You have obtained an Order of Protection or Injunction Against Harassment from a Maricopa County Justice Court. The defendant can be located in the Central Valley. Who can serve this Order?

The defendant must be served with a copy of the Petition for the Order of Protection or Injunction Against Harassment and a copy of the signed Order of Protection or Injunction Against Harassment. It is the plaintiff’s responsibility to start the process of serving the defendant. ONLY law enforcement or a registered process server can serve the Order of Protection (OP) or Injunction Against Harassment (IAH). Service of the OP/IAH has priority over other service that does not involve an immediate threat to safety.

The plaintiff should have an additional copy of the OP/IAH in their possession in order for law enforcement to complete service on the defendant if the defendant has not been served and comes near you. Call 911; explain that you have an OP or IAH and the defendant is approaching you, and that you also need the paperwork served. Have the law enforcement officer serve the defendant with your copy of the OP/IAH.

It is important that you keep a copy of your OP/IAH and Declaration of Service with you at all times. This is your proof that such an order has been issued against the defendant. Your OP/IAH is good for one year from the date of service on the defendant.
