(“Hopewell”) providing goods to the above applicant (“Applicant”), the undersigned (“Guarantor”) unconditionally guarantees payment of all indebtedness incurred by the Applicant to Hopewell, whether due now or hereafter incurred, and agrees to indemnify Hopewell Nursery for any and all amounts due from the Applicant to Hopewell. This payment will be made in New Jersey at the offices of Hopewell. Guarantor also agrees to pay to Hopewell reasonable attorney fees incurred in the collection of such indebtedness. It shall not be necessary for Hopewell, in order to enforce the obligations of the Guarantor, to first institute suit or pursue or exhaust its remedies against the Applicant. If more than one individual signs below, each shall be liable hereunder jointly and severally. This guarantee shall remain in full force and effect until released in writing by Hopewell, or thirty (30) business days after notice is received by Hopewell from the Guarantor, although such notice by the Guarantor shall apply only to indebtedness arising after such thirty (30) business day period and shall not affect the guarantee relating to indebtedness existing through that date. Guarantor understands that this is a guarantee of payment and not of collection and that Hopewell is relying upon this guarantee in approving this Credit Application.
