Title : Article 3 and Paposhvili: medical claims

The Grand Chamber judgement in Paposhvili v Belgium (App no 41738/10) has at last expanded the scope for Article 3 medical claims from the highly restrictive categories in D v United Kingdom (App no 30240/96) and N v United Kingdom (App no 26565/05). This seminar examines the implications of Paposhvili and scope for making appeals or fresh claims on medical grounds. It also guides you through difficult related topics including (i) Article 3 suicide risk; (ii) capacity and appointment of litigation friends; (iii) vulnerable witnesses; (iv) the Equality Act 2010. This seminar guides you through the latest caselaw on unlawful detention, including claims involving physical and mental ill health, where there is evidence of torture and the particular issues arising from detention of EU nationals and stateless persons. It also examines the latest decisions on damages and quantum.

The Supreme Court has delivered a trio of important decisions consolidating the law concerning the application of article 8 ECHR in immigration cases, including the effect of provisions introduced by HC 194 in July 2012. The seminar examines these three key decisions of the Supreme Court and provides an account of their current effect, as well as identifying subsisting questions and potential future developments.

As the Article 50 process commences, and the post-Brexit landscape becomes (ever so slightly) clearer, this seminar examines life beyond EU membership. With free movement of labour ending, or at the very least changing dramatically, the seminar will explore the policy problems facing the Home Office and how clients are likely to be affected by the new reality of UK immigration control. The inevitability of complex "transitional provisions" will require examination of how these will interact with underlying rights, providing options for challenge should clients find themselves disadvantaged.
