Project Title: Strengthening Montenegrin agriculture with establishing Land Parcel Identification System

Potential applicants’ questions & Contracting Authority’s responses

Q2 The service contract notice for the above mentioned project includes requirements for technical capacity of the candidate. However, the requirements do not include any minimum value of such reference as it is often with similar projects. Does this mean, that there is no minimum value? Are the references in amount of 10.000 EUR acceptable for this project?

A2 Yes indeed, there is no minimum value in this case. Please however bear in mind that if more than 8 eligible candidates meet the selection criteria, a shortlist will be drawn up on the basis of the 3 RE-examinations criteria mentioned in point 21 of the Contract Notice.

Q3 Reference to the Eligibility clause, please could you confirm whether a firm based outside EU can participate as a lead firm in this procurement? If not, whether the non-EU based firm can participate as a sub-contractor to a European firm (as part of the consortium).

A3 Rules of participation and origin, eligibility for grants (i.e. being a sole applicant, Leader or member of a consortium, or a sub-contractor) are defined in article 19 of Council Regulation (EC) 1085/2006 establishing an Instrument for Pre-Accession Assistance (IPA):

1. Participation in the award of procurement or grant contracts financed under this Regulation shall be open to all natural persons who are nationals of and legal persons who are established in a Member State, a country that is a beneficiary of this Regulation, a country that is a beneficiary of the European Neighbourhood and Partnership Instrument, or a Member State of the European Economic Area.

The list of countries belonging to those categories could be found on pages 13-14 of Annex A2b2 of the Practical Guide (PRAG) :

2. Participation in the award of procurement or grant contracts financed under this Regulation shall also be open to all natural persons who are nationals of and legal persons who are established in any country other than those referred to in paragraph 1, where reciprocal access to their external assistance has been established.

Regarding this second paragraph, it should be noted that there are no reciprocal agreements in place so far.

The same rules of participation apply to sub-contractor.

Furthermore, considering near deadline, we would appreciate if you could let us know which certificates/evidences are mandatory to be submitted, if any?

A4 The standard application form to be used for this service contract is Annex B3 Standard Application Form. Mandatory certificates/evidences to be submitted will only be requested at the next stage of the procedure.
