Chapter 3, Title 56 of the 1976 Code is amended by 23 adding: 24 25 “Article 79 26 27 ‘Choose Life’ Special License Plates 28 29 Section 56-3-7950. (A) The Department of Motor Vehicles 30 shall issue special motor vehicle license plates to owners of private 31 passenger carrying motor vehicles or light pickups having an 32 empty weight of seven thousand pounds or less and a gross weight 33 of nine thousand pounds or less registered in their names which 34 shall have imprinted on the plate the words ‘Choose Life’. The fee 35 for this special license plate is seventy-five dollars every two years 36 in addition to the regular motor vehicle license fee set forth in 37 Article 5. This special license plate must be of the same size and 38 general design of regular motor vehicle license plates. The special 39 license plates must be issued or revalidated for a biennial period 40 which expires twenty-four months from the month they are issued. 41 (B) The fees collected pursuant to this section, after the costs to 42 produce and administer the distribution of this special license

1 [3382] 1 1 plate, must be deposited in a special account, separate and apart 2 from the general fund, designated for use by the Department of 3 Health and Environmental Control to be used to support research 4 for the prevention and cure of breast cancer. 5 (C) Before the Department of Motor Vehicles produces and 6 distributes a special license plate pursuant to this section, it must 7 receive four hundred prepaid applications for the special license 8 plate or a deposit of four thousand dollars from the individual or 9 organization seeking issuance of the license plate. If a deposit of 10 four thousand dollars is made by an individual or organization 11 pursuant to this section, the department must refund the four 12 thousand dollars once an equivalent amount of license plate fees is 13 collected for that organization’s license plate. If the equivalent 14 amount is not collected within four years of the first issuance of 15 the license plate, the department shall retain the deposit. 16 (D) If the department receives less than three hundred biennial 17 applications and renewals for the ‘Choose Life’ special license 18 plate, it may not produce additional special license plates in that 19 series. However, the department shall continue to issue special 20 license plates of that series until the existing inventory is 21 exhausted.” 22 23 SECTION 2. Chapter 3, Title 56 of the 1976 Code is amended by 24 adding: 25 26 “Article 80 27 28 ‘Choose Abortion’ Special License Plates 29 30 Section 56-3-7970. (A) The Department of Motor Vehicles 31 shall issue special motor vehicle license plates to owners of private 32 passenger carrying motor vehicles or light pickups having an 33 empty weight of seven thousand pounds or less and a gross weight 34 of nine thousand pounds or less registered in their names which 35 shall have imprinted on the plate the words ‘Choose Abortion’. 36 The fee for this special license plate is seventy-five dollars every 37 two years in addition to the regular motor vehicle license fee set 38 forth in Article 5. This special license plate must be of the same 39 size and general design of regular motor vehicle license plates. The 40 special license plates must be issued or revalidated for a biennial 41 period which expires twenty-four months from the month they are 42 issued.
