Section 121085(B) of the 1976 Code is amended to 24 read: 25 26 “(B) Rural Infrastructure Fund grants must be available to 27 benefit counties or municipalities designated as ‘Tier IV’ or ‘Tier 28 III’ as defined in Section 1263360 according to guidelines 29 established by the council, counties with a population of less than 30 forty thousand residents, according to the latest official United 31 States Census, and municipalities located in a county with less 32 than forty thousand residents, according to the latest official 33 United States Census, except that up to twentyfive percent of the 34 funds annually available in excess of ten million dollars must be 35 set aside for grants to areas of ‘Tier II’ and ‘Tier I’ counties. A 36 governing body of a ‘Tier II’ or ‘Tier I’ county must apply to the 37 council for these setaside grants stating the reasons that certain 38 areas of the county qualify for these grants because the conditions 39 in that area of the county are comparable to those conditions 40 qualifying a county as ‘Tier IV’ or ‘Tier III’.” 41
