Pursuant to M.S. Chapter 375.07, the Board of County Commissioners of Polk County met in session at 8:00 o'clock a.m., January 4, 2011 in the Commissioners Room at the Polk County Government Center. Members present: Commissioner Craig Buness, Commissioner Warren Strandell, Commissioner William Montague, Commissioner Warren Affeldt and Commissioner Don Diedrich. Others present: Gerald J. Amiot, County Auditor-Treasurer and Tangee Bouvette, Deputy Clerk of the Board.

The Deputy Clerk of the Board called the meeting to order and proceeded to call for nominations for the Office of Chairman of the Polk County Board of Commissioners for 2011. A motion was made by Commissioner Diedrich to nominate Commissioner Affeldt as Chairman of the Board seconded by Commissioner Strandell. Commissioner Montague seconded by Commissioner Strandell moved that nominations cease and a unanimous ballot be cast for Commissioner Affeldt as Chairman of the Polk County Board of Commissioners for 2011. Motion unanimously carried. The Deputy Clerk of the Board asked for nominations for the office of Vice-Chairman of the Board. A motion was made by Commissioner Diedrich to nominate Commissioner Montague as Vice-Chairman of the Board, seconded by Commissioner Buness. Commissioner Strandell moved that nominations cease seconded by Commissioner Diedrich and a unanimous ballot be case for Commissioner Montague as Vice-Chairman of the Polk County Board of Commissioners for 2011. Motion unanimously carried.

The Chairman of the Board assumed the chair.

A motion was made by Commissioner Buness, seconded by Commissioner Montague and adopted by unanimous vote of the Board to approve the Agenda and Consent Agenda for January 4, 2011:

1. Approve December 2010 Auditor Warrant List. 2. Approve payment to the City of Erskine, Erskine, MN in the amount of $65.00 for blading for the Highway Department. 3. Approve payment to MN County Engineers Association in the amount of $240.00 for membership dues for the Highway Department.

Commissioners Forum

Karl Erickson, Chief Deputy, came before the board to discuss matters pertaining to the Sheriff’s Office. A motion was made by Commissioner Diedrich, seconded by Commissioner Montague and adopted by unanimous vote of the Board to approve the public sale of unclaimed property and forfeitures on IQBID.com, a division of Steffes Auctions, from the dates of January 24, 2011 through February 7, 2011. Complete list available in the County Administrator’s Office.

Richard Sanders, Polk County Highway/Ditch Engineer came before the Board to discuss matters pertaining to his department. A motion was made by Commissioner Diedrich, seconded by Commissioner Strandell and adopted by unanimous vote of the Board to approve the Angus Farm Lease for Don Strickler. A motion was made by

1 Commissioner Montague, seconded by Commissioner Buness and adopted by unanimous vote of the Board to approve signature of contract for Safety Compliance Services. A motion was made by Commissioner Strandell, seconded by Commissioner Buness and adopted by unanimous vote of the Board to approve sending two Maintenance employees to travel to Quincy, Ill to learn to set up a sign truck. Bert’s Trucks will be funding the travel. A motion was made by Commissioner Montague, seconded by Commissioner Diedrich and adopted by unanimous vote of the Board to approve sending two Maintenance employees to travel to Tomahawk, WI to the Case proving grounds. Case will be funding the travel. A discussion was held regarding TH 75 and CSAH 21.

Gerald Amiot, County Auditor-Treasurer, came before the board with matters pertaining to his department. A motion was made by Commissioner Buness, seconded by Commissioner Montague and adopted by unanimous vote of the Board to approve the establishment of a 2011 County Attorney’s Contingent Fund in the amount of $7,500.00 as per M.S. 388.14. A motion was made by Commissioner Strandell, seconded by Commissioner Diedrich and adopted by unanimous vote of the Board to approve the one- year lease agreement with the City of McIntosh for the Extension office at the annual cost of $6,966.00. A motion was made by Commissioner Diedrich, seconded by Commissioner Buness and adopted by unanimous vote of the Board to approve the Malt Liquor license renewal of Christopher Weiland, dba One–n-Only Store, Euclid Township. A motion was made by Commissioner Strandell, seconded by Commissioner Diedrich and adopted by unanimous vote of the Board to approve the Tobacco Sales License Renewals, as on file in the Administrator’s Office, once fees are received. A motion was made by Commissioner Montague, seconded by Commissioner Diedrich and adopted by unanimous vote of the Board to approve the payment to Sequel, Help Systems IL in the amount of $293.98 for annual maintenance contract.

Tangee Bouvette, County Human Resources came before the Board with matters pertaining to the Administrator’s Department. A motion was made by Commissioner Montague, seconded by Commissioner Buness and adopted by unanimous vote of the Board to approve the Public Health Response Grant. A motion was made by Commissioner Strandell, seconded by Commissioner Buness and adopted by unanimous vote of the Board to reappoint Commissioner Montague and Commissioner Diedrich to the Tri-Valley Opportunity Council Board. A motion was made by Commissioner Montague, seconded by Commissioner Diedrich and adopted by unanimous vote of the Board to appoint Commissioner Affeldt as Delegate and Commissioner Strandell as alternate to the MRCC Board. A motion was made by Commissioner Montague, seconded by Commissioner Strandell and adopted by unanimous vote of the Board to approve payment to AMC in the amount of $11,893.00 for annual dues. A motion was made by Commissioner Buness, seconded by Commissioner Diedrich and adopted by unanimous vote of the Board to approve payment to MRCC in the amount of $2,100 for annual dues.

The following resolution (2011-1-1) was offered by Commissioner Buness:

2 WHEREAS, The Board of County Commissioners of Polk County, Minnesota, has availed itself of the authority granted under Section 375.163, M.S.A., and will pay the dues of said County to the State and National Association of County Commissioners for the year 2011 and it is the intention of said Board of County Commissioners to designate individuals to attend meetings of said Association.

NOW THEREFORE BE IT RESOLVED, That the Board of County Commissioners of Polk County Minnesota, does hereby designate all of its members as delegates from said County to serve on various committees of that Association.

BE IT FURTHER RESOLVED, That upon presentation of a properly verified claim, the County Auditor-Treasurer be and hereby is authorized to reimburse each of said person for their actual and necessary expenses in attending such meetings.

BE IT FURTHER RESOLVED, That the following named individuals are Polk County's official delegates to the Association of Minnesota Counties: Commissioner Buness, Commissioner Strandell, Commissioner Montague, Commissioner Affeldt, Commissioner Diedrich, John P. Schmalenberg, County Administrator, Gerald J. Amiot, County Auditor-Treasurer, and Richard Sanders, County Highway/Ditch Engineer.

Commissioner Montague seconded the foregoing resolution and it was declared adopted upon the following vote. YEAS: Buness, Montague, Strandell, Diedrich. NAYS: None.

The following resolution (2011-1-2) was offered by Commissioner Diedrich:

BE IT RESOLVED, By the Board of County Commissioners of Polk County that pursuant to M.S. 331A.12, Polk County’s web site; www.co.polk.mn.us be and hereby is designated by the Board of County Commissioners of Polk County as the official site for the publications of invitations to bid on Polk County transportation projects.

Commissioner Strandell seconded the foregoing resolution and it was declared adopted upon the following vote. YEAS: Buness, Montague, Strandell, Diedrich. NAYS: None.

Gerald Amiot, County Auditor-Treasurer, came back before the board to announce that his tentative retirement date is the end of July 2011.
