1 Performance Rider: The purpose of this rider is to allow ARTIST to provide the best performance possible for BUYER and the public. STAGE /RISERS: A. The stage shall be no less than 16'x16'x1.5'. (N/A) B. In the case of an outdoor concert venue, BUYER must provide a covered, load-bearing (N/A) top, capable of protecting Artist personnel and all equipment from direct sun, rain and other inclement weather. SOUND/LIGHT: A. Sound and Lighting shall be provided by BUYER unless otherwise stated on face of contract and agreed to by Agent or Artist Management. B. Sound and Light in A. shall substantially meet or exceed system requirements outlined in ARTIST StagePlot. C. Sound Engineer familiar with sound system shall be present to cordially assist Artist and Artist Engineer in setting up, checking and providing the best possible sound in good faith under the Artist and Artist Engineer’s direction. D. Sound Engineer for FOH mix shall be provided by Artist at discretion of Artist Management. E. Artist Sound Engineer shall at all times have complete and unrestricted accesses to mixing consoles before and during all performances. F. Artist and Artist Engineer shall have final artistic control including but not limited to FOH mix levels during performance.

CANCELLATION: A. ARTIST'S obligation to perform hereunder shall be excused if ARTIST, or any of his group or essential crew, is unable to perform as a result: illness or injury; detention resulting from inability to obtain reasonable modes of transportation; riots or other civil strife; strikes or other forms of labor disputes; epidemics; an act or order of any public authority or court; any act of God; or any other cause beyond ARTIST'S reasonable control. In such event, ARTIST will not be required to perform and shall return to PURCHASER any deposits paid, less costs incurred by ARTIST and neither party shall be under any other obligation to each other. Not withstanding anything contained herein, inclement weather shall not be deemed a Force Majeure occurrence, except by act of civil authority, and the Purchaser shall remain liable for payment of the full contract price even if the performance(s) called for herein are prevented by such weather conditions. Producer or artist manager shall have the sole right to determine in good faith whether any such weather conditions shall render the performance(s) impossible, hazardous or unsafe. In this case all reasonable attempts shall be made to schedule another performance at a reduced rate.

BILLING/OPENING ACT: A. The billing for this engagement is to be Headliner (Festival) or Top Sole Performer (Concert) in any and all advertising, publicity and websites. Standard publicity should include adequate advertising in local newspapers, magazines, radio, TV, flyers and posters. Photo and links of artist must be displayed in prominent position on venue website. B. Artist is to headline or close show unless otherwise stated on face of contract and agreed to by Agent or Artist Management. C. No other programming or opening act may appear in a concert without the approval of ARTIST. D. The creative control and content of the entire presentation are at the sole discretion of the ARTIST. Catering — Hot meals or fresh sandwiches and salads shall be provided for six (6) persons.

Final configuration of Artist/Band at concert shall be determined solely by Artist and Artist management. Purchaser shall indemnify and hold Artist and all persons and entities (Management personnel, employees, agents, representatives and attorneys) harmless from and against any and all claims, demands, actions liabilities, costs and expenses (including attorney and other professional fees) arising out of or in connection with the concert, unless same is caused directly by the tortious conduct of the Artist or any of the indemnified persons. Purchaser is responsible for and must have its own public liability and property damage insurance. In the event of any breach of any conditions contained herein, the Artist may cancel the performance without any further liability to the Purchaser and the Purchaser is obliged to pay the full contract price to the Artist. www.mactalla.com
