BYLAW 13909

ACCESSIBLE TAXI BYLAW

Whereas, pursuant to sections 7 and 8 of the Municipal Government Act, R.S.A. 2000 , c. M-26, Council may pass bylaws dealing with transportation, business and other activities:

Edmonton City Council enacts:

PART - PURPOSE, DEFINITIONS AND INTERPRETATION

PURPOSE The purpose of this bylaw is to establish a system of Accessible Taxi service with priority for passengers using a Mobility Aid as a result of a physical disability.

DEFINITIONS In this bylaw, unless the context otherwise requires:

“Accessible Taxi” means a vehicle bearing an Accessible Taxi Licence;

“Accessible Taxi Licence” means a licence issued pursuant to this bylaw to operate a vehicle as an Accessible Taxi;

“Licensee” means the individual or corporation named on an Accessible Taxi Licence; and

“Mobility Aid” means a device, including a manual wheelchir, electric wheelchair or scooter, that is used to facilitate the transport, in a normal seated orientation, of a person with a physical disability.

PART - ACCESSIBLE TAXI LICENCES

ISSUE OF The City Manager may issue up to 10 Accessible Taxi Licences. LICENCES

ONE LICENSEE All Accessible Taxi Licences must be issued in the name of the same individual or corporation as Licensee.

CITY PROPERTY All Accessible Taxi Licences remain the property of the City and are not transferable.

EXPIRY Unless otherwise cancelled all Accessible Taxi Licences expire on April 30th of each year.

RENEWAL A Licensee may apply to renew an Accessible Taxi Licence that would otherwise expire.

PART - LICENSEE OBLIGATIONS

VEHICLE A Licensee shall ensure that all Accessible Taxis comply with the STANDARDS standards for such vehicles prescribed by the Commission.

ONE TAXI BROKER A Licensee shall ensure that all Accessible Taxis are operated through the same Taxi Broker.

SERVICE A Licensee shall ensure that the Taxi Broker through which OBLIGATIONS Accessible Taxis are operated:

has no less than two Accessible Taxis in service and available to passengers at all times;

gives priority to requests for service from passengers using a Mobility Aid as a result of a physical disability; and

keeps a daily record of service activity for each Accessible Taxi including details of pick up and drop off points for each passenger.

SHAREHOLDER If the Licensee is a corporation then the consent of the City CHANGE Manager shall be obtained prior to any change of directors or shareholders resulting in a change of control of the corporation. Bylaw 13909 Page 3 of 4

PART - ACCESSIBLE TAXI OPERATION

OPERATION AS Subject to the requirements of this bylaw an Accessible Taxi may TAXI operate in the same fashion as a Taxi.

VEHICLE No person shall operate an Accessible Taxi unless it complies with STANDARDS the standards for such vehicles prescribed by the Commission.

OPERATOR No person shall operate an Accessible Taxi unless that person has TRAINING satisfied the training requirements for such operators prescribed by the Commission.

PRIORITY FOR A person operating an Accessible Taxi shall give priority to SERVICE requests for service from passengers using a Mobility Aid as a result of a physical disability.

PART - GENERAL

APPLICATION OF Except where inconsistent with the provisions of this bylaw, the TAXI BYLAW provisions of Bylaw 12020, the Taxi Bylaw, apply to this bylaw with any required modifications for context.

OFFENCE A person who contravenes or does not comply with a provision of this bylaw is guilty of an offence.

CANCELLATION OF Whether or not a person has been prosecuted for the commission LICENCE of an offence the City Manager may cancel any Accessible Taxi Licence if there are reasonable grounds to believe the Licensee has contravened or failed to comply with a provision of this bylaw.

COMMISSION In addition to any of it’s other powers the Commission may POWERS prescribe:

the application procedures for Accessible Taxi Licences;

the criteria by which such applications will be judged;

vehicle standards for Accessible Taxis; Bylaw 13909 Page 4 of 4

training requirements for operators of Accessible Taxis; and

operational requirements for Accessible Taxis not otherwise specified in this bylaw.
