Village of Dousman Board Proceedings June 12, 2017

PRESENT: Pres. Nissen, H. Dessart, R. Hawk, C. Queen & D. Geiger ABSENT: None ALSO PRESENT: J. Kitelinger, Utilities Superintendent; G. Powell, Village Engineer and E. Larson; Village Attorney

The meeting was called to order by Pres. Nissen and the confirmation of public meeting notice was affirmed by Clerk Nissen

CHIEF BOWEN; DOUSMAN FIRE DISTRICT UPDATE

Chief Bowen handed out Monthly Report and went over the highlights.

TIM MEYER; WAUKESHA COUNTY PRE-DISASTER RECOVERY PLANNING

Chief Bowen stated July 11th Deputy Chief Tim Meyer would like to have a meeting of the Emergency Operations Center with the Summit Police and Village Committee consisting of Pres. Nissen, S. Hall and C. Igl. They discussed the date and time of the meeting and would like to have the meeting during the day. Chief will have T. Meyer set something up for a noon meeting.

CINDY QUEEN; DOUSMAN CHAMBER OF COMMERCE; CORY PARK STATUE

C. Queen spoke about the statue that the Chamber is interested in putting in Cory Park. The statue will be of a boy jumping a frog. The idea is to have it at the front of the park by the trees behind the bleachers. The Board would like to see a map showing exactly where they would like it. Pres. Nissen made a motion granting space in the park for the statute subject to the Chamber bringing in a map and deciding on a spot. D. Geiger seconded. Carried. C. Queen abstained.

STEVE WURSTER; RUEKERT & MIELKE; PRESENTATION OF STORM WATER PLANNING REPORT AND STORMWATER GRANTS

Steve Wurster gave a power point presentation on TMDL (Total Maximum Daily Loads) Master Plan Update.

POLICE DEPARTMENT

Chief Hartert went over monthly report.

DPW/SEWER/WATER DEPARTMENT

J. Kitelinger stated that the Village has been having a lot of power outages lately. He has contacted We Energies but they have not responded to him yet.

J. Kitelinger asked the Board if they thought it would be alright to take down the white poles going along the lot and driveway behind the Village Hall. He stated it would be expensive to replace all of those. The Board agreed that we could take them down now and if a problem arose in the future they would discuss again.

CONSIDERATION/POSSIBLE ACTION ON RESOLUTION #04-17 COMPLIANCE MAINTENANCE RESOLUTION

J. Kitelinger went over the results of the CMAR for 2016. A copy of the report will be attached to the Resolution.

R. Hawk made a motion to approve Resolution #04-17 Compliance Maintenance Resolution. H. Dessart seconded. Carried. Pres. Nissen abstained.

DISCUSSION CHANGES TO ORDINANCE 13.14 (5) MAINTENANCE OF SERVICES

J. Kitelinger explained to the Board that an issue had come up that made him look at this ordinance. He said currently it states that the property owner is only responsible for maintenance of the sewer from the property line to the house. He discussed with the Board having this changed to say they are responsible from the main to the house. He stated that there are many ways that the resident could do damage to the lateral without proper upkeep and the Village would be responsible for part of it with the current wording. The Board all agreed and advised the Village Attorney to do some research and get some samples of wording back to J. Kitelinger. Village of Dousman Board Meeting Minutes June 12, 2017 Page 3.

ORDINANCE #357 AN ORDINANCE TO REPEAL AND RE-CREATE SECTION 14.1.2(C) OF THE VILLAGE OF DOUSMAN VILLAGE CODE CONCERNING BUILDING PERMIT ISSUANCE FOR PROPERTIES NOT ABUTTING A PUBLIC STREET

Attorney Larson told the Board that this issue had come up while he was working on getting the Conditional Use together for Level 3 in regards to building permits being not being issued unless the property has approved access to a public street. Attorney Larson went over the changes in regards to new developments, private streets or drives and existing public roads.

Pres. Nissen made a motion to approve Ordinance #357. C. Queen seconded. Carried.

ORDINANCE #358 AN ORDINANCE TO CREATE SECTION 14.1.2 OF THE VILLAGE OF DOUSMAN VILLAGE CODE CONCERNING DRIVEWAY CONSTRUCTION STANDARDS IN STREET RIGHTS OF WAY

J. Kitelinger spoke to Attorney Larson about making changes to our ordinance in regards to the construction in the street rights of way. The change made states that the portion of a residents driveway that is in the Village right of way shall be paved with asphalt.

Pres. Nissen made a motion to approve Ordinance #358. R. Hawk seconded. Carried.

CONSIDERATION/POSSIBLE ACTION ON RESOLUTION #05-17 A RESOLUTION AUTHORIZING THE BORROWING OF $175,917.00 FOR THE PAYMENT TO THE WESTERN LAKES FIRE DISTRICT FOR 2017 CAPITAL FUNDING

Clerk Nissen had contacted Ixonia State Bank to get some financing information for this amount and he had e-mailed back some different terms and interest rates. The Board needed to decide how long they wanted to borrow for.

Pres. Nissen made a motion to approve Resolution #05-17 for the borrowing of $175,917.00 for the payment to Western Lakes Fire District for the 2017 Capital Funding for a term of 5 years at 2.99% through Ixonia Bank. CONSIDERATION/POSSIBLE ACTION ON 2017/2018 LIQUOR LICENSES

A Combination Class “B” fermented malt beverage and intoxicating liquor license to Bark River Yacht Club, Inc., Richard J. Thome, Agent, 136 N. Main Street, was granted on a motion by R. Hawk, seconded C. Queen, carried.

A Combination Class “B” fermented malt beverage and intoxicating liquor license to the Lion’s Club of Dousman/Ottawa, Inc., Larry Williams, Sr. Agent, for the Lions Community Center, 235 N. Main Street, was granted on a motion by C. Queen, seconded Pres. Nissen, carried.

A Combination Class “B” fermented malt beverage and intoxicating liquor license to Richard Lyshek, for the Dousman House, 128 N. Main Street, was granted on a motion by Pres. Nissen, seconded H. Dessart, carried.

A Combination Class “A” fermented malt beverage and intoxicating liquor license for Mike and Rocco’s Corner Stop, Inc., T. Michael Tyler, Agent, d/b/a Mike and Rocco’s Corner Stop, Inc., 200 N. Main Street, was granted on a motion by D. Geiger, seconded H. Dessart, carried.

A Class “A” fermented malt beverage license to L.B. Unlimited, Inc., Lee M. Bleecker, Agent, d/b/a The Paper Chase Station, 159 Hwy 67, was granted on a motion by H. Dessart, seconded R. Hawk, carried.

A Class “B” Beer fermented malt beverage license to Kyle Krischan Whale-Tale Archery LLC, 109 Main Street, was granted on a motion by R. Hawk, seconded C. Queen, carried.

A Class “B” Beer fermented malt beverage and Class “C” Wine license to Lizeth Garcia for Sunny Side Up, 159B Hwy 67, was granted on a motion by C. Queen, seconded Pres. Nissen, carried.

A Class “B” Beer fermented malt beverage and Class “C” Wine license to Deborah Leinweber, for Deb’s Main Street Diner, 120 N. Main Street, was granted on a motion by Pres. Nissen, seconded D. Geiger, carried.

A Reserve Class B Liquor License to Lee M. Bleecker, Agent, d/b/a The Other Bar, 159C Hwy 67, was granted on a motion by D. Geiger, seconded H. Dessart, carried.

Renewal Operator’s licenses for the following were granted based on a satisfactory record check by the Police chief, on a motion by Pres. Nissen, seconded C. Queen carried:
