In the matter of supporting the 50% ) reimbursement rate for indigent defense) March 25, 2015

WHEREAS, the State of Ohio has a constitutional mandate to provide legal representation to indigent persons; and

WHEREAS, Ohio has chosen to transfer this responsibility to its counties, initially reimbursing them for 50% of the costs incurred in meeting this constitutional obligation of the state; and

WHEREAS, the state has chosen not to maintain this 50% commitment, which has resulted in the counties carrying more than their 50% share of the burden for more than the last two decades; and

WHEREAS, the reimbursement rate has averaged 34.6% for the decade prior to the FY14/15 biennium and hit its record low of 26.1% in FY09; and

WHEREAS, increasing the appropriation in HB64, the proposed state biennial budget for fiscal years 2016 and 2017, by an additional $12 million in GRF funding in each year of the biennium would provide for a return to 50% reimbursement rate; and

WHEREAS, Ohio’s counties ask that the original partnership to be restored and counties receive reimbursement for 50% of their costs incurred in meeting the State’s constitutional mandate to provide legal representation to indigent defendants.

NOW, THEREFORE BE IT RESOLVED, by the Lorain County Board of Commissioners that we hereby ask our legislators representing Lorain County to - Restore County Reimbursement for Indigent Defense To 50% in HB64, the FY2016/2017 state biennial budget bill. - Increase the current appropriation, GRF line, County Reimbursement by $12 million in each year the of the biennial to establish the annual appropriation of $21,620,268

The focus of the Juvenile Mental Health Court is to improve a youth’s behavioral and emotional functioning, strengthens the family’s ability to care for the youth in the home and assists the youth in achieving stability in school and in the community. There is a cash match of $17,250 that will be provided by the Department of Youth Services Reclaim Fund.

Program enhancement will include the addition of a Program Assistant position, increased drug screening, assessments and incentives for program participants. FURTHER BE IT RESOLVED, said credit card policy is as follows; Introduction The Lorain County Probate Court, recognizes the value of an efficient method of payment and record keeping for certain expenses. Therefore the Lorain County Probate court permits employees to use Court credit cards for the purchase of goods and services, provide that the following procedures are follows: Credit Card Procedures 1. Credit card(s) can only be used for official county business. Pursuant to R.C. 301.27, credit card use is limited to the following work-related expenses: food, transportation, gasoline and oil, motor vehicle repair and maintenance, telephone, lodging and internet service provider expenses. 2. Credit card(s) can only be used by designated employees who have received written authorization. Designated employees as of this date are: James T. Walther, Judge Darlene Chapman, Court Administrator 3. Detailed receipts must be obtained when using credit card(s) and provided to the Court Administrator. If the Court Administrator is making the purchase, detailed receipts shall be submitted to the Judge. 4. Employees may be held liable for charges if receipts are lost or not provided. 5. In the event credit card(s) cannot be located or are determined to be stolen, employee(s) must contact the credit card company immediately to cancel credit card(s). 6. Employee(s) authorized to utilize credit card(s) will sign a copy of this policy prior to use of credit card(s). 7. The Judge or Court Administrator shall retain credit card(s) in a secure location when not in use. 8. Lorain Municipal Court Pay rate increases; 1. Thomas Borowicz, Bailiff for Judge Mihok, pay rate increase 1.33% for 2014 and 2015 retro 2. Bianca Villar, Bailiff for Judge Elwell, pay rate increase 1.33% for 2014 and 2015 retro

Golden Acres: New hires; 1. Khadja Knapp, Part-time LPN, effective April 1, 2015 at rate of $17.00/hour 2. Awilda Droz, Housekeeper, effective April 1, 2015 at rate of $8.20/hour

Job & Family Services: Pay rate increases; 1. Mary Lou Golski, Director, effective date to be determined at rate of $61.00/hour
