WARRANT FOR TOWN MEETING

TO: LARRY WHITE, A CONSTABLE IN THE TOWN OF JAY, COUNTY OF FRANKLIN, STATE OF MAINE:

In the name of the State of Maine, County of Franklin, you are hereby required to notify and warn the inhabitants of the Town of Jay, in said County, qualified to vote in Town affairs, to meet in the Jay Community Building, in said Town, on Tuesday, the 12th day of June A.D. 2007 at 9:00 A.M. in the forenoon, then and there to act on the following articles to wit:

ARTICLE 1 To choose a moderator to preside at said meeting.

ARTICLE 2 To choose by ballot the following Town Officers, for the ensuing year in accordance with Title 30-A Section 2528, of the Revised Statutes of Maine for the year 1964 and amendments thereto, to wit: One Selectmen, Assessors, and Overseers of the Poor, Third for three years: and Two Members of the School Board for three years: Three trustees for the Jay Power District, One for one year; one for two years; and one for three years.

To vote by ballot the following warrant articles for the ensuing year in accordance with Title 30- A Section 2528, of the Revised Statutes of Maine for the year 1964 and amendments thereto.

ARTICLE 3 To see if the Town will vote to lapse the overdrafts and unexpended balances.

ARTICLE 4 To see if the Town will vote to set October 1, 2007 and April 1, 2008 as the date that property taxes are due and payable.

ARTICLE 5 To see if the Town will vote to levy and accrue interest at the rate of eight (8%) per annum on property taxes that are unpaid after October 1, 2007 and April 1, 2008.

ARTICLE 6 Shall an Ordinance entitled “First Ordinance Amending the Jay Administrative Ordinance” be enacted?

TOWN GOVERNMENT ARTICLE 7 Shall the Town vote to raise and appropriate a sum of $499,380.00 for Town Government.

BUILDINGS & GROUNDS ARTICLE 9 Shall the Town vote to raise and appropriate a sum of $85,950.00 for Buildings & Grounds. (includes building maintenance, Christmas decorations, cemetery care and animal control)

DISPATCH ARTICLE 10 Shall the Town vote to raise and appropriate a sum of $200,250.00 for Dispatch. Note: A no vote means moving Dispatch Service to Franklin county Dispatch Service.

POLICE DEPARTMENT ARTICLE 11 Shall the Town vote to raise and appropriate a sum of $720,524.00 for the Police Department

5 DEBT SERVICE ARTICLE 35 Shall the Town vote to raise and appropriate a sum of $289,500.00 for Debt Services.

LIBRARY ARTICLE 36 Shall the Town vote to raise and appropriate a sum of $156,569.00 for the Library.

SELECTMEN RECOMMEND: YES BUDGET COMMITTEE RECOMMENDS: YES

HYDRANT RENTAL, WATER AND STREET LIGHTS ARTICLE 37 Shall the Town vote to raise and appropriate a sum of $283,510.00 for Hydrant Rental, Water and Street Lights.

REVENUES TO REDUCE TAX COMMITMENT ARTICLE 38 To see if the Town will vote to appropriate all revenues received, that are not dedicated or otherwise appropriated for other expenses, to reduce the tax commitment. Estimated amount $2,237,040.00

SNOWMOBILE FUND ARTICLE 39 Shall the Town vote to appropriate to the Jay Snowmobile Fund the payment received annually by the Town of Jay from the Maine Department of Inland Fisheries and Wildlife from snowmobile registrations paid by Jay citizens.

ATV CLUB ARTICLE 40 To see if the town will vote to appropriate $1.00 (one dollar) for each ATV Registration that is done in the Town of Jay to the Western Maine ATV Club.

6 SUMMER RECREATION ARTICLE 41 Shall the Town vote to raise and appropriate a sum of $20,000.00 for Summer Recreation.

SPRUCE MOUNTAIN ARTICLE 42 Shall the Town vote to raise and appropriate a sum of $8,330.00 for the support of Spruce Mountain.

SELECTMEN RECOMMEND: YES BUDGET COMMITTEE RECOMMENDS: YES

CHANNEL 7 ARTICLE 43 Shall the Town vote to appropriate the Cable TV Franchise Fees received annually by the Town of Jay from our Cable TV Company for the support and operation of Public Access TV.

SELECTMEN RECOMMEND: YES BUDGET COMMITTEE RECOMMENDS: YES

TENNIS COURTS ARTICLE 44 Shall the Town vote to raise and appropriate a sum of $76,600.00 for Tennis Court. (this is for reconstruction and repaving of the existing court)

SELECTMEN RECOMMEND: YES BUDGET COMMITTEE RECOMMENDS: YES

ALLEN STREET EASEMENT ARTICLE 45 To see if the Town, pursuant to 23 M.R.S.A. § 3025 and other Maine laws, will vote to accept the dedication of easements over certain parcels of land for highway, drainage, and sewerage purposes on land owned by Janet L. Diaz located on the westerly end of the town way known as Allen Street and more particularly described on a Plan dated February 6, 2007, entitled “Survey Plan Made for the Town of Jay (End of Allen Street)”, surveyed by Kachnovich Land Surveying, Inc., and to establish a Town Way over Allen Street Easement and to authorize the Selectmen to accept on behalf of the Town the deed from Janet L. Diaz conveying such easements to the Town under such terms and conditions as are in the best interests of the Town.

7 PURINGTON ROAD ARTICLE 46 To see if the Town, pursuant to 23 M.R.S.A. § 3025, will vote to accept the dedication of a certain parcel of land for a Town Way for Highway Purposes from HAROLD W. KNOCKWOOD, SUSAN N. KNOCKWOOD, PHILLIP W. HAMILTON, JOANNE E. HAMILTON, STANLEY L. RIDLEY, SHERALYN J. RIDLEY, MARTHA E. HINES, KEITH P. NEWHALL, MARLENE R. NEWHALL, and THOMAS CERULLI, being more particularly bounded and described in a deed from Harold W. Knockwood, Susan N. Knockwood, Phillip W. Hamilton, Joanne E. Hamilton, Stanley L. Ridley, Sheralyn J. Ridley, Martha E. Hines, Keith P. Newhall, Marlene R. Newhall and Thomas Cerulli to the Town of Jay and to authorize the Selectmen to accept on behalf of the Town a deed from the landowners under such terms and conditions as are in the best interest of the Town.

END OF VISTAVIEW DRIVE ARTICLE 47 To see if the Town, pursuant to 23 M.R.S.A. § 3025 and 33 M.R.S.A. § 458, will vote to accept the dedication of a certain parcel of land for a Town Way for Highway Purposes and Utility Services from JAMES G. RICHARDS, GERARD J. RICHARDS, and KENNETH W. RICHARDS, being more particularly bounded and described in the easement deed from James G. Richards, Gerard J. Richards and Kenneth W. Richards to the Town of Jay and to authorize the Selectmen to accept on behalf of the Town a deed from the landowners under such terms and conditions as are in the best interest of the Town.

ARTICLE 48 To see what sum the municipality will appropriate for the total cost of funding public education from kindergarten to grade 12 as described in the Essential Programs and Services Funding Act (Recommend $7,374,269.00_) and to see what sum the municipality will raise as the municipality’s contribution to the total cost of funding public education from kindergarten to grade 12 as described in the Essential Programs and Services Funding Act in accordance with the Maine Revised Statutes, Title 20-A, section 15688. Recommend $ 6,328,836.00

The following statement must accompany this article in subparagraph: “Explanation: The school administrative unit’s contribution to the total cost of funding public education from kindergarten to grade 12 as described in the Essential Programs and Services Funding Act is the amount of money determined by state law to be the minimum amount that a municipality must raise in order to receive the full amount of state dollars.”

ARTICLE 49 Shall the Town of Jay raise and appropriate $2,092,171.00 in additional local funds, which exceeds the State’s Essential Programs and Services allocation model by $1,820,443.00 as required to fund the budget recommended by the School Committee?

The School Committee recommends $2,092,171.00 for additional local funds and gives the following reasons for exceeding the State’s Essential Programs and Services funding model by $1,820,443.00 8 The School Committee recommends this for the following reasons: greater costs for co-curricular activities than designated in Essential Programs and Services; higher than average salaries and benefits for staff; optimum teacher / pupil ratio staffing levels.

The following statement must accompany this article in subparagraph:

Explanation: The additional local funds are those locally raised funds over and above the school administrative unit’s local contribution to the total cost of funding public education from kindergarten to grade 12 as described in the Essential Programs and Services Funding Act and local amounts raised for the annual payment on non-state funded debt service that will help achieve the municipality budget for educational programs.

ARTICLE 50 To see what sum the municipality will authorize the school committee to expend for the fiscal year beginning July 1, 2007 and ending June 30, 2008 from the school administrative unit’s contribution to the total cost of funding public education from kindergarten to grade 12 as described in the Essential Programs and Services Funding Act, non-state-funded school construction projects, additional local funds for school purposes under the Maine Revised Statutes, Title 20-A, section 15690, unexpended balances, tuition receipts, state subsidy and other receipts for the support of schools. Recommend $9,962,139.00

ARTICLE 51 To see what sum the municipality will appropriate for Adult Education (Recommend $79,760.00) and to see what sum the municipality will raise as the local share. Recommend $79,760.00

ARTICLE 52 Shall the municipal be authorized to issue notes not to exceed a period of five years in the name of the municipality for the purpose of purchasing a school bus in an amount not to exceed $65,000.00 and appropriate the same.

9 ARTICLE 53 To see if the municipality will reduce the additional local appropriation raised pursuant to Maine Revised Statutes, Title 20-A, §15690(3) for public schooling by the amount of any unanticipated state general purpose aid received for the fiscal year beginning July 1, 2007 and ending June 30, 2008.

ARTICLE 54 To see if the Town will vote to authorize the Selectmen to appropriate up to $500,000.00 from the Undesignated Fund as they deem advisable for school purposes in order to allow the schools to operate until the school budget is approved and to transfer, after the school budget has been approved, from the school budget to the Undesignated Fund an amount equal to the amount so appropriated.
