MEASURE'S PURPOSE: This measure establishes the penalty for indecent exposure in the first degree and in the second degree.
PROVISION/MECHANICS: This measure creates a new section of KRS 510 to establish the penalties for a person found guilty of indecent exposure in the first degree as a Class A misdemeanor and a Class D felony for subsequent offenses; This measure also amends KRS 510.150 to establish the penalty for indecent exposure in the second degree as a Class B misdemeanor.
FISCAL EXPLANATION: The fiscal impact is anticipated to be minimal and is related to the Class D felony charge.
During fiscal year 2002-2003, there were 236 convictions of indecent exposure, it is not known how many of these involved a person under the age of 18.
If a person was convicted of this offense, it can be estimated that the sentence would be served at a regional jail at a cost of $27.31 per day. The cost per inmate per year would be approximately $10,000.
