SUB: REPRESENTATION FOR GRANT OF THE BAND PAY OF RS. 9300-34800 WITH GRADE PAY OF RS. 4200/- WITH EFFECT FROM ______ON 2ND MACP.

Sir,

I beg to lay following few lines for your kind perusal and favorable order.

1. That, I joined in the Govt. service on ______as LDC. Now, I am serving/continuing as______under the administrative control of Director, GDC, Survey of India, . On introduction of Assured Career Progression (in short ACP) Scheme, I was granted Ist Financial Upgradation after completion of 12 years of required period of service with effect from______and was placed in the next higher scale of pay i.e. 4000-6000 for the promotional post of UDC.

2. That, the Modified Assured Career Progression (in short MACP) Scheme was introduced in the year 2008 on recommendations of 6th CPC and the required period of service to be rendered to earn Financial Upgradation was made on interval of 10, 20 and 30 years. Accordingly, on completion of 20 years of service, I was granted 2nd MACP with effect from______. As per 6th CPC MACP Rules, I should have been allowed/granted the Pay Band of Rs. 9300-34800 with Grade Pay Rs. 4200/-with effect from______i.e. on completion of 20 years of service. In the mean time more than _____ years have passed but I have not been allowed/granted the same Band Pay and Grade pay

3. That, it is pertinent to mention here that the Hon'ble Central Administrative Tribunal, Chandigarh, the Hon'ble Punjab & Haryana High Court as well as the Hon'ble CAT, Principal Bench, New Delhi have allowed the aforesaid benefit to the similarly situated employees who are working under the different departments of the Central Govt. For better appreciation of the case, the operative portions of the judgments are quoted hereunder:-

"The applicant therein was entitled for the 2nd Financial Upgradation in the next hierarchy of post and not in the next grade pay. " It has also been settled that the ACP would be granted on completion of the required years of service in the hierarchy of posts for the posts of LDC/Hindi Typists and not in the next higher scale in the recommended scales. The same principle would have to be applicable in regard to grant of MACP to the applicant."

" The eligible government servants are to be placed in the immediate next higher grade pay in the hierarchy of the recommended revised pay bands and grade pay and not merely in the next higher scale of pay as per the recommendations of the 6th CPC. In the hierarchy, after the scale of UDC, the next scale is that of Assistant. Therefore, the respondents should have given the next higher grade pay and pay band attached to the next promotional post in the hierarchy, namely, the Assistants carrying the pay scale of -2-

Rs. 9300-34800 and the grade pay of Rs. 4200/- (passed vide judgment dated 26-11-2012 passed in O.A. No. 904/2012 by the Hon'ble CAT Principal Bench New Delhi and vide judgment dated 19/10/2011 passed in CWP No. 19387/2011 by Hon'ble High Court Punjab and Haryana at Chandigarh. extract copy of which is enclosed herewith as Annexure)

In view of the above judicial pronouncements in foregoing paragraphs and settled position of law, you are requested to kindly grant me the Band of Rs. 9300-34800 with Grade Pay of Rs. 4200/- with effect from ______i.e. from the date I have completed 20 years of service and for which act of kindness, I shall remain ever grateful to you.
