tenement and 10 acres of land in Frogmore late in occupation of Robert Benny part of the manor of Climsland Prior, formerly part of the possession of the ‘then late dissolved Priory of Launceston’ and then annexed to Duchy lands, for 99 years on lives of John Luxmore, now deceased, Charles Lethbridge and George Palmer, also deceased, every assignment of the premises to be enrolled before the Auditor within 6 months otherwise to be void
‘Divers Wills Assignments and other good and sufficient Assurances ...’ entitling Sarah Mayes, wife of William Wyatt Mayes of Plymouth, merchant, for her life to the remainder of the term; the assignments being duly enrolled; the legal estate of the term remained vested in Corydon Carpenter deceased; for want of a personal representative to him, Sarah is unable to make a complete legal title to the term in the premises
Sarah Mayes requests that letter of administration of the goods of Corydon Carpenter be granted to John Beer, but only for the purpose of assigning the remainder of the term of years vested in Corydon Carpenter.

John Beer is required on oath to swear that Corydon Carpenter late of Launceston, esquire, died possessed of the remainder of a term of 99 years in premises in Sturt, Mallett Down and Frogmore, all in Stokeclimsland, late in occupation of Robert Benny; that deceased by his will appointed John Arscott, John Luxmore and Henry Luxmore as his executors; that Henry Luxmore was the only survivor and is since dead without having assigned the legal estate in the term; that John Beer will therefore administer the goods chattels and credits of Corydon Carpenter ‘So far concerns the residue and remainder of the said term’; that he will present an inventory and a just and true account when required

John Beer of Plymouth, gentleman, confirms that the grant of administration of the effects of Corydon Carpenter is ‘intended only to extend to the residue’ of the term of years in property in Stokeclimsland and to enable him to assign it in trust for Sarah Mayes, ‘beneficially entitled’ to the residue of the term of years and that he takes nothing beneficially.
