The School Board of the Parish of Lafayette, State of Louisiana, met in regular session at its meeting place, the Lafayette Parish School Board Administrative Building, Board Room, Lafayette, Louisiana, on Wednesday, May 6, 2015 at 5:30 P.M. pursuant to notice given in writing to every member.

MEMBERS PRESENT: Tommy Angelle, President; Dawn Morris, Vice-President; Elroy Broussard, Justin Centanni, Tehmi Chassion, Jeremy Hidalgo, Erick Knezek, Britt Latiolais and Mary Morrison, Board Members; Burnell LeJeune, Interim Secretary- Treasurer/Superintendent

MEMBERS ABSENT: None

I. MEETING OPENINGS The meeting was called to order by Angelle followed by a moment of silence. He led the group in the Pledge of Allegiance.

OPENING COMMENTS Superintendent LeJeune thanked teachers and recognized them for Teacher Appreciation Week. He also recognized the school support employees for their awesome support service; Cox Communications for their educational support in sponsoring the student Hero program; and Lafayette High School for receiving a Blue Ribbon Band award. He then gave a brief overview on how principals are selected, and ended by congratulating the new superintendent Dr. Donald Aguillard.

ADDITIONS TO THE AGENDA Motion (Centanni, Hidalgo) That the Board amend the agenda to add under Other Financial Reports: Comprehensive Annual Financial Report (CAFR). Motion carried.

APPROVAL OF AGENDA Motion (Centanni, Broussard) That the Board approve the agenda as amended. Motion carried.

2. Recognition of Ms. Patricia Colbert Cormier, 2015 Louisiana Association of Educators Human and Civil Rights Award/Mr. Rodolpho Espinoza,President of LPAE-LAE President's Award

1 The Board recognized and congratulated Ms. Patricia Colbert Cormier, 2015 Louisiana Association of Educators Human and Civil Rights Award for her work in the community that contributes to broadening horizons for minorities and women. Also recognized was Mr. Rodolpho Espinoza, President of LPAE-LAE President's Award for being fair, open- minded and open to suggestions leading him to make intelligent and fair decisions.

2. Rezoning Board member Chassion said he added this item to the agenda in order to get a discussion started. He said some schools are bursting at the seam, and other schools have empty classrooms. Dr. Chassion said a zone modification is needed to balance schools. Discussion by other board members included: getting a parent or community group together, giving ample notice to public regarding zone maps, and having students attend schools close to their homes.

Michael Hefner (Geographic Planning & Demographic Services) suggested that the Board take a look at where programming is right now; make people part of the process; he would work with the Board and staff; can use socio economic background and student performance; and that it is not necessary to go back to the courts.

Superintendent Aguillard asked that he be given an opportunity to evaluate programming, understand where Schools of Choice are, see where overcrowding issues are, and come back to the Board in about 2 or 3 months with a vision.

12. Resolution 05-15-1850 - Approval of Release and Settlement Agreement for Salt Water Disposal and Water Well

BE IT RESOLVED, that pursuant to a public notice, a regularly scheduled meeting of the Lafayette Parish School Board was held on the 6th day of May, 2015, at 5:30 o’clock P.M. at 113 Chaplin Drive, Lafayette Louisiana, where the following resolution, upon motion duly seconded and passed, was adopted, to-wit:

BE IT RESOLVED, that the Lafayette Parish School Board is the owner of the property described as Section 16, Township 9 South, Range 3 East located in Lafayette Parish near the town of Duson, Louisiana.

BE IT FURTHER RESOLVED, that Kaiser-Francis Oil Company owned an Oil & Gas lease with Lafayette Parish School Board dated April 8, 1954 and a Salt Water Disposal Well agreement dated May 14, 1956 with both of these agreements being released on August 5, 2014.

BE IT FURTHER RESOLVED, that Lafayette Parish School Board has performed soil sampling and laboratory testing that has confirmed the well site and facility are free of contamination.

BE IT FURTHER RESOLVED, a freshwater supply well of unknown origin is located near the Salt Water Disposal Well and Lafayette Parish School Board has requested that Kasier- Francis plug the freshwater well at its sole cost in accordance with all appropriate regulations in exchange for release of Kasier-Francis from any claims and damages related to the Salt Water Disposal Well and the Fresh Water Well.

BE IT FURTHER RESOLVED, by Lafayette Parish School Board, in legal session convened, does hereby approve the Release and Settlement Agreement.

RESOLUTION 05-15-1851 Request an Opinion from Attorney General on Allowed Investments in an OPEB Trust

Pursuant to a public notice, a regularly scheduled meeting of the Lafayette Parish School Board (LPSB) was held on the 6th day of May, 2015, at 5:30 o’clock P.M. at 113 Chaplin Drive, Lafayette Louisiana, where the following resolution, upon motion duly seconded and passed, was adopted, to-wit:

WHEREAS, the Government Accounting Standards Board (GASB) is the independent organization that establishes and improves standards of accounting and financial reporting for U.S. state and local government and in June 2004 issued GASB Statement 45;

WHEREAS, GASB 45 provides that public employers, including school systems that provide other post-employment benefits (OPEB), such as retiree health insurance, are required to measure and disclose an amount for annual OPEB cost on the accrual basis of accounting;

WHEREAS, LPSB, as required by law, provides health insurance to retirees and is therefore required to meet the requirements of GASB 45;

WHEREAS, the Louisiana Legislature, in recognition of the need to comply with GASB 45, enacted LRS 33:5161 & 33:5162 which allows local governments to create trusts dedicated to meeting OPEB obligations and expand the types of investments placed in such trusts to reflect the long-term nature of such an obligation;

WHEREAS, the LPSB has created a trust for OPEB funds and is in need of confirmation that the trust so created can invest in any of the investment alternatives set forth in LRS 33:5162. Among these investment options are Treasury instruments, US government bonds, mutual funds, LAMP, and stocks listed on the New York Stock Exchange, American Stock Exchange or NASDAQ; and,

7 NOW THEREFORE, BE IT RESOLVED, that the Lafayette Parish School Board, in legal session convened, does hereby request the Louisiana Attorney General to issue an opinion on the following question:

May a trust dedicated to the funding of post-employment benefits created by a local governing body in accordance with LRS 33:5161 invest those funds in any or all of the types of invests set forth in Subsection A of LRS 33:3162, subject to the restrictions and limitations set forth in Subsection B and C thereof?

BE IT FURTHER RESOLVED that the President of LPSB executes a joint letter which will include the Louisiana School Boards Association requesting an official opinion of the Louisiana Attorney General in this regard.

WHEREAS, nutritious meals at school are an essential part of the school day; and

WHEREAS, the staff of the District’s school meals and nutrition department are committed to providing healthful, nutritious meals to the District’s children; and

WHEREAS, the men and women who prepare and serve school meals help nurture our children through their daily interaction and support; and

WHEREAS the week of May 4-8, 2015, is School Nutrition Employee Week; now

THEREFORE, BE IT RESOLVED, that the Lafayette Parish School Board expresses its deep appreciation to these valuable employees and commends their good work on behalf of children.

3. Proposed Revision to the Current Counselor Staffing Allocation Formula Motion (Centanni, Latiolais) That the Board approve the proposed revision to the current Counselor staffing allocation formula.

Voting for were Angelle, Broussard, Centanni, Hidalgo, Knezek, Latiolais, Morris and Morrison. Voting NO was Chassion. Motion carried.

4. French Immersion Pathway Growth at Myrtle Place Elementary Discussion was held and call for the question was made by Knezek and seconded by

9 Hidalgo. Voting for were Angelle, Broussard, Chassion, Hidalgo, Knezek, Latiolais, Morris and Morrison. Motion carried. Centanni abstained.

Motion (Hidalgo, Knezek) That the Board approve the Myrtle Place French Immersion Pathway Growth.

Voting for were Angelle, Broussard, Hidalgo, Knezek, Latiolais, Morris and Morrison. Voting NO was Chassion. Motion carried. Centanni abstained.

Chassion exited the meeting.

5. Resolution 05-15-1852 National Children's Mental Health Awareness Day May 7, 2015

RESOLUTION - 05-15-1852 National Children’s Mental Health Awareness Day

WHEREAS addressing the complex mental health needs of children, youth, and families today is fundamental to the future of Lafayette Parish;

WHEREAS the need for comprehensive, coordinated mental health services for children, youth, and families places upon our community a critical responsibility;

WHEREAS it is appropriate that a day should be set apart each year for the direction of our thoughts toward our children’s mental health and well-being;

WHEREAS Lafayette Parish School System, through its unique approach to serving children and adolescents, is effectively caring for the mental health needs of children, youth, and families in our community;

THEREFORE, BE IT RESOLVED, that the Lafayette Parish School Board does hereby support May 7, 2015, as

NATIONAL CHILDREN’S MENTAL HEALTH AWARENESS DAY and urge our citizens and all agencies and organizations interested in meeting every child’s mental health needs to unite on that day in the observance of such exercises as will acquaint the people of Lafayette Parish with the fundamental necessity of a year-round program for children and youth with mental health needs and their families.

RESOLUTION - 05-15-1853

School Nurse Day

WHEREAS, children are the future and, by investing in them today, we are ensuring our world for tomorrow; and

WHEREAS, all students have a right to have their health needs safely met while in the school setting; and

WHEREAS, children today face more complex and life‐threatening health problems requiring care in school; and

WHEREAS, school nurses have served a critical role in improving public health and in ensuring student’s academic success for more than 100 years; and

WHEREAS, school nurses are professional nurses that advance the well‐being, academic success, and life‐long achievements of all students by serving on the frontlines and providing a critical safety net for our nation’s most fragile children; and

WHEREAS, school nurses act as a liaison to the school community, parents, and health care providers on behalf of children’s health by promoting wellness and improving health outcomes for our nation’s children; and

WHEREAS, school nurses support the health and educational success of children and youth by providing access to care when children’s cognitive development is at its peak; and

WHEREAS, school nurses are members of school‐based mental health teams; and

WHEREAS, school nurses understand the link between health and learning and are in a position to make a positive difference for children every day, therefore be it

11 RESOLVED, that the National Association of School Nurses celebrates and acknowledges the accomplishments of school nurses everywhere and their efforts of meeting the needs of today’s students by improving the delivery of health care in our schools and offers gratitude for the nation’s school nurses, who contribute to our local communities by helping students stay healthy, in school, and ready to learn, and keeping parents and guardians at work, not just on this National School Nurse Day, but at every opportunity throughout the year.

THEREFORE, BE IT RESOLVED, that the Lafayette Parish School Board does hereby support May 6, 2015, as

SCHOOL NURSE DAY in Lafayette Parish and urges our community to promote activities in recognition of this day.

7. Resolution 05-15-1854 Support from Legislators for Not Reducing or Repealing the Inventory Tax

RESOLUTION 05-15-1854

THE LAFAYETTE PARISH SCHOOL BOARD HEREBY RESOLVES:

A RESOLUTION URGING STATE SENATORS AND STATE REPRESENTATIVES TO FIND ALTERNATIVES MEASURES IN BALANCING THE STATE BUDGET WITHOUT REDUCING OR REPEALING THE INVENTORY TAX THAT LOCAL GOVERNMENTS RELY ON FOR ITS OPERATIONS

WHEREAS, the state of Louisiana has a projected budget deficit of $1.6 billion; and

12 WHEREAS, any bill that proposes reductions or repeal of the inventory tax would have an estimated financial impact of $8.1 million dollars on the Lafayette Parish School Board and $12.5 million dollars on other Lafayette Parish governmental entities.

WHEREAS, Lafayette Parish Inventory Tax received contributes to the overall operation of Lafayette Parish Schools and other taxing authorities’ operations; and

WHEREAS, reducing or repealing this local revenue stream, would cause substantial decline to the quality of the public school system, local health care system, law enforcement authority including 911 Call Center, transit services, an exhausted supportive services programs; i.e., Head Start Program, Elderly Services, Youth Programs, etc., maintenance of the levees, road, and public works projects, maintenance of water treatment plants, Emergency Management and Preparedness ability to respond to emergencies, and other local government supported programs and services; and

WHEREAS, Lafayette Parish School Employees’ salaries and benefits account for approximately 89% of the operating budget. A repeal or any reduction to the inventory tax received by the Lafayette Parish School Board would make it very difficult to maintain the current pupil/teacher ratios.

WHEREAS, by supporting any change to reduce or repeal the Inventory Tax would mean dwindling the local economy and creating economic hardship on many families; and further imposing barriers on the sustainability of local government;

THEREFORE, BE IT DULY RESOLVED that the Lafayette Parish School Board and Superintendent do hereby urge Louisiana State Senators and Representatives to find alternative measures in balancing the state budget without reducing or repealing the Inventory Tax that local government entities rely on for operations.

And the resolution was declared adopted on the 6th of May 2015.

8. Superintendent's Contract (Potential Executive Session) Motion (Latiolais, Knezek) That the Board ratify the contract negotiated with Superintendent Dr. Aguillard. Motion carried.

9. Contingent approval of a Reduction-In-Force, by the LPSS Board, if such is caused by the approval of the 2015-2016 budget

A motion was made by Centanni and seconded by Morrison that the LPSS Board declare a RIF which is contingent upon the adoption of the 2015-2016 budget, if such becomes necessary. After some discussion, the motion was withdrawn.

Motion (Knezek, Hidalgo) That the Board approve reduction in force as required by the adoption of 2015-2016 budget.

Voting for were Angelle, Centanni, Hidalgo, Knezek, Latiolais, and Morrison. Voting against were Broussard, Chassion, and Morris. Motion carried.
