state. Iocco second by McKean motioned to get pricing on the flashing stop sign lights; move forward with it; not to exceed $5,000. 3 Aye Votes

Zoning & Code Officer’s Report: June Report Zoning: 23- Building Permits 3- Occupancy Certificates Codes: 1-Drainage complaint 2-Property Maintenance Issue-Batts & Sibert 3-Mowing-2 resolved, 1-citation 2nd offense

The Board of Supervisors asked to continue receiving Strevig’s activity log and the condensed report for the minutes. Jim Lafferty second by Harry McKean motioned to accept the Zoning and Code Officer’s June Report as written. 3 Aye Votes

31 Emerald Lane: Strevig asked the Supervisors and Solicitor for advice; there are two cars parked at 31 Emerald Lane in the morning; not sure if they moved in but looks like it. There is no Use & Occupancy Permit issued for that residence. The driveway and sidewalk are not installed and a copy of the water test was not received. There is also an issue with storm water not being correct. It’s not habitable according to Township ordinances. Iocco offered to call the owner and ask if he moved in and let Strevig know. Baranski advised the owner will be cited daily to vacate the property until the O & U is issued; it’s a non-habitable residence. This is subject to a daily fine of $1,000. Strevig was guaranteed by Brian McIntyre he would move the storm water pipe out of the Township right-of-way and put it on the other side, behind the sidewalk. Strevig reported this has not been done yet. If McIntyre doesn’t do it; the owners do not receive their O & U permit.

113 C Kohler Mill Road: Strevig learned today; a person is living in the backyard of the property; 113 C Kohler Mill Road. There is a lady living in a tent; with a fenced area for her two dogs. Hempfing and Officer Cuffley were out there earlier and gave the owner fourteen days to get rid of everything. Hempfing cited a structure in a floodplain. We are past the fourteen days. It was said the owner of the property is renting out his yard. The person complaining said today; the lady is moving furniture into the tent. The Township requirement for a campground; is to have 10 acres; this property is .21 acres. Strevig took pictures of the residence with the tent. Baranski directed Strevig to get a letter to the owner; they have fourteen days to eliminate the violation for running an illegal campground. If the owner wants to appeal it; the owner has to come before the Board of Supervisors. After fourteen days; Strevig should give the owner a citation and every day after that until it is removed. Baranski will look for a penalty amount and let Shriver know.

Secretary’s Report: Recreation Park Mowing: Shriver informed T. J. Smith, June 16th that he was approved to mow the recreation park for $70 an acre. Smith said it was just mowed and the second cutting is not as good as the first cutting. Smith said whatever the Supervisors want him to do he will do but he is not going to get his monies worth out of that second cutting. Smith suggested waiting until next year to start; next spring he can fertilize and get a better cutting. The Board of Supervisors will finalize this before year end. Consent Agenda: Lafferty second by McKean motioned to accept the consent agenda as written. 3 Aye Votes

Rec’d Liquids Fuels Tax Fund Audit for January 1, 2016 - December 31, 2016.

Rec’d notice that TB Liquidating Company, formerly known as TimBar Packaging & Display will dissolve by filing Articles of Dissolution with the Department of State of PA so that its corporate existence shall cease.

Rec’d DEP letter dated May 24, 2017, to Liberty Environmental Inc. giving notice Oxford Commons, 2-248 Erin Court, New Oxford, has approval of the Environmental Covenant.

Rec’d notice from FEMA dated May 22, 2017 of an invitation to a Flood Risk Reduction meeting scheduled June 27, 2017 from 1:30PM to 3:30PM, but Oxford Township will not undergo changes to flood zone designations or base flood elevations at this time, our attendance is not required but we are welcome to attend.

Treasurer's Report: Motion on List of Incomes, Bills and Transfers: Lafferty second by Iocco motioned to approve the Treasurer’s List of Incomes, Transfers and pay Bills. 3 Aye Votes

Adams County 12-Month CD: This CD is up for renewal; Adams County Bank has a special for on a 13-Month CD at .9% interest instead of .2 %. Shriver, Lafferty and Greenholt sign the account opening form.

Board of Supervisors Issues & Executive Session: Mario Iocco and Deb Greenholt are attending C S Datum training, Friday, June 23 at Range End Golf Club in Dillsburg. Shriver is on vacation, so the office will be closed until around 10:00am.

Review Active Plan List: Larry B. Jr. and Audrey M. Feeser Preliminary/Final Subdivision Plan: Baranski explained the last condition of this plan is for the Township to receive a draft deed; when approved by Baranski the plan can be approved by the Board of Supervisors and recorded. Once the plan is recorded; Larry Feeser’s Attorney, Attorney Hagerman can use the recording information to fill in the blanks on the deed and get it recorded. Baranski reported Hagerman will have to correct Mrs. Groft’s name; her name is Janet not Janette. Baranski is okay with the deed as written with that correction. Baranski will inform Hagerman to make the name correction. Baranski advised the Board could approve the plan tonight; this was the last condition to be met. As discussed at the previous meeting; Tom Beamer stopped in the office and told Shriver, he is not signing the plan until Larry Feeser pays the sewer hook-up. It is a Township requirement to have NOMA’s signature on a plan. Baranski noted this is a vacant lot that might never be developed. The Board of Supervisor’s feel they don’t need NOMA’s signature; Feeser has an approved Sewage Facility Planning Module which has NOMA’s letter included. Harry McKean second by Mario Iocco motioned to approve the Larry B. Jr. and Audrey M. Feeser Preliminary/Final Subdivision Plan. 3 Aye Votes
