OFFICE AND PROFESSIONAL EMPLOYEES' INTERNATIONAL UNION, LOCAL 378 TERESA SC ASSA• I. INTRODUCTION A recent decision from the British Columbia Supreme Court, British Columbia Automobile Assn. v. O.P.E.I. U., local 378, 1 raises issues of"passing off," trademark, and copyright infringement relating to web sites, domain names,2 and meta tags. 3 In this comment I will explore these issues, all of which may commonly arise in situations of alleged competition between web sites. The case thus provides a context for exploring legitimate and unlawful uses of domain names and meta tags, copyright infringement, and web site design, and it touches on the role of s. 22 of the Trade-marks Act. 4 Because BCAA also occurs in the context of a labour dispute, it raises further issues about intellectual property rights and freedom of expression. These issues have arisen before in the non-Internet labour dispute cases of Cie Generate des Etablissements Michelin Michelin & Cie v. C.A. W.-Canada5 and Rotisseries St-Hubert ltee v. le Syndical des Travailleurs(euses) de la Rotisserie St-Hubert De Drummondville (C.S.N.),6 and their resolution continues to raise serious concerns about the balance being struck between monopolistic intellectual property rights and the fundamental right of freedom of expression. The plaintiff, British Columbia Automobile Association ("BCAA''), a member of the national Canadian Automobile Association ("CAA"), sued the defendant Office and Professional Employees' Union ("Union") over three successive web sites created by the Union to publicize a strike by BCAA employees. -

INTRODUCTION 1 Chad Wayland, a university student, was an avid snowboarder. When he was not on the slopes or involved with homework, he was waxing his board or experimenting with adjustments to it in his garage. Chad ended up with a small garage business, fixing up snowboards for his friends and their friends. One day, a Japanese corporation approached Chad and asked if he would sell them a few of his modified snowboards. Knowing that this was an excellent opportunity to develop a business that he really loved, Chad accepted the offer. He purchased twenty snowboards from the Slide Corporation, modified fifteen of them, and sent the entire batch to the Japanese corporation. The Japanese corporation was impressed with his modified board. It ordered 200 more and offered to pay a very large amount. -

Vol. 93 TMR 1035 RECONSIDERING INITIAL INTEREST CONFUSION ON THE INTERNET By David M. Klein and Daniel C. Glazer∗ I. INTRODUCTION Courts developed the theory of initial interest confusion (or “pre-sale confusion”) to address the unauthorized use of a trademark in a manner that captures consumer attention, even though no sale is ultimately completed as a result of any initial confusion. During the last few years, the initial interest confusion doctrine has become a tool frequently used to resolve Internet- related disputes.1 Indeed, some courts have characterized initial interest confusion on the Internet as a “distinct harm, separately actionable under the Lanham Act.”2 This article considers whether the initial interest confusion doctrine is necessary in the context of the Internet. Courts typically have found actionable initial interest confusion when Internet users, seeking a trademark owner’s website, are diverted by identical or confusingly similar domain names to websites in competition with, or critical of, the trademark owner. A careful analysis of these decisions, however, leads to the conclusion that a distinct initial interest confusion theory may be unnecessary to resolve cases involving the unauthorized use of a trademark as a domain name. In fact, traditional notions of trademark infringement law and multi-factor likelihood of confusion tests may adequately address the balancing of interests required in cases where courts must define the boundaries of trademark owners’ protection against the use of their marks in the domain names of competing websites. The Federal Trademark Dilution Act (FTDA)3 and the Anticybersquatting Consumer Protection Act (ACPA)4 provide additional protection against the unauthorized use of domain names that dilute famous marks or evidence a bad ∗ Mr. -

It will not be a hyperbole to throne this year as the flag bearer of cardinal transformations. Court refuses to prevent use of identical mark for dissimilar goods Dilution India - Nishith Desai Associates - Legal & Tax Counselling Worldwide Passing off November 25 2010 In Kamdhenu Ispat Ltd v Kamdhenu Pickles & Spices Ind Pvt Ltd (October 18 2010), the Delhi High Court has rejected a request for a permanent injunction preventing the defendant from using the mark KAMDHENU. Plaintiff Kamdhenu Ispat Ltd is engaged in the business of manufacturing and marketing steel bars. It has also expanded into other businesses, such as cement and construction. The plaintiff is the registered proprietor of approximately seven registered trademarks containing the word ‘Kamdhenu’. Defendant Kamdhenu Pickles & Spices Ind Pvt Ltd manufactures and retails pickles, spices and condiments, among other things. The plaintiff sought a permanent injunction before the Delhi High Court, alleging infringement of its KAMDHENU mark and passing off. It also sought other reliefs, such as damages and delivery-up. Before the court, the plaintiff argued as follows: l KAMDHENU is a well-known trademark, trade name, service mark and brand name. l It had produced copies of invoices, advertisements and annual reports, among other things, to establish use of the KAMDHENU mark. l The defendant used the trademark KAMDHENU in bad faith. l Due to extensive use, KAMDHENU has become a household brand in respect of steel bars. The plaintiff thus sought an injunction restraining the defendant from manufacturing any goods, or engaging in any commercial dealings, under the mark KAMDHENU or any other deceptively similar mark. The defendant argued as follows: l It had no intention of deriving any benefits from the plaintiff's trade name. -

INTRODUCTION This article presents the results of a world-wide survey of one aspect of trademark litigation--provisional relief for trademark infringement. This survey was made from the perspective of a United States trademark practitioner. The first objective of the study was to provide information on how trademark practitioners view the current status of provisional remedies for trademark infringement in their respective jurisdictions. A second objective was to provide world-wide information on the availability of provisional remedies in trademark infringement cases immediately prior to the adoption of "minimum standards" for enforcement of trademark rights as set forth in the Trade Related Aspects Of Intellectual Property (TRIPs) agreement that was finalized in December 1994 [n.1] as part of the General Agreement On Tariffs And Trade (GATT). *68 A.
